MS 04-01 A preliminary decision has been made, pursuant to Section 20.24.120 of the City of Carlsbad Municipal Code, to approve the tentative parcel map of the proposed minor subdivision subject to the following conditions: ,/t. The applicant may request a review of the preliminary conditions within ten (10) days of the date of this approval. The request must be submitted in writing to the City Engineer in accordance with Section 20.24.120 through 140 of the Carlsbad Municipal Code. The parcel map shall comply with the Planning Department memorandum for Minor Subdivision No. 04-01 and the conditions of approval for PCD 05-01. The tentative parcel map approval shall expire twenty-four (24) months from the date of the letter containing the final decision for tentative parcel map approval. i/4. The applicant shall provide the City with the approved tentative parcel map. The map shall be to scale on a reproducible 24" x 36" xerox or photo mylar. The tentative parcel map shall reflect the conditions of approval by the City. The reproducible shall be submitted to the City Engineer, reviewed and signed by the City's project engineer and project planner prior to submittal of the building plans, final map, improvement or grading plans, whichever occurs first. Unless a standards variance has been issued, no variance from City Standards is authorized by virtue of approval of this tentative parcel map. The applicant shall defend, indemnify and hold harmless the City and its agents, officers, and employees from any claim, action or proceeding against the City or its agents, officers, or employees to attack, set aside, void or null an approval of the City, the Planning Commission or City Engineer which has been brought against the City within the time period provided for by Section 66499.37 of the Subdivision Map Act. All required fees and deposits shall be paid prior to approval of the parcel map. The applicant shall pay the jpcal drainage area fee prior to approval of the parcel map. The private drainage, sewer and access easement shall be recorded, via a separate covenant of easement document, concurrently with the final parcel map. (Vp The applicant shall pay park-in-lieu fees to the City prior to the approval of the parcel map as required by Chapter 20.44 of the Carlsbad Municipal Code. 2. The project is approved under the express condition the applicant pay the additional public facilities fee prior to parcel map^pproval in accordance with City i Council Resolution No. 9169 adopted July 28, 1987 and as amended from time ' to time. The grading shown on the Minor Subdivision shall be completed as one unit under v ^^ one grading permit. Applicant shall process grading plans and apply for a grading permit prior to commencement of any earthwork. Grading shall not commence until recordation of the final parcel map. Prior to parcel map approval, grading plans shall be designed and secured to the satisfaction of the City Engineer. This project is approved upon the express condition that building permits will not be issued for development of the subject property unless the City Engineer determines that sewer facilities are available at the time of application for such sewer permits and will continue to be available until time of occupancy. This note shall be placed on the parcel map. xt6. The deferral of standard public improvements to Oak Avenue does not alleviate the developer to install any necessary drainage and pavement improvements deemed necessary at the time of development. Necessary improvements to Oak Avenue can be shown on and constructed with the grading plans and permit. The owner shall enter into a Neighborhood Improvement Agreement for the future c^ ./public improvement of Oak Avenue along the subdivision frontage for a half street c,^ width of 40 feet prior to approval of the parcel map. Public improvements shall t»*T ^^ include but not be limited to paving, base, sidewalks, curbs and gutters, medians, grading, clearing and grubbing, undergrounding or relocation of utilities, sewer, water, fire hydrants, street lights and retaining walls. MS 04-01 APPROVAL Whereas-no review of the conditions of the letter of -preliminary- approval -y/as-reqaestecHby the appropriate date; and whereas the requirements of the California Environmental Quality Act and the City of Carlsbad Environmental Protection Ordinance of 1973 relating to the subject proposed parcel map have been examined by the Planning Director and declared to have a non-significant impact upon the environment; and whereas negative findings delineated by Section 20.24.130 of the Carlsbad Municipal Code have not been made; and whereas this minor subdivision is found to be in conformity with the General Plan of the City of Carlsbad; therefore, a final decision has been made to approve the subject tentative parcel map subject to the conditions set forth in the preliminary approval letter. .
