Adopt Resolution No. 9g - IY 7 approving an immediate one-time reimbursement to the Carlsbad Ranch Company, L.P., for the construction of Master Drainage Plan facility CB and CC in the amount
of $165,882.
ITEM EXPLANATION:
As a condition of approval for the development of Carlsbad Ranch (CT 92-07 and CT 94-09), the
Carlsbad Ranch Company, L.P., developer of the project, was required to construct storm drain facilities identified as Planned Local Drainage Facility CB and CC on the Master Drainage and Storm
Water Quality Management Plan (Master Drainage Plan). In accordance with the provisions of the
Drainage Ordinance, Carlsbad Municipal Code Section 1508.080, the City Council at its discretion
may enter into a reimbursement agreement with any developer who has constructed a Planned Local
Drainage (PLD) facility identified within the Master Drainage Plan.
The developer’s contractor has completed construction of the drainage facility. Total design and
construction cost of the project to the developer, as verified by the Assessment Engineer, was
$1,299,270. Of that amount the Carlsbad Ranch Company, L.P., has been reimbursed $1,133,388,
through the Carlsbad Ranch Assessment District. The Carlsbad Ranch Assessment District could only
assess PLDA fees that were due as a result of the development approval. The storm drain facilities
have a benefit to others so the reimbursement from the PLDA account can be done now. Carlsbad Ranch Company, L.P., is also eligible for reimbursement for the cost of design of $31,371.
The Drainage Ordinance specifies that payment of any reimbursement shall be limited to the extent
that the funds are available through the collection of Planned Local Drainage Area (PLDA) fees. The
total amount of funds available for reimbursement through the collection of PLDA fees for facility CB and CC is estimated at $518,223 ($1,651,611 less $1,133,388 previously reimbursed). Since the
amount available for reimbursement exceeds the actual storm drain costs eligible for reimbursement,
the developer is eligible to receive a 100% reimbursement on the constructed facility with no
modification to the existing PLDA fee program.
The City presently has adequate funds within the PLDA fee accounts to pay the requested
reimbursement while maintaining adequate resources to fund all the Planned Local Drainage Area projects listed in the City’s current five-year Capital Improvement Program. Staff is, therefore,
recommending that an immediate one-time reimbursement be made to Carlsbad Ranch Company,
L.P., in the full amount of $165,882.
FISCAL IMPACT:
The total cost to the Carlsbad Ranch Company, L.P., to construct PLD facility CB and CC, as verified
by the Assessment Engineer, was $1,267,899 not including all design costs. The total cost assessed
in Assessment District AD 95-01 was $1 ,I 33,388. The cost assessed in the Assessment District was
the drainage fees owed by the developer. The Assessment District could only assess the PLDA fees because that was the developer’s benefit. The difference of $134,511 for the construction costs can be
reimbursed to Carlsbad Ranch Company, L.P., because the storm drain benefits others. The Carlsbad
Ranch Company, L.P., is also eligible to receive reimbursement for the design fees of $31,371 paid for the storm drain. The total reimbursement is $165,882.

The City currently has $1.8 million in unreserved undesignated funds within PLDA “c” account. Payment of the proposed one-time reimbursement of $165,882 to the Carlsbad Ranch Company, L.P.,
will not adversely affect the City’s ability to fund the drainage facilities included within the current or
proposed five-year Capital Improvement Program.

RESOLUTION NO. 98-149
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
CARLSBAD, CALIFORNIA, APPROVING IMMEDIATE ONE-TIME
REIMBURSEMENT TO THE CARLTAS COMPANY FOR THE CONSTRUCTION OF MASTER DRAINAGE PLAN FACILITY CB
AND CC IN THE AMOUNT OF $165.882.
WHEREAS, the Carlsbad Ranch Company, LP, as a condition of approval for Carlsbad
Tract 92-07 and 94-09, did complete the construction of on-site drainage facilities identified in the
City’s Master Drainage and Storm Water Quality Management ,Plan (Master Drainage Plan) as
Planned Local Drainage facilities CB and CC located within Planned Local Drainage Area ‘c”;
and
WHEREAS, the Carlsbad Municipal Code Section 1508.080 provides that the City
Council, at its discretion, may enter into a reimbursement agreement with any developer who has
constructed a Planned Local Drainage (PLD) facility identified in the Master Drainage Plan; and
WHEREAS, the Carlsbad Ranch Company, LP, has requested an immediate
reimbursement for costs incurred in the construction of PLD facility CB and CC; and
WHEREAS, the Carlsbad Ranch Company, LP, has submitted detailed accounting
records, verified by the Assessment Engineer and adopted by the City Council, as a part of the
formation of the Carlsbad Ranch Assessment District , which show that the total audited cost to
construct the storm drain facilities CB and CC was $1,267,899 and the design costs not
assessed as part of the Carlsbad Ranch Assessment District were $31,371; and
WHEREAS, the Carlsbad Ranch Company, LP, has been reimbursed $1,133,388 through
the Cansbad Ranch Assessment District; and
WHEREAS, the Carlsbad Ranch Assessment District could only assess the Planned
Local Drainage Area (PLDA) fees because that was the benefit to the assessment district; and
WHEREAS, the Carlsbad Ranch Company, LP, is eligible for the remaining cost to design
and construct the storm drain facility because the facility is a benefit to others; and

WHEREAS, the Carlsbad Ranch Company, LP, as a condition of approval of CT 92-07
and 94-09, entered into agreements with the City to pay any increase in PLDA fees resulting
from the recent Master Drainage Plan update; and
WHEREAS, the Carlsbad Ranch Company, LP, has fulfilled this obligation for all
properties approved for development in satisfaction of said agreements; and
WHEREAS, adequate funds are, or will be, available through the collection of PLDA fees
to reimburse the developer for the cost of the PLD facility CB and CC not reimbursed through the
Carlsbad Ranch Assessment District; and
WHEREAS, adequate funds currently exist within PLDA account for Area “C” to
reimburse the developer for the construction of PLD facility CB and CC and to finance all PLD
Area “C” drainage improvements programmed in the City’s current and proposed five-year
Capital Improvement Program.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Carlsbad,
California, as follows:
1. That the above recitations are true and correct.
2. That the Finance Director is hereby directed to make an immediate one-time
reimbursement to the Carlsbad Ranch Company, LP, in the amount of $165,882 for the
construction of PLD facility CB and CC from PLDA Area “c” account.
PASSED, APPROVED AND ADOPTED at a regular meeting of the Carlsbad City Council
held on the 19 day of Mav , 1998 by the following vote, to wit:
