As a condition of approval of Planned Industri a1 Permit 86-2, Resol u 3566 the owner is required to offer for dedication a water main easemen Lot 10, 11, 12 and 13 of CT 74-21.
[ FISCAL IMPACT:
Requiring dedications as a condition of development will save the City 1 in the future right-of-way acquisitions.

SUBORDINATION AGREEMENT
NOTICE: THIS SUBORDINATION AGREEMENT RESULTS IN YOUR
SECURITY INTEREST IN THE PROPERTY BECOMING
SUBJECT TO AN ESTATE IN THE REAL PROPERTY
TO WHICH YOUR SECURITY INSTRUMENT ATTACHES
AND HAS THE POTENTIAL EFFECT OF REDUCING
THE VALUE OF YOUR SECURITY INTEREST.

Partners owner of the land hereinafter described and hereinafter referred
"Owner," and First National Bank of Minneapolis, present owner and holder 1
deed of trust and not hereinafter described and hereinafter referred
"Beneficiary";
WITNESSETH
THAT WHEREAS, B.W. Pacific Partners did execute a deed of trust, (
&c. cb 19 a, to First America Title Insurance Company as trl
covering Lots 10 thru 13, CT 74-21, to secure a note in the sum of
million, six hundred fifth thousand dollars ($8,650,000.00) dated Decembl
1986, in favor of First National Bank of Minneapolis recorded December 24,
as File No. 86-607919 of Official Records of said county; and
WHEREAS, Owner has executed, or is about to execute, as grantor, a
of Easement dated December 7, 1988, in favor of the City of Carlsbad as g
herein referred to as "Easement Grantee," creating an Easement more partict
described in Exhibits 'A' and 'B" attached hereto; and
WHEREAS, Easement Grantee is willing to accept said Easement providl

grant of Easement is a charge upon the above described property pri
superior to the,lien or charge of the deed of trust above mentioned and PI
that beneficiary will specifically and unconditionally subordinate the
charge of the deed of trust above mentioned to the lien or charge
Easement created in favor of Easement Grantee; and
WHEREAS, it is to the mutual benefit of the parties hereto that E,
Grantee accept said Easement and Beneficiary is willing that the gr
Easement shall, when recorded, constitute a charge upon said land wt

1. That said Easement in favor of Easement Grantee
