HomeMy WebLinkAbout1976-12-08; Planning Commission; Resolution 1301' // 9 9 1 2 3 4 5 6 7 8 PLANNING COMMISSION RESOLUTION NO. 1301 RESOLUTION OF THE PLANNING COMMISSION OF CERNING A PLANNED UNIT DEVELOPMENT FOR 209 RESIDENTIAL UNITS ON PROPERTY LOCATED TWEEN CADENCIA STREET AND GIBRALTAR. APPLICANT: LA COSTA LAND COMPANY THE CITY OF CARLSBAD, CALIFORNIA, CON- ON THE NORTH SIDE OF LA COSTA AVENUE BE- CASE NO. : PUD-7 !{HEREAS, a verified application for a certain property, t wit: 9 Assessor's Book No. 223, Page 180, Parcels 1, 3-8 18 10 and 19-24; Assessor's Book No. 223, Page 200, Parcel 11 12 13 14 15 16 17 has been filed with the City of Carlsbad and referred to the Planning Commission; and WHEREAS, said verified application constitutes a request as provided by Title 21 of the "Carlsbad Municipal Code"; and WHEREAS, at said public hearing, upon hearing and conside> ~ ing the testimony and arguments, if any, of all persons who de. 11 sired to be heard, said Commission considered all factors rela, 18 11 to the Planned Unit Development and found the following facts ' 19 20 21 22 23 24 25 reasons to exist: 1) The proposed use at the particular location is necessary l desirable to provide a service or facility which will con tribute to the general well-being of the neighborhood and the community because: a) The development will allow the subject property to bt developed to its allowable potential and density; an( b) The development will provide comprehensively planned public park access and private amenities. 26 2) The use will not be detrimental to the health, safety, or vicinity because: 28 vicinity or injurious to property or improvements in the 27 general welfare of the persons residing or working in the r , 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 m e a) The proposed PUD will be developed in a manner simil to the anticipated future development in the area. 3) The design criteria set forth in Section 21.45.110 and a1 minimum development standards set forth in Section 21.45. will be met because: a) The plot plan and additional exhibits include all development as?ects required; b) The plot plan and additional exhibits include adequa provision for open space, recreational facilities, circulation and parking; c) The project will be developed in a manner to be com- patible with surrounding development; d) Internal curculation is acceptable to the City Engin as shown on the plot plan and by conditions of appro e) Private recreational facilities, and public open spa are readily accessible; and f) Dwelling unit density does not exceed the density a1 in the underlying zone (P-C with Plaster Plan). NOW, THEREFORE, BE IT RESOLVED by the Planning Commission the City of Carlsbad as follows: A) That the above recitations are true and correct. B) That in view of the findings heretofore made and consider the applicable law, the decision of the Planning Commissi is to approved PUD-7, subject to the following conditions 1) The approval is granted for the land described in th application and any attachments thereto, and as show on the Plot Plan submitted labeled Exhibit B, dated 11/1/76, Exhibit Cy dated 11/12/76, Exhibit D, dated 11/12/76, and Exhibit E, dated 11/12/76. The locati of all roadways, parking areas, landscaping and othe facilities or features shall be located substantial1 as shown on Exhibits By Cy D and E unless otherwise provided herein. 2) All conditions shall be appropriately completed and project commenced within 18 months from final City action. 3) The set backs or yards are as follows: a) Front Yard - minimum 20.00 feet from the right- of-way line to the front line of the building. -2- 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 W I) 4) 5) 6) 7) 8) 9) 10) 11) ~ b) Rear Yard - minimum 10.00 feet from the rear li of the building to the rear lot line or street right-of-way line on through lots. c) Side Yards: 1) The side ,yard adjacent to a lower pad shal be a minimum of 5.00 feet from building li to property line. 2) The side yard adjacent to a pad that is 3. feet, or less, higher shall be a minimum o 5.00 feet from building line to property 1 3) The side yard adjacent to a pad that is mo than 3.00 feet higher shall be a minimum o 7.50 feet from building line to property 1 4) Minimum distance between buildings shall b 10.00 feet. Any structure that has a foundation or decking and t extends higher than 3 feet from the ground level, su as patio covers, etc., shall not be constructed clos than 5 feet from any rear property line or any slope or 5 feet from any side lot line or slope. A landscape, irrigation, surfacing and fencing plan the recreational vehicle storage area shown on Exhib C, shall be submitted to the Planning Director, Park and Recreation Director and City Engineer for their approval prior to issuance of grading permits. Facilities on lots 210, 211 and 212 as shown on Exhi C shall be completed to the satisfaction of the Park. and Recreation Director prior to building permit issuance for Unit 3. Provision for electrical facilities on lots 210, 211 and 212 will be provided to the satisfaction of the Parks and Recreation Director. Facilities such as picnic tables, fences, etc., will provided on lots 210, 211 and 212 as required b,y the Parks and Recreation Director. The asphalt trail shown on Exhibit E shall be 6' wid( minimum. The concrete walk shown on Exhibit D shall be 7' and as shown on the exhibit. The 20' access easement between lots 103 and 104 sha; be fenced to the satisfaction of the Parks and Recret Director. - 3- -, II w e 1 2 3 4 5 6 7 12) A barrier will be placed on the western portion of 1 210 to the satisfaction of the Parks and Recreation Director. 13) Prior to the issuance of grading permits, the City Engineer shall approve a plan submitted by the appli cant for interim erosion control on all man-made slo in excess of five feet created by this subdivision. Prior to this issuance of grading permits, the appli shall post bonds and agreements ensuring the install and maintenance of the erosion control system until permanent landscaping is installed and maintained. I 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 14) Prior to the issuance of any building permits, the applicant shall submit a permanent landscaping and irrigation plan to the Parks and Recreation Director for his approval. The plan shall include all artifi slopes. These slopes shall: a) Utilize fire-retardant, drought-resistant land- scaping which includes trees and shrubs which r a variety of sizes at maturity; and b) Utilize an irrigation system appropriate for co maintenance of the required landscaping in conf mance with Conditions 15 and 16. 15) Permanent landscaping and irrigation shall be instal on all lots identified in Condition 13 before any of those lots are occupied. If residential constructiol occurs in units, this condition shall be met on a un. by-unit basis. 16) Prior to the issuance of building permits, the provi! of permanent open space maintenance on those areas a! indicated in Condition 14 shall be assured to the sa. faction of the Planning Director. Such maintenance I be assured by the formation of an Open Space Mainten( District, Homeowners' Association or similar institu, suitable for commonly maintaining open space. 17) CC&Rs for the project will be submitted to the Plann Director for approval prior to issuance of building permits. 18) Provision for the exclusive use of the Recreational Vehicle lot shown on Exhibit C for the subject PUD, i provided for under Section 21.45.120(b), shall be accomplished to the satisfaction of the City Attorne) prior to issuance of building permits for the 1st phi 27 28 19) Access easements will be provided along the lot line: with abutting structures to allow building maintenanc from adjacent property. 11 - 4- v .. .. ,. 9 * 1 PASSED, APPROVED AND ADOPTED at a regular meeting of the 2 of Carlsbad Planning Commission held on December 8, 1976, by t 311 following vote, to wit: 4 5 6 7 8 9 10 AYES: Commisisoners L’Heureux, Watson, Fikes, Nelson, NOES: None.
