PLANNING COMMISSION RESOLUTION NO. 4028
A RESOLUTION OF THE PLANNING COMMISSION OF THE
CITY OF CARLSBAD, CALIFORNIA, APPROVING A
SPECIAL USE PERMIT TO ALLOW THE INSTALLATION OF
SIX (6) PCS PANEL ANTENNAS MOUNTED ON POLES, ONE
(1) GLOBAL POSITIONING ANTENNA, AND SIX (6)
PROPERTY GENERALLY LOCATED AT 4901 EL CAMINO
REAL IN LOCAL FACILITIES MANAGEMENT ZONE 1.

WHEREAS, Cox California PCS, Inc., “Developer”, has filed a ve
application with the City of Carlsbad regarding property owned by Jay and Maryon Hofi
“Owner”, described as
GROUND-MOUNTED EQUIPMENT CABINETS ON
Parcel 1 of Parcel Map 3451, in the City of Carlsbad, County
of San Diego, State of California filed January 31, 1975, in the
office of the County Recorder of San Diego County, and That
portion of Parcels 2 and 3 of Parcel Map No. 3451, in the City
of Carlsbad, County of San Diego, State of California, filed in
the Office of the County Recorder of San Diego County,
January 31,1975
(‘the Property”); and
WHEREAS, said verified application constitutes a request for a Specia:
Permit as shown on Exhibits “A”-“I” dated December 4, 1996, on file in the Pla
Department (Marja Acres PCS Facility - CUP 96-05mDP 96-O7/SUP 96-05), as provid
Chapter 21.40 of the Carlsbad Municipal Code; and
WHEREAS, the Planning Commission did on the 4th day of December
hold a duly noticed public hearing as prescribed by law to consider said request; and
WHEREAS, at said public hearing, upon hearing and considering all testi
and arguments, if any, of all persons desiring to be heard, said Commission considered all fi
relating to the Special Use Permit.

NOW, THEREFORE, BE IT HEREBY RESOLVED by the Pla
Commission of the City of Carlsbad as follows:
A) That the foregoing recitations are true and correct.
B) That based on the evidence presented at the public hearing, the Comm-
APPROVES Special Use Permit SUP 96-05 based on the following finding
subject to the following conditions:
Findings:
1. The proposed project is consistent with the purposes of Chapter 21.40 (S
Preservation Overlay) and all applicable general and specific plans, and wil
adversely affect the scenic, historical or cultural qualities of the subject propel
that the proposed antenna poles will be located far enough away from El Ca
Real so as not to be visually intrusive to the El Camino Real Scenic Corridor
the proposed project will be screened by several means including: a split-face L
wall painted to match surrounding vegetation (for the equipment cabinets), a E
vinyl chain link fence (for the antenna poles), and required landscaping (fo~
antenna poles), the antenna poles will be located in the slopes such that none a
tops of the poles will be visible above the ridgeline.
Conditions:
1. The Planning Commission does hereby APPROVE the Special Use Permit fc
project entitled Marja Acres PCS Facility Exhibits “A”-“I” dated December 4,
on file in the Planning Department and incorporated by this reference, subject t
conditions herein set forth. Staff is authorized and directed to make, or require Deve
