DIRECTOR f^ CITY ATTORNEY / (^?, CITY MANAGER (^ RECOMMENDED ACTION: Adopt Resolution No. 2010-077 accepting bids and awarding the contract to Burtech Pipeline Inc., for the Northwest Quadrant Storm Drain Improvement Program - Chestnut Avenue, Pio Pico Drive and Crest Drive, Project No. 6608. ITEM EXPLANATION: The Northwest Quadrant Storm Drain Replacement Program is a multi-year program to address non- master drainage plan needs within the northwest quadrant of the City. Carlsbad Operations and Maintenance staff was interviewed regarding their field observations and knowledge of drainage issues throughout the northwest quadrant. Site locations were identified and prioritized based on recommendations from field observations. The locations of the sites, status and current priority are included in Exhibit 2. Four sites are included in this contract request as shown on Exhibit 1. The Chestnut Avenue storm drain comprises two of the sites and will install 1,350 feet of 18-inch diameter reinforced concrete pipeline. The pipeline will carry nuisance groundwater, which surfaces in the street and currently flows in the gutter year round, to the existing storm drain system. New curb inlets and cleanouts will be installed. The project includes work within CALTRANS right-of-way, where Chestnut Avenue crosses under Interstate 5, and an encroachment permit has been obtained. The third site includes replacement of the existing storm drain located at the intersection of Pio Pico Drive and Forest Avenue. This existing storm drain is undersized and unable to convey storm water flow tributary to that location. The new storm drain system is designed to provide capacity to accept a 100- year flood event. The project includes the construction of 565 feet of reinforced concrete pipeline consisting of 105 feet of 18-inch diameter pipeline, 65 feet of 24-inch diameter pipeline and 395 feet of 30-inch diameter pipeline plus curb inlets, cleanouts, and street surface improvements including reconstruction of 355 feet of concrete channel. The fourth site includes the Crest Drive storm drain improvement to replace a temporary system installed by City crews to protect the steep slope between Crest Drive and Monroe Street. The temporary system was situated on private property to convey storm flows. The new system will construct 150 feet of 18-inch diameter reinforced concrete storm drain pipeline and 380 feet of 18-inch diameter high density polyethylene pipeline through publicly owned land and convey the storm flows to the existing City storm drain system. The project includes construction of cleanouts and roadway improvements. In addition, 380 feet of the pipeline will be installed using a tunneling method referred to as "directional drill" to avoid surface impacts to Hosp Grove, thereby reducing environmental impacts. On March 18, 2010, Eighteen (18) sealed bids were received, opened and witnessed for the construction of this project as shown in the following Table 1. Bid documents submitted by the lowest bidder, Burtech Pipeline, Inc., were determined to be responsive after staff completed a review of the contract documents and determined that they were in order. Based on a review of the bids submitted, staff recommends awarding the construction contract to Burtech Pipeline, Inc., in the amount of $558,000. ENVIRONMENTAL IMPACT: The project is exempt from the California Environmental Quality Act (CEQA) per State CEQA Guidelines Section 15301(b) - minor alteration of existing facilities of public utility services involving negligible or no expansion and 15304(f) - minor trenching or backfilling. Annually, funds are added to the project through the Capital Improvement Program. This funding source is not subject to State or Federal restrictions regarding prevailing wage. Therefore, pursuant to Carlsbad Municipal Code Section 3.28.130, prevailing wages are not required for 'the construction of Northwest Quadrant Storm Drain Improvement Program - Chestnut Avenue, Pio Pico Drive and Crest Drive, Project No. 6608. PROJECT NO. 6608. 5 WHEREAS, on December 1, 2009, the City Council of the City of Carlsbad, through 6 Resolution No. 2010-002, has previously authorized to advertize for bids to construct the 7 Northwest Quadrant Storm Drain Improvement Program - Chestnut Avenue, Pio Pico Drive and 8 Crest Drive, Project No. 6608.; and 9 WHEREAS, eighteen (18) sealed bids were received on March 18, 2010, by the City for 10 the construction of said project; and 11 WHEREAS, the lowest responsive and responsible bid to construct said project was submitted by Burtech Pipeline Inc., in the amount of $558,00; and WHEREAS, the City Council of the City of Carlsbad, California, has determined it14 necessary, desirable, and in the public interest to accept bids and award a contract to construct 10 the Northwest Quadrant Storm Drain Improvement Program - Chestnut Avenue, Pio Pico Drive16 and Crest Drive, Project No. 6608; and ._ WHEREAS, funding for said project has been appropriated from the General Capital1o Construction Fund and Gas Tax Fund to cover all project costs and is sufficient; andI y __ WHEREAS, the City Manager is hereby authorized to approve change orders in the 21 cumulative amount equal to the contingency hereby set at fifteen percent (15%) of the contract 22 award. 23 NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Carlsbad, 24 California, as follows: 25 1.
