TRANS AWARD OF CONTRACT FOR CONSTRUCTION OF THE LA COSTA AVENUE SUBDRAIN, PROJECT NO. 3681 DEPT. DIRECTOR CITY ATTORNEY CITY MANAGER \j^, RECOMMENDED ACTION: Adopt Resolution No.2010-105 accepting bids and awarding the contract to Atom Engineering Construction for construction of the La Costa Avenue Subdrain, Project No. 3681. ITEM EXPLANATION: Approximately 200 feet south of Cadencia Street, the asphalt concrete pavement on La Costa Avenue is severely deteriorated with water seeping out of the pavement, even during dry weather conditions. A subsurface investigation has indicated that saturated subgrade soils are responsible for the loss of structural support for the existing pavement. This project will construct a subdrain system consisting of 6-in diameter perforated PVC pipes within the saturated subgrade soils. The subdrain system will remove the ground water from the subgrade and deposit the water into the existing storm drain in La Costa Avenue. This is an allowed discharge into the municipal separate storm sewer system per the NPDES Permit No. CAS0108758, Section B.2. After the subdrain system is constructed, the existing pavement will be rehabilitated with an asphalt concrete leveling course and 1.5-inch asphalt concrete overlay. On February 23, 2010, through Resolution Number 2010-033, City Council approved the plans and specifications and authorized advertising for bids for The La Costa Avenue Subdrain Project No. 3681. The engineer's estimate for construction of this project was $250,000. On April 13, 2010, eighteen (18) sealed bids were received for the construction of this project as shown on the following table. Staff recommends awarding the construction contract to Atom Engineering Construction in the amount of $117,395. ENVIRONMENTAL IMPACT: The project is exempt from the California Environmental Quality Act (CEQA) per State CEQA Guidelines Section 15301(b) - minor alteration of existing facilities of public utility services involving negligible or no expansion and 15304(f) - minor trenching or backfilling. FISCAL IMPACT: The La Costa Avenue Subdrain Project is part of a larger Capital Improvement Program called Miscellaneous Road Subdrains, which is a City-wide effort to fix various pavement subgrade issues. Table 1 shows the current status of the Gas Tax funding for the Miscellaneous Road Subdrains Program. PROJECT NO. 3681. 5 WHEREAS, the City Council of the City of Carlsbad, California, has determined it 6 necessary, desirable, and in the public interest to construct the La Costa Avenue Subdrain Project 7 No. 3861; and 8 WHEREAS, on February 23, 2010, with resolution 2010-033, the City Council of the City 9 of Carlsbad approved plans and specifications for construction of the La Costa Avenue Subdrain, 10 Project No. 3681; and 11 WHEREAS, eighteen (18) sealed bids were received on April 13, 2010, by the City of 12 Carlsbad for the construction of said project; and 13 WHEREAS, the lowest responsive and responsible bid to construct said project was ^ submitted by Atom Engineering Construction, in the amount of $117,395; and 15 WHEREAS, there are sufficient funds Gas Tax funds available to complete the project; 16 and 17 WHEREAS, subsection 3.28.040(C)(6) of the Carlsbad Municipal Code authorizes the 18 City Manager to approve change orders in the amount equal to the contingency set at the time of 19 project award. 9ft NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Carlsbad, 21 California, as follows: 22 1. That the above recitations are true and correct. 23 2. That the low bid of $117,395 submitted by Atom Engineering Construction for the 24 construction of the La Costa Avenue Subdrain, Project No. 3681, is accepted and the Mayor is 25 hereby authorized to execute a contract with Atom Engineering Construction for Project No. 3681. 26 3. That the award of this contract is contingent upon the bidder submitting the lowest responsible bid executing the required contract and submitting the required bonds and insurance policies, as described in the contract, within twenty (20) days of adoption of this resolution.
