CASE NO. : SP-175 (A) APPLICANT: Howard Shomate (Homeowner's Association) WHEREAS, a verified application for a certain property, wit: Portion of La Costa Downs Unit No. 1, according to Map thereof No. 2013 filed in the Office of the County Recorder of San Diego County, April 6, 1927 and those portions of Fractional Sections 20 and 21, Township South, Range 4 West, San Bernardino Meridian. has been filed with the City of Carlsbad and referred to the Planning Commission; and WHEREAS, said verified application constitutes a request as provided by Title 21 of the "Carlsbad Municipal Code"; and WHEREAS, the Planning Commission did on the 11th day of October, 1978, hold a duly noticed public hearing as prescrib by law to consider said request; and WHENAS, at said public hearing, upon hearing and consid the testimony and arguments, if any, of all persons who desir to be heard, said Commission considered all factors relating Specific Plan Amendment and found the following facts and rea to exist: The proposed Specific Plan Amendment is consistent with General Plan because it will not increase the density of the existing development nor will it affect circulation patterns. // ' II w 0 1 The proposed Specific Plan Amendment is consistent with 2 categorically exempt pursuant to sectioln 19.04.040 (c), (4), 3 City of Carlsbad Environmental Protection Ordinance because i 4 The proposed Specific Plan Amendment conforms to City PO 5 6 and ordinances dealing with public facilities because, if app: recommended APPROVAL of SP-175 (A) as ':fotllows: 9 WHEREAS, the Planning Commission by the following vote 8 facilities. 7 the amendment will not result in any ad.ditiona1 load on publil 10 read: 11 Item l.,(a) should be added to section 3 of Specific Plan 175 1.
