HomeMy WebLinkAbout1996-12-04; Planning Commission; Resolution 4027- c’ 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 a 0 PLANNING COMMISSION RESOLUTION NO. 4027 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF CARLSBAD, CALIFORNIA, APPROVING A HILLSIDE DEVELOPMENT PERMIT TO ALLOW THE INSTALLATION OF SIX (6) PCS PANEL ANTENNAS MOUNTED ON POLES, ONE (1) GLOBAL POSITIONING CABINETS ON PROPERTY GENERALLY LOCATED AT 4901 EL CAMINO REAL IN LOCAL FACILITIES MANAGEMENT ZONE 1. CASE NAME: MAMA ACRES PCS FACILITY CASE NO: HDP 96-07 WHEREAS, Cox California PCS, Inc., “Developer”, has filed a ve application with the City of Carlsbad regarding property owned by Jay and Maryon Hofj “Owner”, described as ANTENNA, AND SIX (6) GROUND-MOUNTED EQUIPMENT Parcel 1 of Parcel Map 3451, in the City of Carlsbad, County of San Diego, State of California filed January 31, 1975, in the office of the County Recorder of San Diego County, and That portion of Parcels 2 and 3 of Parcel Map No. 3451, in the City of Carlsbad, County of San Diego, State of California, filed in the Office of the County Recorder of San Diego County, January 31,1975 (“the Property”); and WHEREAS, said verified application constitutes a request for a H: Development Permit as shown on Exhibits “A”-“I” dated December 4, 1996, on file Carlsbad Planning Department (Marja Acres PCS Facility - CUP 96-05/HDP 96-07/SU 05) as provided by Chapter 21.95 of the Carlsbad Municipal Code; and WHEREAS, the Planning Commission did on the 4th day of December consider said request; and WHEREAS, at said hearing, upon hearing and considering all testimon arguments, if any, of all persons desiring to be heard, said Commission considered all f relating to the Hillside Development Permit. 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 e 0 NOW, THEREFORE, BE IT HEREBY RESOLVED by the Pla Commission as follows: A) That the foregoing recitations are true and correct. B) That based on the evidence presented at the public hearing, the Comm APPROVES Hillside Development Permit, HDP 96-07, based on the follc findings and subject to the following conditions: Findings: 1. That hillside conditions have been properly identified on the constraints map which existing and proposed conditions and slope percentages. 2. That undevelopable areas of the project, i.e. slopes over 40%, have been prc identified on the constraints map. 3. That the development proposal is consistent with the intent, purpose, and requireme the Hillside Ordinance, Chapter 21.95, in that the project will not result in signil grading or disturbance of the hillside, is of very low intensity, and will be adeqt screened to minimize visibility of the project from surrounding uses and fro Camino Real. 4. That the proposed development or grading will not occur in the undevelopable portic the site pursuant to provisions of Section 21.53.230 of the Carlsbad Municipal Co that the proposed use is non-residential and therefore, is not subject tc restrictions of Section 21.53.230. However, Section 21.53.240, which governs residential development on open space and environmentally sensitive lands, a] the standards of Section 21.53.230. The proposed project is consistent with Sc 21.53.240 in that the project does not occur on environmentally sensitive lan slopes of greater than 40%. 5. That the project design substantially conforms to the intent of the concepts illustral the Hillside Development Guidelines Manual, in that the project minimizes gr; amounts, minimizes visibility of the project by providing adequate screening, a1 locating the antenna poles so as to not be visible above the ridgeline. 6. That the project design and lot configuration minimizes disturbance of hillside lan that the project will occupy three very small areas in and at the lower edge ( slope area, and the amount of grading is limited to that required to create a pa the equipment cabinets and the area in which the necessary electric lines w placed underground, and the area of the underground lines will be reseeded the facility installation is complete. ... The Planning Commission does hereby APPROVE the Hillside Development Pern project entitled Marja Acres PCS Facility, Exhibits “A”-“I” dated December 4, on file in the Planning Department and incorporated by this reference, subject . conditions herein set forth. Staff is authorized and directed to make, or require Deve to make, all corrections and modifications to the Hillside Development P document(s), as necessary, to make them internally consistent and in conformity final action on the project. Development shall occur substantially as shown i approved Exhibits. Any proposed development substantially different from this app shall require an amendment to this approval. 2. Approval of HDP 96-07 is granted subject to the approval of CUP 96-05 and 96-05. 3.
