Planning Systems is processing sign design and permit applications for the Fairway Corporate
Center, located on the southwest corner of College Boulevard and El Camino Real. During the
course of processing we discovered that two City documents contain conflicting regulations for
signs at this location.
1. The El Camino Real Corridor Development standards allow monuments signs,
but wall signs are prohibited.
2. The Carlsbad Research Center Specific Plan allows wall signs, but prohibits
monument signs.
We requested that Planning Department staff make an administrative decision regarding which
document takes precedence. Staff stated that no decision can be made until revision of the City
sign ordinance is complete. Then staff can decide how to resolve the plan conflicts. We also
understand Planning Department staff are conflicted, with some senior staff preferring wall
signs and some preferring monument signs. The end result is that our client, who has been
trying to get signs on his building for over a year, cannot and there is no definite time frame for
resolution of the problem.
Since the sign ordinance does not address the specific issue of concern, the need to wait for its
completion is unclear. We do not believe it is the intent of either City plan to prohibit signs at
the subject location, as both plans provide specifications for signage, albeit conflicting
specifications. We ask you as Director of Community Development to resolve this conflict or
direct the Planning Department to resolve the conflict in a timely manner. Thank you for your

I have been working with the owners of the Fairway Corporate Center, located at the comer of College
and El Camino Real, since April of 1999 in an effort to design signs that would be acceptable to the City
and the Carlsbad Research Center. Our fust attempt followed the development standards in the Carlsbad
Research Center Specific Plan which prohibits ground sign oriented to El Camino Real. Upon submittal,
Planning Department staff pointed out that the plans did not meet the El Camino Real Scenic Comdor
Development Standards which prohibit walls signs oriented to El Camino Real.
Given the conflicting requirements, I went to Mike Grim, in September of 1999, and asked which
standards should take precedence. Mike recommended following the El Camino Real Comdor
Development Standards in the interest of continuity, since the development going in at the former Hughes
site on El Camino Real was using monument signs.
Based on this input we provided a conceptual sign design to our client that met the needs of the City and
the CRC. The client then passed the signs on for final design to his sign contractor, who submitted the
designs to the City for issuance of a sign permit. The permit for the El Camino Real signs was denied in a
letter from the City dated February 1,2000. The letter cites the ground sign prohibition contained in the
CRC Specific Plan as the reason for denial.
Our client has spent a considerable amount of time and money to design these signs. We advised our
clients based on direct input from City Staff. Now we are faced with telling our client that he cannot have
any signs until the City decides which document takes precedence, the CRC Specific Plan or El Camino
Real Comdor Development Standards. This does not reflect well on the City or Planning Systems. I
imagine the amendment process is a lengthy one. One that in effect penalizes our client for his efforts to
comply with the conflicting city requirements. I believe it would be appropriate in this case for you or
Michael to make an administrative decision on this particular parcel while the City amends the document
of its choice. I w-ould be happy to meet with you and Michael to discuss the issue further if you wish.

200 square feet in area or comprise more than 10% of
the area of the elevation upon which the sign is locat- ed, whichever is less.
b. In multi-tenant industrial or office buildings, each individual business may have a wall sign over the entrance to identify the tenant. Said sign will give only the name of the company and will be limited to letters six inches high. Said signs will be oriented
toward the parking or pedestrian area for that building
and shall not exceed a maximum are2 of five square feet .
c. In multi-tenant comnercial buildings, each ground-floor business may have one wall sign per building frontage. Said signs shall not be located above the ground-floor
facia. Each sign shall be limited to an area equal to 10% of the business face upon which it is located, or a maximum of 35 square feet.

a. Ground signs shall not exceed four feet above grade in height or more than 1-1/2 square feet in area for each foot of lineal frontage of the building or store. How- ever, no sign shall exceed 200 square feet in area (100 square feet per face, two-face maximum).
b. Every lot may have at least one ground sign. Addition- al ground signs may be added for every 200 square feet
of street frontage in excess of the first 100 feet of
street frontage.

Dear Ian:
The Planning Department has reviewed your proposed monuments signs for the
Fairway Corporate Center, located at 5540-5541 Fermi Court. All signs within the
Carlsbad Research Center are subject to the provisions of the Carlsbad Research
Center Specific Plan (SP 180). According to this Specific Plan, “no ground sign other
than the approved entryway sign shall be approved so as to be visible along El Camino
Real.” Therefore staff cannot support the two proposed monument signs along El
Camino Real. A copy of this correspondence is being forwarded to the Carlsbad
Research Center Architectural Review Committee to assist them in providing direction
consistent with the provisions of the Specific Plan.
All proposed monument signs must be reviewed and approved by the Traffic
Engineering division prior to issuance. The Traffic Engineering division is currently
reviewing the proposed signs on Fermi Court and will apprise the Planning Department
of their determination. Upon receipt of comments from Traffic Engineering, you will be
informed as to the status of your sign permit application. Please feel free to contact me
