Statement of the Matter
The City Council, at your November 7, 1978 meeting, directec
the City Attorney to prepare the necessary documents amendir
Specific Plan (SP-175) to allow patio covers under certain
circumstances in the Altamira subdivision. An ordinance in
that regard is attached.

ORDINANCE NO. 95 14
AN ORDINANCE OF THE CITY COUNCIL
OF THE CITY OF CARLSBAD, CALIFORNIA,
AM.ENDING SPECIFIC PLAN (SP-175) TO
ALLOW PATIO COVERS UNDER CERTAIN
CIRCUMSTANCES. APPLICANT : ALTAMIRA
HOMEOWNER'S ASSOCIATION.
The City Council of the City of Carlsbad, California,
ordain as follows:
SECTION 1: That Ordinance No. 9465 adopting Specific'
(SP-175) is amended by the amendment of Section 3, Paragrap1
add the following:
to individual units subject to the following conditions:
"Provided that patio covers open on two sides may be i
Sideyard setbacks as shown on SP-175 shall be mail
and shall not be closer than 3' from a common pro] line.
1.
2. Foundations and vertical structural members shall
maintain a sethack of two feet from rear property
lines or top of slope, whichever is closer to the main structure.
3. Patio roofs may not overhang property lines or to]
of slopes and shall be designed so that all roof
drainage falls on the flat portion of the propert; on which the patio cover is located."
EFFECTIVE DATE: This ordinance shall be effective th
days after its adoption, and the City Clerk shall certify ti
adoption of this ordinance and cause it to be published at
once in the Carlsbad Journal within'fifteen days after its
adoption.

Carlsbad City Council held on the 21st day November
