ITEM EXPLANATION The Kelly Family has requested that they be granted a Zone Change from Res Agriculture (R-A-10) to Limited Control (L-C). The intent and purpose of the Control zone is to provide an interim zone for areas where planning for future la has not been completed or plans for development have not been formalized. F zoned L-C may be rezoned only after the proper planning has been completed. The site is vacant, has no entitlements, and is located apart from existing develc Development of the site would therefore require planning studies to be comple subsequently extensive infrastructure to be brought to the site. Because of the planning studies and the costs associated with project construction, developmen site will not be in the near future. Therefore the proposed zone change is app because the property meets the intent and purpose of the L-C zone. Staff has reviewed the application and the Planning Commission held a public regarding the request on February 16, 1994 (See the attached Planning Commiss report). There was no opposition from the public and the Planning Commission unan recommended approval of the Zone Change. ENVIRONMENTAL REVIEW The Planning Director has determined that there will be no significant impacts as of this project and issued a Negative Declaration on January 20, 1994. FISCAL IMPACT The property is located in Local Facilities Management Zone 15 and has bee Community Facilities District (CFD) No. 1 since its formation. How will a zone change to Limited Control affect the Growth Management Ordinanc DISCUSSION The General Plan designation for the property is Residential Low Medium (RLM). proposed zone change will not affect the intent or effectiveness of the general I designation. Changing the project zoning from R-A-10 to L-C will create greater consistency bem adjacent parcels in this part of the northeast quadrant. An unknown factor relating to the site’s development potential is the adoption and implementation of the City of Carlsbad Hal Management Plan (HMP) which will identify and direct development to accomoc sensitive plant and animal species and habitat. Located within proposed Preseme Plam Area 2 of the HMP, the project area has been identified as having a high priority conservation. The site would also require the extension of extensive infrastructure to accommo City of Carlsbad. ZE 93-06 - KELLY DEL CERRO - Request for approval of a Negative Declaration and a zor ’ . ,. i’i change from Residential Agriculture (R-A-10) to Limited Control (L-C) on approximately 24( generally located east of the future intersection of the extension of College Avenue and Cann Road northeast of El Camino Real. Christer Westman, Associate Planner, reviewed the background of the request and stated that the F owner has requested a zone change from Residential Agriculture 10 to Limited Control. Limited Cc intended as an interim zone to be used when the ultimate use is in flux. This property is within Plar Area 2 of the City‘s Habitat Management Plan and is identified as having a high priority for wnsewi The ultimate development potential of the property is therefore unknown at this time. Staff has revic the request against the General Plan and against existing zoning in the area. Adjacent properties ti west and south are currently zoned Limited Control and a rezoning to L-C will further ensure defer1 development until the future of the property can be determined and development plans formalized. recommends that the Commission approve the request which can be supported with the findings as 77- MlNUT a e PLANNING COMMISSION February 16, 1994 PAG in the resolution of approval, Prior to the start of the meeting, Mr. Westman had handed out a lei James F. and Kit S. Crawford dated February 14, 1994 which supports the zone change. Commissioner Erwin inquired if this was a request on behalf of the property owner. Mr. Westman that it was the property owner who came to the City and requested the change. Chairman Savary invited the applicant to speak. Lucia Sipple, 1287 Vera Cruz, Oceanside, representing the applicant, addressed the Commission stated that she agrees with the staff report and recommendation. If negative comments are made the public testimony, she would like an opportunity to respond. Chairman Savary opened the public testimony and issued the invitation to speak. Jack Gerhardt, 41 70 Andros Way, Oceanside, addressed the Commission and stated that he is ai Oceanside resident on the immediate border of the property. He inquired if any type of livestock 4 allowed with the proposed zoning. He is concerned about odors emanating from livestock. Leonard Rosen, 41 34 Andros Way, Oceanside, addressed the Commission and stated that he live Leisure Village which abuts the site. He hopes the Commission will approve the zone change becl sounds like a great idea. He commended Christer Westman for his expertise and the way he expl everything in complete detail to the residents of Leisure Village. The applicant declined further comment. There being no other persons desiring to address the Commission on this topic, Chairman Savary the public testimony closed and opened the item for discussion among the Commission members. Commissioner Hall requested staff to respond to the livestock question.
