CASE NAME: FAIRWAY CORPORATE CENTER CASE NO: SUP 97-1 1 WHEREAS, Z.B. Investment Co., L.L.C., “Developer”, has filed a application with the City of Carlsbad regarding property owned by Union Pacific 1 Company, “Owner”, described as TWO-STORY OFFICE BUILDINGS WITHIN THE EL Parcels 2 and 3 of Parcel Map No. 17830, in the City of Carlsbad, County of San Diego, State of California, filed in the office of the County Recorder of San Diego County, March 21, 1997 as file No. 1997-0129122 of official records. (‘the Property”); and WHEREAS, said verified application constitutes a request for a Spe Permit as shown on Exhibit(s) “A”-“G” dated April 15, 1998, on file in the I. Department FAIRWAY CORPORATE CENTER, SUP 97-11, as provided in Chapt of the Carlsbad Municipal Code; and WHEREAS, the Planning Commission did on the 15th day of April, 1991 duly noticed public hearing as prescribed by law to consider said request; and WHEREAS, at said public hearing, upon hearing and considering all te and arguments, if any, of all persons desiring to be heard, said Commission considered a1 relating to the Special Use Permit; NOW, THEREFORE, BE IT HEREBY RESOLVED by the I Commission of the City of Carlsbad as follows: 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 0 0 A) That the foregoing recitations are true and correct. B) That based on the evidence presented at the public hearing, the Cor! APPROVES FAIRWAY CORPORATE CENTER SUP 97-11, base following findings and subject to the following conditions: Findings: - I. Planning Commission finds that: a) the project is a later activity considered by the Carlsbad Research Center Plan and evaluated in a previous EIR; b) the project is consistent with the Carlsbad Research Center Specific Plan; c) there was an EIR certified in connection with the prior Carlsbad Researcl Specific Plan; d) the project has no new significant environmental effect not analyzed as si$ in the prior EIR; e) none of the circumstances requiring Subsequent or a Supplemental E1 CEQA Guidelines Sections 15162 or 15163 exist; f) The Planning Commission finds that all feasible mitigation measures iden the Carlsbad Research Center Specific Plan which are appropriate Subsequent Project have been incorporated into this Subsequent Project. 2. That the project is consistent with General Plan Land Use Element in tha development is included as an allowed use within the Planned Industrial 1; designation. 3. That the requested use is properly related to the site, surroundings and enviro~ settings, is consistent with the various elements and objectives of the General P1 not be detrimental to existing uses or to uses specifically permitted in the area il the proposed use is to be located, and will not adversely impact the site, surrounc traffic circulation, in that the proposed office use is consistent with surroundi and is consistent with the intent of the Carlsbad Research Center. 4. That the site for the intended use is adequate in size and shape to accommodate the that all required onsite improvements including parking and employee eatin; have been provided. That all yards, setbacks, walls, fences, landscaping, and other features necessary the requested use to existing or permitted future uses in the neighborhood provided and maintained, in that all required setbacks have been provided. 6. That the street systems serving the proposed use is adequate to properly handle 2 generated by the proposed use, in that the project is not expected to genera than 2,400 Average Daily Traffic which is below the overall capacity of the I local street. 7. That the project is consistent with the applicable development standard! zoning ordinance and the development standards of the El Camino Real C scenic preservation overlay zone in that all of the proper setbacks and heigl have been observed, in that the building has been designed with a “campus’ and in that all of the necessary parking has been provided onsite. Conditions: 1. Staff is authorized and directed to make, or require Developer to make, all co: and modifications to the Special Use Permit document(s) necessary to ma internally consistent and in conformity with final action on the project. Deve shall occur substantially as shown in the approved Exhibits. Any proposed deve substantially different from this approval, shall require an amendment to this appr 2. The Developer shall provide the City with a reproducible 24” x 36”, mylar cop Site Plan as approved by the final decision making body. The Site Plan shall re conditions of approval by the City. The Plan copy shall be submitted to t Engineer and approved prior to building, grading, final map, or improvemt submittal, whichever occurs first. 3. The Developer shall prepare a detailed landscape and irrigation plan in conforma the City’s Landscape Manual with a focus on enhancing the frontage along El 1 Real. The plans shall be submitted to and approval obtained from the Planning prior to the approval of the building permit. The Developer shall construct and i~ landscaping as shown on the approved plans, and maintain all landscaping in a and thriving condition, free from weeds, trash, and debris. 4. A landscape plan shall be completed in accordance with the Landscape Man presented for approval by the Planning Director. Engineering Note: Unless specifically stated otherwise in the condition, the developer shall satisfy a following conditions, prior to the issuance of building permits. Building permits will not be issued for development of the subject property ur District Engineer determines that sewer facilities are available. 5. Prior to issuance of any building permit, the developer shall comply c requirements of the City's anti-graffiti program for wall treatments if and whe~ program is formerly established by the City. 6. The developer shall pay all current fees and deposits required. 7. The owner of the subject property shall execute an agreement holding the City 1 regarding drainage across the adjacent property. Grading 8. No grading shall occur outside the boundary of this parcel unless a grading ( easement is obtained from the owners of the affected properties. If the applicant i: to obtain the grading or slope easement, no grading permit will be issued. In that ' applicant must amend the site plan so grading will not occur outside the project manner which substantially conforms to the approved project as determined by 1 Engineer and Planning Director. 9. Based upon a review of the proposed grading as shown on the site plan, a permit for this project is NOT required. 10. Prior to hauling dirt or construction materials to or from the site, the develop1 submit to and receive approval from the City Engineer for the proposed haul roul developer shall comply with all conditions and requirements the City Engine impose with regards to the hauling operation. 11. The developer shall exercise special care during the construction phase of this prc prevent offsite siltation. Planting and erosion control shall be provided in accc with the Carlsbad Municipal Code and the City Engineer. ... ... ...
