ENG I TITLE: APPROVE AMENDMENT NO. 1 WITH RICK ENGINEERING COMPANY FOR THE CARLSBAD MASTER DRAINAGE PLAN RECOMMENDED ACTION: Adopt Resolution No. 2003-072 approving Amendment No. 1 to Agreement for Engineering Services for a Master Drainage Plan and Prototype Water Quality Master Plan. ITEM EXPLANATION: On February 5, 2002, the City Council adopted Resolution No. 2002-043 authorizing the execution of a professional services agreement with Rick Engineering Company for a Master Drainage Plan and Prototype Water Quality Master Plan. The objective of the Master Plan is to develop a comprehensive approach to planning for the construction of future storm drain infrastructure (both pipelines and desiltation/detention basins) and to evaluate appropriate techniques for managing the impacts of urban pollutants from rain flows. The Master Plan is in compliance with the mandates outlined by Regional Water Quality Control Board NPDES Order No. 2001-01. During the development of the database and draft Water Quality Master Plan, additional tasks were identified to complete the database prior to running hydraulic models. The additional tasks include: 0 Update the watershed and flow line information consistent with the 2001 aerial topography. 0 Perform additional field visits to verify watershed boundaries and location of storm drain outlets. 0 Include the new information into the GIS database. 0 Assist the City with grant applications for the Clean Beaches Initiative Grant Program. Staff is recommending that the Council approve Amendment No. 1 to the contract with Rick Engineering Company for additional tasks to complete the Master Drainage Plan and Prototype Water Quality Master Plan. FISCAL IMPACT: This amendment for professional services, for a not-to-exceed amount of $66,646 is part of an update to the City's Master Drainage and Storm Water Quality Management Plan and is being funded by the Public Works Department NPDES goal budget. The remainder of the costs for the Master Plan update are being funded by Planned Local Drainage Area B funds in a Capital Improvement Program budget. EXHIBITS: 1. WHEREAS, on February 5, 2002, the City Council authorized the execution of a Professional Services Agreement with Rick Engineering Company for the development of a Master Drainage Plan and Prototype Water Quality Master Plan; and WHEREAS, during the initial development of the master plan, it became apparent that additional services are required of the consultant to allow for the full evaluation of the drainage characteristics within the City’s watersheds; and WHEREAS, there are sufficient funds in the Public Works NPDES goal budget for the services; and WHEREAS, the consultant and City staff have developed a scope of services and resulting fee schedule to complete the necessary additional tasks. NOW, THEREFORE be it resolved by the City Council of the City of Carlsbad, California, as follows: 1. That the above recitations are true and correct. 2. That the Mayor of the City of Carlsbad, California, is authorized and directed to execute Amendment No. 1 to Agreement for Engineering Services with Rick Engineering Company to Develop a Master Drainage Plan and Prototype Water Quality Master Plan. AMENDMENT NO. 1 TO AGREEMENT FOR MASTER DRAINAGE PLAN AND PROTOTYPE WATER QUALITY MASTER PLAN, PROJECT NO. 3872 (RICK ENGINEERING COMPANY) ENGINEERING SERVICES FOR A GIs-BASED This Amendment No. 1 is entered into and effective as of theJ& kd day of , 2003, amending the agreement dated February 7, 2002 (the “Agreement”) by and between the City of Carlsbad, a municipal corporation, (“City”), and RICK ENGINEERING COMPANY, a corporation, (‘Contractor”) (collectively, the “Parties”) for the development of a GIs-Based Master Drainage Plan and Prototype Water Quality Master Plan for the Agua Hedionda Watershed in the City of Carlsbad. RECITALS A. The Parties desire to alter the Agreement’s scope of work to perform additional field visits and research efforts of the City’s existing storm drain information in order to update the GIS database, and perform revisions to the watershed and flow line information from the 2001 topography maps; and B. The Parties have negotiated and agreed to a supplemental scope of work and fee schedule, which is attached to and incorporated by this reference as Exhibit ”A”, Scope of Services and Fee. NOW, THEREFORE, in consideration of these recitals and the mutual covenants contained herein, City and Contractor agree as follows: 1. In addition to those services contained in the Agreement, as may have been amended from time to time, Contractor will provide those services described in Exhibit “A”. 2. City will pay Contractor for all work associated with those services described in Exhibit “A’ on a time and materials basis not-to-exceed sixty six thousand six hundred forty six dollars ($66,646). Contractor will provide City, on a monthly basis, copies of invoices sufficiently detailed to include hours performed, hourly rates, and related activities and costs for approval by City. 3. Contractor will complete all work described in Exhibit “A by February 7, 2004. 4. All requisite insurance policies to be maintained by Contractor pursuant to the Agreement, as may have been amended from time to time, will include coverage for this Amendment. 6. The individuals executing this Amendment and the instruments referenced in it on behalf of Contractor each represent and warrant that they have the legal power, right and actual authority to bind Contractor to the terms and conditions of this Amendment. As was mentioned in our letter dated September 30,2002, additional time and effort not included in the original contract and scope of work will be required to complete the project. The original scope and fee associated with the update of the 1994 Master Drainage Plan for the City of Carlsbad was based on the most available information at the time of the proposal. However, as we have proceeded with the GIS based updates to the MDP there have been some changes in scope as directed by the City and changes in base information like current topography and storm drain layout. Because of the amount of work associated with updating the watersheds based on the new topography, the new storm drain information, the new developments, and the changes in the base information since this project was initiated, additional funds will be needed to cover the cost for work already done and to finalize the GIS based MDP. The following is a proposal amendment to cover some of the additional work we have already completed at the direction of the City of Carlsbad. As you requested, the cost associated with the time spent on researching information to aid with the preparation of the Clean Beaches Initiative Grant Proposals has been included in this amendment. Scope of Work: 0 Revise the watersheds and flowlines within the City of Carlsbad to be consistent with the 2001 topography provided by the City of Carlsbad. This will require modification to a majority of the watersheds delineated in the 1994 MDP. This task is outside of our original scope of work for the GIS based MDP. This task is outside of our original scope of work for the GIS based MDP. Cost: $8,730.00 Additional research and effort associated with incorporating storm drain information not provided in the GIs information fiom the City of Carlsbad as well as grading plans for projects currently being developed since the 2001 topography was flown. This task is outside of our original scope of work for the GIS based MDP. Cost: $9,220.00 Research and preparation of support materials and information to aid in the preparation of three Grant Application for funding from the Clean Beaches Initiate Grant Program. Coordinate with the City of Carlsbad regarding beach closures, project scheduling and the Grant Applications for Grant Proposals. This work was completed in October 2002 per your request. Cost: $4,296.00 Total Approximate Cost: $66,646.00 This Amendment No. 1, in the amount of $66,646.00, will bring the total amount authorized as of this date to $228,394.00 to perform this additional work in conjunction with our contract dated March 6,2002 (P.O. P110891). All other provisions of the original contract are to remain unchanged. Please issue Rick Engineering Company a City of Carlsbad contract amendment to cover the above scope of work as Amendment No. 1.
