RECOMMENDED ACTION:
The Planning Commission and the Planning Staff are recommend
that the City Council CERTIFY EIR 81-6 by minute motion and
direct the City Attorney's Office to prepare documents APPRC
SP-181, ZC-250 and CT 81-46.
ITEM EXPLANATION
The proposed project (map attached) involves the consideratj
the City Council of four public hearing items. EIR 81-6 an;
the proposed impacts on the environment from the development
the 333 acre Airport Business Center. Major impacts identif
include traffic, crash hazards, grading and noise. Both the
Planning Commission and staff feel that all impacts have be(
adequately addressed and mitigated by the EIR.
The three other actions include a specific plan, a preannex-
ational zone change to the PM zone, and a tentative map to c
a 77 lot subdivision to be completed in three phases. Throl
Planning Commission and staff. review, all major issues on tk
project have been resolved. The City At.torney's Office has
requested the placement of one additional condition regardir
attainment of an agreement from the developer which would hc
the city harmless from litigation resulting from any airplar crashes occurring on the property. The condition would reac
follows: "Prior to the approval of the final map for this I
ject the applicant shall enter into an agreement satisfacto~
the City Attorney to hold the city harmless from liability j
personal injury or property damage, or liability resulting j inverse condemnation caused by or resulting from the operat:
Palomar Airport or aircraft using Palomar Airport. This cor
dition shall apply to that property located within the FAA ' zone" of the airport as identified by the Environmental Inpi Report." The Planning Department has no problem with the addition of this condition.

EIR 81-6 addresses the impacts and describes mitigation mea: for the proposed project.
FISCAL IMPACT
The applicant will provide all required public improvements
the project. Also, the applicant has agreed to pay a publi( facilities fee to offset the costs of providing all other PI .services.

The proposed subdivision would create 77 *total lots comprised o
68 industrial lots, 4 mini-park lots and I Future Planning Area
.lot. The project is proposed to be developed in three phases.
Phase 1 would include 22 industrial lots; 2 open space lots and
mini-park, Phase 2 would involve 22 industrial lots, 1 open
space lot and 1 mini park. The final phase would contain 24
industrial lots, 1 open. space lot, 2 mini-parks and the Future
improvements and circulation system. Approximately three yearE
aTe estimated 'for development of each phase.
Each of- the proposed industrial lots .would exceed the minimum I
size established in the P-M zone. All of the proposed lots WOI satisfy the requirements of the Carlsbad ,Subdivision Ordinance

e NOTICE IS HEREBY GIVEN that the Planning Cornmission of the City of Carlsbad will 1

Avenue), Carlsbad, California, at 6:OO p.m. on Wednesday, July 17, 1991, to cons
approval of a request to reduce the total amount of land designated for commercial
and to reassign the locations of commercially designated lots within Specific Plan 181
industrial and commercial uses on property generally located between El Camino F
Palomar Airport Road, north of College Avenue and McClellan-Palomar Airport in the
Zone, and in Local Facilities Management Zone 5 and more particularly described a5
CT 81-46, Unit 1, Map No. 11287, CT 81-46, Unit 2, Map No. 11288, and
CT 81-46, Unit 3, Map No. 11289.
Those persons wishing to speak on this proposal are cordially invited to attend the pi
hearing. Copies of the staff report will be available on and after July 11, 1991. If
