DESCRIPTION: A request for a two year retroactive extension of Site Development Plan 05-04x1 for the
demolition of an existing hotel, restaurant, and single family residence and for the construction of a 3-
story, 104-room hotel project on property located at 3136 Carlsbad Boulevard on the east side of
Carlsbad Boulevard between Pine Avenue and Oak Avenue in Land Use District 9 of the Carlsbad Village
Area Master Plan, in the Village Review and Mello II Segments of the Local Coastal Program and in Local

COMPLETENESS AND ISSUES REVIEW
Land Development Engineering has completed a review of the above-referenced project for
completeness and engineering issues of concern. All items needed for engineering review are
provided for determining the application as complete. Engineering issues which need to be
resolved or adequately addressed prior to staff making a determination on the proposed
project are as follows:
1. Since the project is now subject to storm water pollutant mitigation requirements that
did not exist when the project was originally approved by the City in May 2007, provide
a site plan locating all the treatment BMP's sized per Section 4 of the City Standard
Urban Storm Water Management Plan (SUSMP). Two common treatment best
management practices (BMP's), flow-through planters and bioretention facilities, may
be sized by using a sizing factor of 0.04 times the contributory (DMA) area times the
runoff factor (Table 4-2). Opportunities to integrate Low Impact Design (LID) features,
such as pervious pavement and vegetated roofs, also appear to exist.
In addition, the project is subject to Hydromodification Management Plan (HMP)
requirements unless exempt per Section 2, Figure 2-1 of the City's Standard Urban
Storm Water Management Plan (SUSMP). An analysis will need to be included in the
required Storm Water Management Plan (SWMP) to justify any listed exemption. Since
the project ultimately drains to an exempt receiving water (Pacific Ocean) and appears
to do so through a hardened conveyance system, consider evaluating an exemption
under Node 7 and 8 of Figure 2-1.
If, however, no exemptions apply, rather than use the San Diego County BMP sizing
calculator or continuous simulation hydrology model at this time to size your BMP
facilities, you may use Tables 7-1 through 7-5 of the County of San Diego
Hydromodification Management Plan as a guide to roughly determine treatment BMP
sizing and hydromodification volume sizing. Use a flow threshold of 0.1Q2, soil group B,
flat slope, and Oceanside rain gauge.

Please replace conditions 36 and 37 from ORB Resolution 319 (RP 05-03) with the following
updated conditions:
36. Developer shall cause property owner to process, execute and submit an executed copy
to the City Engineer for recordation a City standard Permanent Stormwater Quality Best
Management Practice Maintenance Agreement for the perpetual maintenance of all
treatment control, applicable site design and source control, post-construction
permanent Best Management Practices prior to the issuance of a grading permit or
building permit, whichever occurs first for this Project.
37. Developer shall comply with the City's Stormwater Regulations, latest version, and shall
implement best management practices at all times. Best management practices include
but are not limited to pollution control practices or devices, erosion control to prevent
silt runoff during construction, general housekeeping practices, pollution prevention
and educational practices, maintenance procedures, and other management practices
or devices to prevent or reduce the discharge of pollutants to stormwater, receiving
water or stormwater conveyance system to the maximum extent practicable. Developer
shall notify prospective owners and tenants of the above requirements.
38. Developer shall complete and submit to the City Engineer a Project Threat Assessment
Form (PTAF) pursuant to City Engineering Standards. Concurrent with the PTAF,
Developer shall also submit the appropriate Tier level Storm Water Compliance form
and appropriate Tier level Storm Water Pollution Prevention Plan (SWPPP) as
determined by the completed PTAF all to the satisfaction of the City Engineer.

39. This project is subject to 'Priority Development Project' requirements. Developer shall
prepare and process a Storm Water Management Plan (SWMP), subject to City Engineer
approval, to demonstrate how this project meets new/current storm water treatment
requirements per the City's Standard Urban Storm Water Management Plan (SUSMP),
latest version. In addition to new treatment control BMP selection criteria in the
SUSMP, the Developer shall use low impact development (site design) approaches to
ensure that runoff from impervious areas (roofs, pavement, etc) are drained through
landscaped (pervious) areas prior to discharge. Developer shall pay all applicable
SWMP plan review and inspection fees per the City's latest fee schedule.
40. Developer acknowledges upcoming hydromodification (runoff reduction) requirements
may impact how this project treats and/or retains storm runoff. Hydromodification
involves detailed site design and analysis to reduce the amount of post-development
run-off by mimicking the natural hydrologic function of the site, preserving natural
open-spaces and natural drainage channels, minimizing use of new impervious surfaces,
and promoting onsite infiltration and evaporation of run-off. During final design,
Developer shall demonstrate compliance with storm water requirements to the
satisfaction of the City Engineer.
41. Developer shall incorporate measures with this project to comply with Standard
Stormwater Requirements per the City's Standard Urban Stormwater Management Plan
(SUSMP). These measures include, but are not limited to: 1) reducing the use of new
impervious surfaces (paving), 2) designing drainage from impervious surfaces to
discharge over pervious areas (e.g.: turf, landscape areas), 3) and designing trash
enclosures to avoid contact with storm runoff, all to the satisfaction of the City
Engineer.
Re-number the remaining conditions of ORB Resolution 319.

Dear Mr. Patel, A couple of the project entitlements (Site Development Plan 05-04 and Coastal Development Permit 05-
14) for the DKN hotel project in Carlsbad are set to expire on August 8, 2014. Please see the conditions of
approvai(Condition 8 attached) require the issuance of a building permit prior to August 8, 2014 to vest the
project. Seeing that the project is still in the building plan check phase and will likely not receive building permits before
August 8'h, it will be necessary to apply for the extensions of the Planning entitlements to keep the permits active. The
Redevelopment Permit and related Coastal Development permits (for the portion of the project in the Village) are valid
until January 8, 2015.
Please find attached all application form for the request to extend the permits. The application should also include a ·
letter stating the reason for the requested permit extension, just as in the past permit extensions. The application shall
be received prior to the expiration date to ensure the permits remain valid.

Thank you for applying for land Use Permits in the City of Carlsbad. The Planning Division has reviewed your
request for the extension of the permits for the construction of a 3-story, 104-room hotel project on property
located at 3136 Carlsbad Boulevard, applications no. SDP05-04x2 and COP 05-14x2, as to its completeness for
processing.
The application is incomplete, as submitted. Attached are two lists. The first list is information which must be
submitted to complete your application. The second list is project issues of concern to staff. In order to
expedite the processing of your application, the "incomplete" items and your response to the project issues
of concern to Staff must be submitted directly to your staff planner; therefore, please contact your staff
planner directly to schedule a re-submittal appointment. As part of your re-submittal package, please
prepare and include with your re-submittal: (1) a copy of these lists, (2) a detailed letter summarizing how all
identified incomplete items and/or project issues have been addressed; and (3} five (5) sets of revised plans.
No processing of your application can occur until the application is determined to be complete.
When all required materials are submitted, the City has 30 days to make a determination of completeness. If

TO COMPLETE THE APPLICATION
Planning:
As you are aware, the project falls within and outside of the Village Review area. As such, the project has
multiple approving bodies for the respective review areas. The applications submitted (SOP 05-04x2/CDP 05-
14x2) are applicable to the area outside the Village Review area. The area within the Village Review area will
require an application for the extension of the RP 05-03/COP 05-14 as it is approved by the Housing and
Redevelopment Commission separate from the area outside the Village Review area which is approved by
the Planning Commission.
The permit fee for the extension of RP 05-03x1 is $685.00. Please remit a check payable to the City of
Carlsbad in this amount.
ISSUES OF CONCERN
Engineering:
1. Since the project is now subject to storm water pollutant mitigation requirements that did not exist
when the project was originally approved by the City in May 2007, provide a site plan locating all the
treatment BMP's sized per Section 4 of the City Standard Urban Storm Water Management Plan
(SUSMP). Two common treatment best management practices (BMP's), flow-through planters and
bioretention facilities, may be sized by using a sizing factor of 0.04 times the contributory (DMA)
area times the runoff factor (Table 4-2). Opportunities to integrate Low Impact Design (LID) features,
such as pervious pavement and vegetated roofs, also appear to exist.
In addition, the project is subject to Hydromodification Management Plan (HMP) requirements
unless exempt per Section 2, Figure 2-1 of the City's Standard Urban Storm Water Management Plan
(SUSMP). An analysis will need to be included in the required Storm Water Management Plan
(SWMP) to justify any listed exemption. Since the project ultimately drains to an exempt receiving
water (Pacific Ocean) and appears to do so through a hardened conveyance system, consider
evaluating an exemption under Node 7 and 8 of Figure 2-1.
If, however, no exemptions apply, rather than use the San Diego County BMP sizing calculator or
continuous simulation hydrology model at this time to size your BMP facilities, you may use Tables 7-
1 through 7-5 of the County of San Diego Hydromodification Management Plan as a guide to roughly
determine treatment BMP sizing and hydromodification volume sizing. Use a flow threshold of
0.1Q2, soil group B, flat slope, and Oceanside rain gauge.

As applicant for the DKN Hotels site development plan, coastal development permit and major
redevelopment permit approved on August 7, 2008, we hereby request the City of Carlsbad to
approve an additional 2-year extension on the above-referenced entitlement and associated
permits, in accordance with the allowances of Title 21 of the Carlsbad Municipal Code.
As you know, the economic circumstances are difficult at this time and the credit markets are
tight. We continue to proceed with preparation of the final engineering plans and anticipate that
with the additional time allowed, we will be able to secure the necessary construction loan to
proceed with the project.
We look forward to working with the City of Carlsbad to eventual construction and operation of
this project.

Redevelopment Commission Resolution 491 (please see attached). Because of the time it takes to
secure a building permit, as no grading, improvement, or building plans have been submitted to date,
the issuance of a building permit by August ih, 2012 is not possible to vest the project. In order to
preserve your project entitlements, it is necessary that you apply for a time extension of the above
mentioned permits, which should be applied for no sooner than 90 days prior to the August 7, 2012
expiration.

With regard to the specific items identified in the April 29 letter, the following is a specific
response to each item/issue identified by City Staff, in the order presented in your draft letter.
Items to make application complete
Engineering:
1. Please submit a Storm Water Standards Questionnaire. A current copy of the questionnaire (E-_
34) can be found at www.carlsbad.gov/development-forms.
Response: The requested Storm Water Standards Questionnaire is included with
this resubmittal package.
2. An updated and revised Storm Water Management Plan will be required prior to approval of any
final engineering applications or plans. It should show how the project design incorporates Low
Impact Development (LID) practices. Low Impact Development (LID) Design should reference
the current County of San Diego Low Impact Development Handbook (Stormwater Management
Strategies). The design shall help preserve and restore the natural hydrologic cycle of the site by
allowing filtration and infiltration of urban run-off using LID BMPs including but not limited to
vegetated swale/strips, rain gardens, and porous pavement, which can greatly reduce the volume,
peak flow rate, and velocity and pollutants.

Please consider the use of permeable pavements and alternatives to the drainage pattern of the
parking areas. Revising the drainage areas of the parking areas could result in more runoff being
directed to LID BMPs sooner than currently shown.
Response: This comment is acknowledged by the applicant. Incorporation of LID
BMPs into the project design will be addressed in the final engineering for the project.
3. Effective March 25, 2010, Carlsbad adopted a new Standard Urban Stormwater Management
Plan (SUSMP). Among other things, the new SUSMP affects how you select and size water
quality treatment devices which will impact the design layout of this project. As a resource, you
may review the new Carlsbad SUSMP at the City's website.
Response: This comment is acknowledged by the applicant. Selection and size of
water quality treatment devices for the project will be addressed in the final engineering
design for the project.
Items of Concern
Housing & Redevelopment:
1. The plans submitted do not conform to the approved plans. Revisions to the plans need to be made
to reflect the original approved plans. If modifications are being requested, please· identify the
nature and purpose of the request. The pool has been moved 10 feet closer to the south property
line (3 feet from property line) and the spa is not enclosed. The property owner to the south raised
concerns about noise from the pool area during the initial review process. This is an issue that
will need to be addressed going forward.
Response: The original set of plans submitted with this time extension application
was inadvertently not the correct set. Four (4) copies of the correct, approved set are
included with this submittal. No modifications are being requested at this time.
2. Parking spaces16s on the upper and lower level of parking are required to have a 2.5 foot clearance
if located next to a solid wall. Please show this clearance.
Response: The approved set of plans is included with this resubmittal package. No
modifications are proposed to the approved set of plans.
3. Half-timbering, stonework and two windows have been removed from Elevation C. Please include
this architectural detailing.
Response: The approved set of plans is included with this resubmittal.
4. Half-timbering has been removed from Elevations F and G. Please include the half-timbering as it
was shown on the approved plans.

To address post-development pollutants that may be generated from development projects, the City requires that new
development and signifiCant redevelopment priority projects incorporate Permanent Storm Water Best Management
Practices (BMP's} into the project design per the City's Standard Urban Stormwater Management Plan (SUSMP}.
Initially this questionnaire must be completed by the applicant in advance of submitting for a development application
(subdivision, discretionary permits and/or construction permits}. The results of the questionnaire determine the level of
storm water standards that must be applied to a proposed development or redevelopment project. Depending on the
outcome, your project will either be subject to 'Standard Stormwater Requirements' or be subject additional criteria
called 'Priority Development Project Requirements'. Many aspects of project site design are dependent upon the
storm water standards applied to a project.
Applicant responses to the questionnaire represent an initial assessment of the proposed project {X)nditions and
impacts. City staff has responsibility for making the final assessment after submission of the development application.
If staff determines that the questionnaire was incorrectly filled out and is subject to more stringent storm water
standards than initially assessed by the applicant, this will result in the return of the development application as
incomplete. In this case, please make the changes to the questionnaire and resubmit to the City.
If applicants are unsure about the meaning of a question or need help in determining how to respond to one or more of
the questions, they are advised to seek assistance from Land Development Engineering staff.
A separate completed and signed questionnaire must be submitted for each new development application submission.

Thank you for applying for an extension for Land Use Permits in the City of Carlsbad. The
Housing and Redevelopment Department, together with other appropriate City departments,
has reviewed the above-mentioned applications as to their completeness for further processing.
The application is incomplete, as submitted. The attached list includes information that
must be submitted to complete your application. This list of items must be submitted
directly to the Housing & Redevelopment Office. All list items must be submitted
simultaneously and a copy of this list must be included with your submittal. No
processing of your application can occur until the application is determined to be complete.
When all required materials are submitted to the Redevelopment Office, the City has an
additional thirty (30) days to make a determination of completeness. If the application is
determined to be complete, processing for a decision on the application will be initiated.

LIST OF ITEMS NEEDED
TO COMPLETE THE APPLICATION

Engineering:
The Engineering Department has .completed their review of the subject project for application
completeness. The applications and plans submitted for this project are incomplete at this time.
Please resubmit 4 sets of plans addressing the following incomplete items:
1. Please submit a Storm Water Standards Questionnaire. A current copy of the questionnaire
(E-34) can be found at www.carlsbad.gov/development-forms.
2. An updated and revised Storm Water Management Plan will be required prior to approval of
any final engineering applications or plans. It should show how the project design
incorporates Low Impact Development (LID) practices. Low Impact Development (LID)
Design should reference the current County of San Diego Low Impact Development
Handbook (Stormwater Management Strategies). The design shall help preserve and
restore the natural hydrologic cycle of the site by allowing filtration and infiltration of urban
run-off using LID BMPs including but not limited to vegetated swale/strips, rain gardens, and
porous pavement, which can greatly reduce the volume, peak flow rate, and velocity and
pollutants.
Please consider the use of permeable pavements and alternatives to the drainage pattern
of the parking areas. Revising the drainage areas of the parking areas could result in more
runoff being directed to LID BMPs sooner than currently shown.
3. Effective March 25, 201 0, Carlsbad adopted a new Standard Urban Stormwater
Management Plan (SUSMP). Among other things, the new SUSMP affects how you
select and size water quality treatment devices which will impact the design layout of this
project. As a resource, you may review the new Carlsbad SUSMP at the City's website.
ISSUES OF CONCERN
Staff has completed a review of the subject project for issues of concern. The following items
need to be resolved or adequately addressed prior to staff making a final determination on the
proposed project: (Please note, the issues are listed under the department which identified
them as an area of concern.)
Housing & Redevelopment:
1 . The plans submitted do not conform to the approved plans. Revisions to the plans need to
be made to reflect the original approved plans. If modifications are being requested, please
identify the nature and purpose of the request. The pool has been moved 1 0 feet closer to
the south property line (3 feet from property line) and the spa is not enclosed. The property
owner to the south raised concerns about noise from the pool area during the initial review
process. This is an issue that will need to be addressed going forward.
2. Parking spaces 16s on the upper and lower level of parking are required to have a 2.5 foot
clearance if located next to a solid wall. Please show this clearance.
3. Half-timbering, stonework and two windows have been removed from Elevation C. Please
include this architectural detailing.

TO THE DIRECTOR OF PLANNING,
I AM WRITING THIS LETTER TO REQUEST THAT THE CITY OF CARLSBAD GRANT DKN HOTELS AN EXTENSION OF THE
COASTAL DEVELOPMENT PERMIT DKN HOTEL-COP 05-14.
WE HAVE BEEN STRIVING AHEAD WITH COMPLETING THE PLAN CHECK PROCESS FROM THE ISSUANCE OF PERMITS
VIA THE CITY AND COASTAL COMMISSION. HOWEVER, WE HAVE FACED CERTAIN SETBACKS WITH THE COMPLEXITY
OF THIS PROJECT WITH ISSUES SUCH AS THE SUBTERRANEAN PARKING GARAGE, TIGHT PROPERTY LINES LEADING
TO SHORING ISSUES AND MISCELLANEOUS ADA ISSUES.
THEREFORE, WITHIN THE EXTENSION PERIOD THAT WE ARE ASKING THE CITY TO GRANT WE WILL BE ABLE TO
COMPLETE AND RECEIVE APPROVAL FOR THE DRAWINGS FROM THE CITY AND FRANCHISE. ADDITIONALLY, AS YOU
ARE MORE THAN AWARE THE ECONOMIC SITUATION THE COUNTRY IS FACING IS MAKING ATTAINING LOANS CLOSE
TO IMPOSSIBLE AT THIS TIME. WITH THE ADDITIONAL TIME WE HOPE CREDIT MARKETS WILL CHANGE AND WE WILL
BE ABLE TO SECURE A CONSTRUCTION LOAN TO PROCEED WITH THE PROJECT.
DKN LOOKS FORWARD TO WORKING WITH THE CITY OF CARLSBAD TAKING THIS PROJECT FROM THE DRAWINGS
TO FRUITION WHILST BUILDING A LASTING PARTNERSHIP.
