LATE PAYMENT PENALTY --MEISTER

RECOMMENDED ACTION:
Deny the request for refund.
ITEM EXPLANATION:

During the latter portion of 1984 and early 1985, the business manager
for Meister-Porsche Audi Peugeot was seriously ill and unable to function
pr9perly in the performance of his duties. Meister, in an effort to provide
every opporcunity to their business manager to continue to perform his
duties, did not replace the business manager until it became obvious that
he was truly disabled. In allowing him this consideration, the 1985 business
license renewal was overlooked. Meister subsequently filed the license
renewal form and paid all fees and penalties. •
Meister is requesting that due to the extenuating circumstances surrounding
this case that the City refund the penalty portion of the license fee.
Meister's business license fees were $2,760.92, plus penalties of $1,380.46
for a total of $4,141.38.
Section 5.04.020 of the Carlsbad Municipal Code provides for the collection
of a penalty of 25% of the license fee plus one percent per day for any
delinquency.
FISCAL IMPACT:
A refund of $1,380.46 is requested. This refund has a negligable effect
on total business license revenue.
