A RESOLUTION OF THE PLANING COIWiISSION OF THE
CITY OF CARLSBAD, CALIFORNIA, APPROVING A SITE
DEVELOPMENT PLAN NO. 77-1 (C) FOR A DRIVE-THRU
BANKING FACILITY ON PROPERTY GENERALLY LOCATED
ON THE SOUTHEAST CORNER OF DOVE LANE AND EL
CAMINO REAL.
APPLICANT : LA JOLLA BANK AND TRUST
CASE NO: SDP-77-1 (C)
WHEREAS, a verified application has been filed with the

of Carlsbad, and referred to the Planning Commission; and
WHEREAS, said verified application constitutes a reques
provided by Title 21 of the Carlsbad Municipal Code; and
WHEREAS, the Planning Commission approved Site Developn
Plan SDP-77-1 with Resolution No. 1374, dated June 22, 1977;
WHEREAS, pursuant to the provisions of the Municipal Cc

NOW, THEREFORE, BE IT HEREBY RESOLVED by the Planning C
mission of the City of Carlsbad as follows:
A) That the foregoing recitations are true and correct.

1 B) That based on the evidence presented at the hearing, the
Commission APPROVES SDP 77-1(C), based on the following 2 findings and subject to the following conditions:

4 1) The proposed development is consistent with the city's General Plan and with the overall intent of the previous:

3) The project is consistent with all applicable city public
facility policies and ordinances since:

c) The applicant has agreed and is required by the inc sion of an appropriate condition to pay a public fa ities fee. Performance of that contract and paymen
the fee will enable this body to find that public f
ities will be available concurrent with need as req
by the General Plan.
d) A condition has been added that building permits ca
be approved unless sewer service is available and
building cannot occur within the project unless sew
service remains available. Therefore, the Planning Corrmission is satisfied that the requirements of th Public Facilities Element of the General Plan have met insofar as they apply to sewer service for this
21 4) Based on an initial study of the project, including a fi
investigation of the site, the Planning Director has det
22 mined that the proposed development will not result in a
significant environmental impacts and, therefore, has is
23 a Negative Declaration on March 8, 1980 (Log No. 652).

25 1) Approval is granted for SDP 77-1(C) as shown on Exhibits
by reference and on file in the Planning Department. DE 26

2) This project is approved upon the express condition that building permits will not be issued for developments of t
subject property unless the City Engineer determines that sewer facilities are available at the tine of applicatior for such sewer permits and will continue to be available
until time of occupancy.

3) The applicant shall prepare a reproducible nylar of the final site development plan incorporating the conditions
contained herein. SAid site plan shall be submitted to i approved by the Flanning Department prior to the issuancc
building permits.

4) This project is approved upon the express condition that
applicant shall pay a public facilities fee as required : City Council Policy No. 17, dated August 29, 1979, on fi with the City Clerk and incorporated herein by reference
and according to the agreement executed by the applicant
payment of said fee a copy of that agreement dated z. Yarch
1980, is on file with the City Clerk and is incorporated herein by reference. If said fee is not paid as promised
this application will not be consistent with the General Plan and approval for this project shall be void. This is required for all future development of this property which a building permit has not been issued.

5) The easternmost drive-thru lane of the proposed! bank sha be eliminated, and the traffic island shall widened in
its place.

6) A detailed landscape and irrigation plan for the banking facility and the traffic island bordering the drive-thru lanes shall be subject to the approval of the Planning
Director. Said plan shall utilize drought tolerant plan
species and be consistent with the landscape plan approv
for the commercial center.
