After careful review of the proposal, it has been determined that your request to eliminate one sign on the building and reinstate the monument sign located on Palomar Airport Road cannot be supported and therefore, application PS 98-85 has been denied. Monument signs in the P-M zone are only permitted if approved as part of a sign program for the master plan or specific plan. This project was developed under Specific Plan 145 which did not include specific standards for signage, other than those proposed as part of the original site plans. Therefore, the City’s Sign Ordinance serves to regulate signage for the property. Our records indicate that in order to provide some consistency for signage along Palomar Airport Road, the Planning Department had been applying the sign criteria for Carlsbad Airport Center Specific Plan SP 181 (A) to the subject property. However, even this criteria only permits one monument sign fronting Palomar Airport Road per lot. The Palomar Triad monument sign located at the intersection of Palomar Airport Road and Camino Vida Roble is considered to be facing Palomar Airport Road and serves as the one monument sign for the lot. Our records also indicate that there were permits issued in March 1987 for the second monument sign on Palomar Airport Road. This permit should not have been issued since the sign was not permitted as part of the specific plan and it also established a second monument sign on Palomar Airport Road. However, the sign was permitted to remain since it was the City’s error in issuing the permit. Subsequently, in December 1991, an amendment to the sign program (PS 91-I 04) was requested. This amendment request increased the number of permitted wall signs from four to five and also eliminated the use of the second monument sign. The denial of this request is not appealable. In order to proceed further with this request, you would need to submit an application for an amendment to Specific Plan 145 and include comprehensive signage criteria for the entire specific plan area. However, please be advised that based on other sign programs in the vicinity, it is doubtful that staff would be supportive of any sign program which would allow more than one monument sign on Palomar Airport Road. The base fee for a Specific Plan Amendment is $1,000 plus deposits in $1,000 increments. The Zoning Ordinance section relating to monument signs and the Specific Plan SP 181 (A) section which discusses monument signs on Palomar Airport Road are attached for your review. (a) In addition to signs permitted by this chapter, service stations shall have one sign advertising the price of gasoline or other motor fuel sold on the premises which meets the follow- ing requirements: (1) The sign shah display only the minimum information required by Chapter 8.49 of this code and by Article 12 of Chapter 14 ofDivision 5 of the State Business and Professions Code com- mencing with Section 13530. (2) The price sign shall either be a monument typesign or be attached to an existing pole sign located on the property. The sign may be double- faced and the maximum area for each sign shall not exceed twelve square feet if attached to an existing pole sign or sixteen square feet for a monument sign measured at the outermost boundary of the sign face. A monument sign not to exceed forty-eight square feet in area with a height not to exceed six feet shall be permitted if it is used to identify the service station as well as provide pricing information and no other free- standing signs are located on the property.- (A) No monument sign shall be permitted within ten feet of the face of the curb of the street. (B) For comer lots no sign over thirty inches in height shall be permitted in the triangular area created by the intersection of the two property lines along the street and two points twenty-five feet behind each back of curb return. (C) Monument signs shall be located so as not to impede vehicular site distance to the satisfac- tion of the city engineer. (b) If a service station is located at the inter- section of two streets, excluding freeway on or off ramps, such a station may have one price sign, not to exceed the maximum size, stated above, on each street frontage. Stations located adjacent to a freeway on/off ramp shah be permitted only one sign to the street frontage. (a) In addition to all other signs permitted by this chapter, property within the boundaries of a planned community, specific plan or planned unit development may have a sign program that provides for entrance, exit, directional and com- munity identity signs; provided, the sign pro- gram is approved as part of either the master plan for the planned community, specific plan, planned unit development or any amendments thereto. Planned industrial or offrice parks that are not subject to community plans, specific plans or planned unit development may quaI@ for community identity signs by conditional use permit if the site is over twenty-five acres in area. The aggregate sign area of all signs in a commu- nity identity sign program for any one develop ment shall not exceed a total of one hundred square feet, plus three square feet per acre of property within the development. No individual sign in such program shah have an area greater than one hundred fifty square feet, or exceed fifteen feet in height. Amendments to an approved community identity sign program may be granted by the planning commission if it is determined such amendments are consistent with the overall objectives of the plan. (b) Subject to the provisions of Chapter 2 1.50 and this section, additional freestanding signs are permitted in the C-2 zone by conditional use permit. If such signs are approved as a part of a master plan in a planned community, specific plan or planned unit development, a conditional * use permit is not required. Additional freestand- ing signs shah not be approved pursuant to this section unless it is found that the signs are appro- priate for the use of the property, compatible with the design of the development, compatible with the adjacent properties, will not interfere with the safety of the traveling public, will not result in a proliferation of signs in the area will not adversely affect the appearance of the area and will not unduly restrict any views.
