RESOLUTION NO. 5402
A RESOLUTION OF THE CITY COU!iCIL OF THE
CITY OF CARLSBAD, C-ALIFORNIA, AUTHORIZING
THE SALE OF REAL PROPERTY OF THE CITY NOT
NEEDED FOR PUBLIC USE AS DESCRIBED IN
RESOLUTION NO. 5365, AND HEREINAFTER MORE
PARTICULARLY DESCRIBED, TO
JAMES R. GERRARD

SUBJECT TO THE TERMS AND CONDITIONS HEREOF.
WHEREAS, the City Council duly adopted Resolution No. 5365
on April 4, 1978, declaring the real property, hereinafter
described, is not needed by the City for public use, is not
capable of being used for park or recreational development,
and declaring its intention to sell the same; and
WHEREAS, the Planning Commission of the City of Oceanside
has determined. that said real property disposition is in conformity
with the General Plan; and
WHEREAS, a public hearing to consider any protests of the sale
was held on Na.y 2, 1978, in the City Hall, 1200 Elm Avenue,
Carlsbad, Ca1i.f ornia;
NOW, THEFEFORE, BE IT RESOLVED by the City Council of the
Cit.y of Carlsbad, California, as follows:
1. That the above recitations are true and correct.
2. That the City Council hereby overrules any protests
which may have been filed and authorizes the sale of the herein-
after described property to JAMES R. GERRARD
for the highest bid price received in the amount of
which sm is riot less than the minimum price designated in
Resolution No.. 5365.

3. That the real property to be sold by the City is situated
in the City of Oceanside, County of San Diego, State of California

more particularly described as follows :
"A Portion of the East One Quarter of Section 24,
Towne'hip 11 South, Range 5 West, San Diego County,
San Bernardino Base and Heridian. ''
It is further identfied as Assessor's Parcel
NO. 1.49-07-28.
excepting a portion of said property as shown on Exhibit A,
attached heret.0 and made a part hereof, which shall be retained
by the City of' Carlsbad.
4. That the Mayor and City Clerk are authorized to execute,
on behalf of t.he City, a Grant Deed for the above-described
property, subject to conditions, restrictions, reservations,
easements, rights of way of record, if any.
5. That the purchase price shall be payable in cash, or
cashier's check, to the City, and shall be payable at the office
of the City Clerk.
Bidders shall solely assme all costs related to the
transaction, including escrow fees, if escrow is wanted. The
City shall secure a policy of title insurance which shall be at
the City's sole expense.
6. This sale is subject to the City's recordation of a
minor subdivision map, separating the property to be retained by
the City,from that to be sold. The purchase price shall be paid
within 10 days of the recordation of said map.

PASSED, APPROVED AND ADOPTED at a regular meeting of the
City Council on the 2nd day of May , 1978, by the
following vote, to wit:
