HomeMy WebLinkAboutHDP 97-01; Cohen Residence; Hillside Development Permit (HDP)January 20, 1997 Jeff Hunter 6840 Draper Ave La Jolla CA 92037 SUBJECT: HDP 97-01 - COHEN RESIDENCE The City has completed a review of the application for a Hillside Development Permit for grading to create a 300 square foot pad on an intermediate slope between two existing retaining walls on property located at 1604 Starling Ct. in the City of Carlsbad. It is the Planning Director's determination that the project is consistent 'with the City's Hillside Development Ordinance, Chapter 21.95 of the Carlsbad Municipal Code and therefore SfVROVEethis request based on the following: Findinas: 1. 2. 3. 4. 5. 6. Hillside conditions have been properly identified on the constraints map which show existing and proposed conditions and slope percentages. Undevelopable areas of the project, i.e. slopes over 40%, have been properly identified on the constraints map. The development proposal is consistent with the intent, purpose and requirements of the Hillside Ordinance, Chapter 21.95. The proposed grading and development will not occur in the undevelopable portions of the site. The area was previously disturbed by authorized grading (DWG 286-9A). Areas in which topographic change is less than fifteen feet in height and less than four thousand square feet in area, which are not a part of the surrounding generalized slope have been identified as required by the Hillside Development Ordinance, Chapter 21.95.090 of the Zoning Ordinance. The pad will be built over a 7 foot high slope area with a manufactured slope grade of 35%. This development is exempt from the requirements for a coastal development permit. Conditions: 1. Approval is granted for HDP 97-01 as shown on Exhibit "A", dated January 20, 1997, incorporated by reference and on file in the Planning Department. Development shall occur substantially as shown on the approved exhibit. Any proposed grading and/or development substantially different from this approval as determined by the Planning Director, shall require an amendment to this Hillside Development Permit. 2. Building permits are required for the retaining walls.
