POLICE APPROVAL OF AMENDMENT NO. 1 TO FY2013 OPERATION STONEGARDEN GRANT, PROVIDING $28,000 TO THE POLICE DEPT TO EXTEND OPERATIONS CITY MGR. / ^ RECOMMENDED ACTION: Adopt Resolution No. 2014-202 approving Amendment No. 1 to the FY2013 Operation Stonegarden Grant and appropriate $28,000 in additional funds to extend participation in joint anti-smuggling operations in coastal North County San Diego. ITEM EXPLANATION: The US Department of Homeland Security Operation Stonegarden is a program to enhance security along the borders of the United States, partnering local, state and federal agencies. The US Department of Homeland Security, US Customs and Border Protection Border Patrol, state and local law enforcement agencies in San Diego County collaborate to raise border security by increasing law enforcement presence along the border, joint special operations, information sharing, and communication. Carlsbad has participated in Operation Stonegarden activities for five years. The FY2013 Operation Stonegarden operational period started in October 1, 2013 and extends through May 31, 2015, in order to fully expend all funds. Initially, Carlsbad was allocated $25,000 for participation in FY2013 Operation Stonegarden. That funding was fully expended at the end of May. Carlsbad requested a grant modification for additional funds to continue participation for the remainder of the grant operational period. The San Diego County Sheriff's Department, as the authorizing agency for the grant, has allocated an additional $28,000 to Carlsbad for continued participation in operations. FISCAL IMPACT: Eligible reimbursable costs for Amendment No. 1 to FY2013 Operation Stonegarden are $26,450 for overtime, $350 for benefits, and $1,200 for mileage reimbursement, for a total of $28,000. These expenses are eligible for full reimbursement by San Diego County Sheriff's Department with Operation Stonegarden federal funds. Staff will monitor the budget for this grant on a quarterly basis. ENVIRONMENTAL IMPACT: Pursuant to Public Resources code section 21065 and CEQA Guidelines section 15738, this action does not constitute a "project" within the meaning of CEQA and therefore, does not require an environmental review. Original Agreement - On or about May 14,2014, the PARTIES to the Agreement listed in Amendment Recital 1, below, entered mto the AGREEMENT FOR OPERATION STONEGARDEN (OPSG) Grant ("Agreement") effective retroactively to September 1, 2013 and with a termination date of May 31,2015, subjectto various provisions ofthe Agreement. 2. For the CITIES, participating agencies are their respective police departments. For the colleges, participating agencies are theh respective police departments. For the OC, LAC, VC, SBC, and SLOC, participating agencies are their respective Sheriffs Department. SDUPD, CHP, CDFW, DMV, DPR, and CDCR do not have subordmate agencies or department participants. 4. Authority To Amend The Agreement - COUNTY, by action of the Board of Supervisors Minute Order No. 2 dated December 13,2013 approved and authorized the SHERIFF to re- allocate FY 2013 OPSG grant fundmg between OPSG agencies, including any annual extensions, amendments, and/or revisions thereof that do not materially impact or alter the services or funding level. The persons signing this Amendment (No. 1) on behalf of the PARTIES represent that they have the authority to do so. Page 1 of 3 Li THEREFORE, the PARTIES agree to the following: AMENDMENTS TO THE AGREEMENT A. The Agreement's "RECITALS" are amended to add the following: R.8 The FY13 OPSG allocation for the CITY OF CARLSBAD, the COUNTY OF SAN LUIS OBISPO, the SAN DIEGO UNIFIED PORT DISTRICT, the CALIFORNIA DEPARTMENT OF FISH AND WILDLIFE, and the CALIFORNIA DEPARTMENT OF MOTOR VEHICLES, will be increased by the amount as specified below. The participatmg agencies, by and through their respective police departments or law enforcement agencies, have agreed to continue to provide basic services as described m the AGREEMENT, in Section 4. (a) The City of Carlsbad's allocation will be increased by $28,000, from $25,000 to $53,000, which will be used for personnel overtime and mileage; (b) The County of San Luis Obispo's allocation will be increased by $192,500, from $350,000 to $542,500, which will be used towards the purchase of a boat; (c) The San Diego Unified Port Disfrict's allocation will be increased by $825,000, from $120,000 to $945,000, which will be used towards the purchase of a boat; (d) The Califomia Department of Fish and Wildlife's allocation will be increased by $20,120, from $25,000 to $45,120, which will be used for personnel overtime and mileage; (e) The Califomia Department of Motor Vehicle's allocation will be increased by $31,306, from $25,000 to $56,306, which will be used for personnel overtime and equipment maintenance. B. The existing Exhibit A, Budget Worksheet, is replaced with the attached new Exhibit A, reflecting grant award and allocations. C. The Agreement's Recital R.6 first paragraph is amended and restated to read as follows: PARTIES agree to maintam documentation supporting all expenditures reimbursed from OPSG grant funds, ensure all expenditures are allowable under grant requirements, adhere to their jurisdictions authorized procurement methods and comply with OMB Circular A- 133 and the Single Audit Act Amendment of 1986 if $500,000 or more of OPSG federal funds are expended in a fiscal year. The documentation and records shall be maintained and retained in accordance with OPSG grant requhements and shall be available for audit and inspection. D. Except as otherwise provided by this AMENDMENT NO. 1, the Agreement, and each and every other term and condition therein, shall remain in full force and effect. Terms and conditions ofthe AGREEMENT not speeifled herein remain unmodified.
