RECOMMENDED ACTION:
That the City Council ADOPT Resolution No. 2009-260 APPROVING corrections to
the Agricultural Conversion Mitigation Fee grant funding amounts specified in Exhibit A of
previously adopted City Council Resolution No. 2009-199, which authorized the allocation of
grant funds from the Agricultural Conversion Mitigation Fee Fund.
ITEM EXPLANATION:
This proposal corrects a typographical error contained in Exhibit A attached to Resolution No.
2009-199, which was approved by the City Council on June 28, 2009 and authorized the
allocation of grants from the Agricultural Conversion Mitigation Fee (ACMF) fund (Fund).
Exhibit A of Resolution No. 2009-199 specifies the amount of ACMF funds to be allocated to
seven different projects, as recommended by the Agricultural Conversion Mitigation Fee
Citizens Committee (Committee). However, the funding amounts specified in Exhibit A for
two projects are incorrect: the Aquaculture Enhancement at Carlsbad Hatchery project (AGP
09-02) and the Coastal Bluff Restoration - Tamarack and Frazee project (AGP 09-10). The
funding amount specified for AGP 09-02 is $7,500 less than the amount the Committee
intended to recommend for that project, and the funding amount specified for AGP 09-10 is
$7,500 more than the amount the Committee intended to recommend.
During the 2009 ACMF grant application review process, the Agricultural Conversion
Mitigation Fee Program Citizens Committee (Committee) determined that a portion ($7,500)
of the Coastal Bluff Restoration project (AGP 09-10) was not eligible for ACMF grant funding.
When Exhibit A of Resolution No. 2009-199 was prepared, the $7,500 was unintentionally
subtracted from the recommended funding for the Aquaculture Enhancement project (AGP
09-02); however, it should have been subtracted from the funding recommended for the
Coastal Bluff Restoration project (AGP 09-10).
Exhibit A of Resolution No. 2009-199 is proposed to be corrected to accurately reflect the
Committee's recommended funding for AGP 09-02 and AGP 09-10, as shown in Exhibit 2 of
this agenda bill. This action will not encumber additional funding from the ACMF Fund
beyond the total amount previously awarded.

FISCAL IMPACT:
Agricultural Conversion Mitigation fees are collected as coastal agricultural lands that are
subject to the fee convert to urban uses. These fees have been set-aside in a special city
fund (ACMF Fund) dedicated to providing the types of grants the Committee will consider
during the project solicitation/evaluation process. On June 28, 2009, the City Council
authorized the allocation of grants from the Fund. The total amount of the allocated grants
($847,822) is below the balance that was available in the Fund at that time (approximately
$891,971). This proposal does not change the total amount of grants to be allocated from the
Fund. Therefore, there is a sufficient balance within the Fund to cover the cost of the grant
allocations. The only direct cost to the City resulting from the recommended action will be the
staff time associated with the allocation of ACMF funds.
ENVIRONMENTAL IMPACT:
The proposed correction to Exhibit A of City Council Resolution No. 2009-199 is consistent
with and does not change the prior determination that the allocation of ACMF funding is
exempt from the requirements of CEQA. The applicable CEQA exemption status for each of
the projects that will receive ACMF funding is listed within Exhibit A of the attached City
Council Resolution (Exhibit 1 of this agenda bill).

WHEREAS, on July 28, 2009 the City Council of the City of Carlsbad adopted

Resolution No. 2009-199, which authorized the allocation of grant funds from the Agricultural
Conversion Mitigation Fee (ACMF) fund (Fund); and
WHEREAS, the Agricultural Conversion Mitigation Fee Ad Hoc Citizens
Committee intended to recommend that $249,313 in ACMF funds be allocated to ACMF Grant
Project (AGP) 09-02 and that $234,830 in ACMF funds be allocated to AGP 09-10; and
WHEREAS, the ACMF funding amounts for AGP 09-02 and AGP 09-10 were
displayed incorrectly in Exhibit A of Resolution No. 2009-199; and
1, WHEREAS, it is necessary to correct Exhibit A to accurately reflect the ACMF
. „ funding amounts for AGP 09-02 and AGP 09-10.
18 NOW, THEREFORE, the City Council of the City of Carlsbad does hereby
jo resolve as follows:
20 1 • That the above recitations are true and correct.
21 2. That the City Council hereby approves the corrections to the ACMF funding
amounts to be allocated to AGP 09-02 and AGP 09-10, as accurately reflected in the attached
22 "Exhibit A - Agricultural Conversion Mitigation Fee Program Committee Recommendation of
2009 Grant Applications and Environmental Review Status."

3. All other provisions and requirements of Resolution No. 2009-199 not
24 modified by this resolution shall remain in full effect.
