2 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
CARLSBAD, CALIFORNIA, APPROVING A TENTATIVE
3 TRACT MAP (CT 06-20) AND NONRESIDENTIAL
4 PLANNED DEVELOPMENT PERMIT (PUD 06-02) TO
SUBDIVIDE A 20.824-ACRE SITE WITH 18 PREVIOUSLY
5 APPROVED INDUSTRIAL BUILDINGS INTO 93 AIRSPACE
NONRESIDENTIAL CONDOMINIUM UNITS AND ONE
6 COMMON AREA LOT GENERALLY LOCATED ALONG
THE SOUTH SIDE OF PALOMAR AIRPORT ROAD, EAST
7 OF INNOVATION WAY, AND NORTH OF GATEWAY
ROAD IN THE P-M (PLANNED INDUSTRIAL) ZONE,
8 BRESSI RANCH MASTER PLAN, PLANNING AREA 4,
AND LOCAL FACILITIES MANAGEMENT ZONE 17.

11 WHEREAS, pursuant to the provisions of the Municipal Code, the
12 Planning Commission did, on February 7, 2007, hold a duly noticed public hearing as
13 prescribed by law to consider a Tentative Tract Map (CT 06-20) and Non-Residential
14 Planned Development Permit (PUD 06-02); and
WHEREAS, the City Council of the City of Carlsbad, on the 13th day

of March , 2007, held a duly noticed public hearing to consider said Tentative
17
Tract Map and Non-Residential Planned Development Permit and at that time received
18
recommendations, objections, protests, comments of all persons interested in or
20 opposed to CT 06-20 and PUD 06-02; and
21 NOW, THEREFORE, BE IT HEREBY RESOLVED by the City Council of
22 the City of Carlsbad as follows:
23 1. That all recitations are true and correct.

2. That the recommendation of the Planning Commission for the
25 approval of the Tentative Tract Map (CT 06-20) and Non-Residential Planned
Development Permit (PUD 06-02) is approved by the City Council and that the findings
26 and conditions of the Planning Commission as set forth in Planning Commission
Resolution No. 6239 and 6240, on file with the City Clerk and made a part hereof by
27 reference, are the findings and conditions of the City Council.

1 3. The action is final the date this resolution is adopted by the City
Council. The Provisions of Chapter 1.16 of the Carlsbad Municipal Code, 'Time Limits
2 for Judicial Review" shall apply:
3 "NOTICE TO APPLICANT"
4 The time within which judicial review of this decision must be
5 sought is governed by Code of Civil Procedure, Section 1094.6,
which has been made applicable in the City of Carlsbad by
6 Carlsbad Municipal Code Chapter 1.16. Any petition or other paper
seeking review must be filed in the appropriate court not later than
7 the nineteenth day following the date on which this decision
becomes final; however, if within ten days after the decision
8 becomes final a request for the record of the deposit in an amount
sufficient to cover the estimated cost or preparation of such record,
the time within which such petition may be filed in court is extended
10 to not later than the thirtieth day following the date on which the
record is either personally delivered or mailed to the party, or his
11 attorney of record, if he has one. A written request for the
preparation of the record of the proceedings shall be filed with the
12 City Clerk, City of Carlsbad, 1200 Carlsbad Village Drive, Carlsbad,
CA. 92008."13
