ITEM EXPLANATION:
Engineering Staff recommends acceptance of three easements to prov
associ ated slopes.
The improvements are required to accommodate drainage from Cougar Dr and Palmer Way, located to the west and currently under construction the developer of Site Development Plan Number 84-5. The developer secured the easements from Ralph and Hope Wrisley without cost to City and without the need for condemnation.
The City has completed review of the improvement plans and easeme associated with Site Development Plan Number 84-5 and has determi that these offsite easements are satisfactory for the intended use.

CITY OF CARLSBAD, CALIFORNIA, APPROVING
ACCEPTANCE OF A GRANT DEED FOR DRAINAGE PURPOSES.
WHEREAS, the City Council of the City of Carlsbad has determii
to be in the public interest to provide for public storm dr
improvements.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the C
Carlsbad, California, as follows:
1. That the above recitations are true and correct.
2. That the Grant Deeds conveying easements for storm draina!

Enclosed are grant deeds which have been executed by Mr. & Mrs. Wrisley, which grant easements for slopes, storm drainage, construction, and maintenance, together with temporary construction
easements and easements for ingress and egress as required, as a
condition of the Carlsbad Gateway project.
These grant deeds have been furnished to you for acceptance by
the City Council. After approval of the deeds by the City, it is
understood that they will be delivered to Cal-West Escrow Company,
Escrow No. 9788-J, for recording of the subordination agreements,
deeds and any other documents to effectuate clear title to the City.
