RECOMMENDED ACTION:
Adopt Resolution No. 2011-036 accepting the contract for construction of the Alga Norte
Community Park Mass Grading, Project No. 38372 as complete, and directing the City Clerk to record a
Notice of Completion and release bonds in accordance with State Law and City Ordinances.
ITEM EXPLANATION:
On January 12, 2010, the City of Carlsbad awarded a contract to KTA Construction, Inc. in the amount of
$1,501,995 for the construction of the Alga Norte Community Park Mass Grading, Project No. 38372.
KTA Construction, Inc. substantially completed the contract work on October 15, 2010 and the landscape
maintenance period required by the contract was completed on February 12, 2011. City staff has
inspected the work and found it to be satisfactory. Staff recommends acceptance of the improvements by
the City Council.
ENVIRONMENTAL IMPACT:
The approval of a Notice of Completion is a ministerial process and is exempt from the requirements of the
California Environmental Quality Act (CEQA) pursuant to Section 15268 of the State CEQA Guidelines.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
3 CARLSBAD, CALIFORNIA, ACCEPTING THE CONTRACT FOR
CONSTRUCTION OF THE ALGA NORTE COMMUNITY PARK
4 MASS GRADING. PROJECT NO. 38372, AS COMPLETE.
5 WHEREAS, the construction of the Alga Norte Community Park Mass Grading,
6 Project No. 38372, has been completed to the City's satisfaction by KTA Construction, Inc. on
7 October 15, 2010; and
8 WHEREAS, the landscape maintenance period required by the contract was completed
9 on February 12, 2011; and
10 WHEREAS, the formal project Notice of Completion has been prepared; and
1 1 WHEREAS, all project costs have been established to date.
12 NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Carlsbad,
13 California, as follows:
14 1. That the above recitations are true and correct.
15 2. That the Alga Norte Community Park Mass Grading, specifically identified as
16 Project No. 38372 is deemed complete and is hereby accepted by the City Council of the City of
17 Carlsbad.

3. The City Clerk of the City of Carlsbad is hereby authorized and directed to

execute and record the Notice of Completion for the Alga Norte Community Park Mass Grading,

Project No. 38372.
