Statement of the Matter
1. The City Engineer *s Office has completed checking the final map of
Carlsbad Tract #72-2,1 for conformance with the State Subdivision Map Act
and applicable State and local ordinances of the City of Carlsbad.
2. The final map conforms substantially to the conditions of the tenta-
tive map approved by the City Council on February 15, 1972 (Resolution
No. 1952).
3. Condition (23) of Resolution No. 1952 states "that all existing streets
and easements shall be vacated with specific utility easement reservations."
This may be accomplished by means of a Map of Reversion to Acreage of a
portion of La Costa Downs Unit No. 1. This map shall record prior to
final map for CT-72-2.1.
4.A public hearing has been advertised relative to the reversion to acreage
of a portion of La Costa Downs Unit #1, and the adjoining property ownersnotified.

Staff Recommendations
Adopt a motion:
(a) Approving the final map of Carlsbad Tract #72-2.1 subject to the con-
ditions of the tentative map and
(b) Accepting dedication of the public streets, drainage easement and
accepting the sanitary sewer system and authorizing the Mayor to execute
a subdivision Improvement Agreement on behalf of the City and
(c) Approving the Map of Reversion to Acreage of a portion of La Costa
Downs Unit No. 1, and authorize the Mayor to execute certificate on Map
of Reversion.

Tract 72T2.1, subject to the conditions of the tentative map;

of Reversion to Acreage of a portion of La Costa Downs Unit 1
and authorization for Mayor to execute certificate on Map of

Gentlemen:
We are the owners and developers respectively of the property encompassed
by subject development.

The boundaries of the subject property include a portion of La Costa Downs
Unit No. 1 , according to Map No. 2013, filed in the Office of the San Diego
County Recorder, February 28, 1927.
Certain portions of said La Costa Downs Unit No. 1 were, by decree, under
Superior Court Case No. 87499, excluded from the original subdivision. It
appears, however, that the streets and the easements for public utilities
along the rear of all lots, as dedicated on said Map and accepted on behalf of
the public by the San Diego County Board of Supervisors, still exist. These
streets and easements were never improved nor used as such by the public.
It is therefore respectfully requested that the City Council close and vacate
those certain portions of said streets and easements as shown oh the attached
Street Vacation Map and marked "Exhibit B".
