Development shall meet all requirements of the-subdivision, zoning
and building codes, laws, ordinances or regulations of the City of
Carlsbad, and other governmental agencies. Some of the more pertinent
requirements and procedures of the City are listed below for your in-
formation and concurrence. -Please read this list carefully and feel
free to ask for further information or explanation.
1) All conditions for Conditional Use Permit, Variance, Planned
Unit Development and Special Use Permit shall be completed and
the project commenced within 18 months from final City action,
unless otherwise stated as part of the approval. There is no
time limitations for Specific Plans unless required as part
of the approval.
2) Development shall substantially conform to the approved plan.
3) All public improvements shall be made in conformity with City
Standards, to the satisfaction of the City Engineer, without
cost to the City of Carlsbad and free of all liens and
encumbrances.
4) Prior to any construction, the applicant shall submit plans
to the appropriate entity providing domestic water to the
proposed development, for its approval of the location, type
and adequacy of water lines.
5) Prior to any construction, the applicant shall obtain approval
from the City Fire Department of the location and size of
fire hydrants.
6) The applicant shall install all required fire hydrants and
dry-stand pipes prior to framing construction, and said fire
appurtenances shall be functional prior to commencing such work.
7) Street trees, as required by the City, shall be installed by the
applicant at applicant's expense. Trees shall be of a type
approved by the Parks Department and shall be installed to their
specifications. If removal of any existing trees is required
by the City, said removal shall be at the applicant's expense.
It shall be the responsibility of the applicant to make all
arrangements with the Parks Department concerning the require-
ments of this condition.
8) A detailed grading plan which includes proposed drainage
and erosion control landscaping or other measures such as
desilting basins shall be approved by the City Engineer.
9) Immediately after grading, erosion control landscaping and/or
other measures such as desilting basins shall be installed.
This control may be the final landscaping if so approved.
10) A detailed landscape and sprinkler plan shall be submitted
for Planning Director's approval for all graded slopes 5'
or greater in height and any other areas required by law.

PRECISE DEVELOPMENT PLAN/SPECIFIC PLAN

4. Twenty-eight (28) ozalid prints of the plan.

6. Fee for1 Specific Plan: $100.00 + $2.00 per lot or dwelling unit
(whichever is greater). Amendments: $100.00 + $1.00 per affected
dwelling unit. -
^ 7. 300 Foot Radius Map - A map to scale not less than 1" = 200'
showing each lot within 300 feet of the exterior boundaries of
the subject property. Each of these lots shall be consecutively
numbered and correspond with the property owner's list.
8.' Property Owner's List - A typewritten list of the name and address
of all property owners within 300 feet as noted on the property
owner map. This list must be accurate and taken from the latest
equalized assessment roll on file in the office of the Assessor
of San Diego County, 1600 Pacific Highway, Room 103, San Diego,
California (phone (714) 236-3771).
9. Disclosure Statement.
10. A written statement by the City Engineer that he finds there
is adequate sewer capacity available for the proposed use
at the site or that he finds that the proposed use and site
can be adequately served by alternative City approved on-
site sewer system. Applicant, please note, this determination
must be done prior to submitting application and it may
require preparation on your part to provide sufficient evidence
to the City Engineer. It is suggested you make early contact
with the Engineering Department for'such determination.
11. For residential developments only a guarantee is required that
school facilities will be available at time of need. If the
project is located in the San Dieguito High School, Encinitas
Elementary, or San .Marcos Unified School District, the City
will contact the district to arrange the meeting of this require-
ment .
If, however, the project is within the Carlsbad Unified School
District, it is the responsibility of the applicant to make
arrangements for the guarantee of school facilities. This
agreement must be submitted prior to acceptance of application.
B) Drafting of Specific Plan;
1., Sheets to be 24" x 36" with 1" border (Standard "D" size)
2. Scale to indicate: 1" =80" is generally sufficient, however,
the scale is to be appropriate for sheet size; but in no case
smaller than 1" = 100'. If project is too large for recommended
scale, additional sheets will be necessary; and a reduced composit
of the plan be submitted on a 29" x 36" reproducible.
3. North arrow oriented to top or left side of sheet.
4. Lettering must be legible. It is preferred that it be shown by
mechanical means, in ink, and heavy upper case.
5. Location map showing the distance to the center line of the
nearest intersection.
7. Proposed streets to be labeled by alphabetical letters.
8. Grades of all proposed streets.
9. Topographic contours at two-feet intervals, with indication of
manufactured slopes. .
10. Elevation of proposed building pads or sites.
11. Proposed use of the site in general land use terms.
12. Location of proposed structure is optional.
13. Delineation of development phasing.

PROCEDURES
1) Application to Planning Commission: In an effort to aid the
applicant, the Planning Department requests that it be given an
opportunity to evaluate and discuss the'application in its various
stages of development prior to submittal. It is more effective if
applicant meets directly with staff; however, written or telephone
communica,tion is acceptable. It is the responsibility of the
applicant to make the initial contact for such meeting.
2) Submittal; Application will be accepted only if the application,
plans and.other pertinent materials are included.
3) Review: After accepting the application staff will submit it to
the department review board (DCC) to ascertain if further information
is necessary. Staff will attempt to conclude this review within
two weeks, but in no case shall the review period be longer than
30 days from receipt of application.
4) Notice; Upon completion of the application review, the applicant
will be informed by letter if further information is required if
any, or if the application is complete what date it will be heard
by the Planning Commission.
5) Planning Commission Calendar: The Planning Commission adopts an
annual calendar that indicates application closing dates, staff
review dates, a staff recommended review dates as well as Planning
Commission hearing dates. The date your request will be heard is
selected from this calendar. You may acquire this calendar at the
Planning Department.
6) Staff Review; Staff prepares a report for the Planning Commission.
This report is reviewed by the Departmental Coordinating Committee
(DCC), which is made up of representatives from the departments of
Planning, Engineering, Fire, City Manager and other as may be
necessary. You are invited to this meeting to explain the project
and respond to staff recommendations. Upon completion of this
review, staff will prepare final staff recommendations to be sub-
mitted to the Planning Commission. The.final report with rec-
ommendations will be available at the Planning Department five days
prior to the Planning Commission hearing (Friday afternoon prior to
the Planning Commission meeting date).
7) Hearing: The Planning Commission meets every 2nd and 4th Wednesday
of the month at 7:00 P.M., or as indicated on the Planning
Commission calendar. Depending on the type of application, the
Planning Commission will either make a recommendation and forward
to City Council or take final action.
8) Appeals; Final actions by the Planning Commission may be appealed
to the City Council, provided such appeal is filed within ten
(.10) days after the Planning Commission action. The applicant
should review with staff the procedure on the various types of
applications.
9) Final Decision; The City will notify the applicant and property
owner of the final decision.

to avoid possible conflicts of -interest, all applicants are required to
complete this disclosure form at the time of submitting their application.
When this form has been completed and signed, .the information will be relied
upon by them in determining if a conflict may exist, so please ensure that
all of the information is completed and accurate. If at anytime before a
final action on your application has been rendered, any of the information
required by this disclosure changes, an amendment reflecting this change must
be filed.
If the applicant is an individual, or a partnership (either general or limited)
or a joint venture, please state the full name, address and phone number of
each person or individual (including trusts) who own any beneficial interest
in the property which is the subject of this application. Should one or more
parties to the application be a partnership or joint venture, then please
state the full legal name of the partnership or joint venture, its legal
address and the name and address of each individual person who is a general
and/or limited partner or member of the joint venture.
Should one or more of the parties be a privately held corporation (10 share-
holders or less) or a real estate syndication, then please state the state of
incorporation or syndication, corporate number, date.of incorporation or
syndication, corporate or syndicate address, and the full names and addresses of

Subject: Recreational Vehicle Parking - Canon Park Subdivision
This is a follow-up to my verbal presentation to you on Monday, November 27, 1978,
concerning the proposed solution to the location of the 8400 sq.ft. required parking
for recreational vehicles in connection with the Canon Park project.
In simple terms, our proposal is to convert Lot 471 of the Vale 3 subdivision for recre-
ational vehicle parking, with appropriate fencing, landscaping and front set back.
This lot is located next to the SDG&E easement which also abuts the Canon Park project.
We are preparing a proposed site plan for Lot 471 for your review. We assume some type
of Planning Commission and/or City Council action will be required in this situation.
We would request that you not hold up occupancy of any completed houses in the
Canon Park project pending construction of the proposed recreational vehicle park.
It seems to me that you have ample tools to assure the completion of the park since you
can withhold approval of occupancy of the models and of course, could refuse the
issuance of building permits for the rest of the subdivision.
I say this because there has been some indication that a representative of the Planning
Department has said that an occupancy permit would not be issued on the one house for
which escrow has not yet closed. It is my understanding that the Woodward Companies
have no desire at this time to seel the models, since sewer should become available
some time in February of 1979.

Dear Mr. Woodward:
As you are probably aware, the provision of a private recreational
vehicle parking area accompanying your Cannon Park subdivision,
has been a point of contention during the final occupancy approvals
of the latest phase of development. The approved Planned Unit
Development for your project (PUD-7; City Council Resolution
No. 4081, February 1, 1977), requires that a RV storage area be
provided for the use of the property owners who reside within the
PUD. The official exhibit of the PUD identifies the location
of the storage lot as an area on the east side of Cadencia Street,
north of La Costa Avenue.
Apparently some confusion has arisen, since the designated site
is currently developed with residential units, and no alternative
site has been processed through the city. Nonetheless, the
recreational vehicle storage area requirement is a condition of
approval that must be met. We have made the concession of allowing
final occupancy to the current development phase, with the under-
standing that approvals of occupancy of the tract model homes
and building permits for any additional construction of the sub-
division, would be withheld until the RV storage area is completed.
We have met with Fred Morey of the La Costa Land Company and have
received correspondence from him presenting a proposal to convert
Lot 471 of La Costa Vale 3 subdivision for recreational vehicle
parking. This solution to the problem would appear "to be initially
acceptable, however PUD regulation require that off-site RV areas
be approved by City Council. Therefore, an amendment to PUD-7
is required.

I am sending you exerpts of the zone code provision pertaining
to amendments to Planned Unit Developments. As you will note in
this provision, the Planning Commission first considers the
proposed amendment. If they determine the change will be minor
in nature, the amendment may be approved by the Commission with
a resolution, and made part of the original City Council approval.
If the Planning Commission does not determine the amendment to
be minor, then a public hearing will foe required.
Mr. Morey mentioned in his letter that La Costa Land Company is
preparing a site plan of the proposed RV area for Planning
Department review. We would like to begin processing the PUD
amendment promptly, so that conflict does not occur when you wish
to draw building permits on a future phase of Cannon Park sub-
division.
Incidently, we are still withholding occupancy for one unit in
your current development phase, pending completion of some improve-
ments to the open space lots. Your Building Superintendent
assured me the work would be finished shortly. I will final
that unit as soon as we are notified that the work has been
completed. .

We are diligently pursuing the planning for and submission to you of a relocated
recreational vehicle parking facility on Lot 471 or 472 which will, we are quite
sure, meet with your approval.
Scott Woodward of the Woodward Companies called me yesterday, December 21st,
and informed me that a member of the planning department was putting a "hold" on
occupancy on one of the production houses.
Since this is contrary to what I understand to be your concession and our general
agreement, I would appreciate it if you would inform me if there are some problems
of which I am not aware in this matter.

On December 21, 1978, you called me because of your concern that the City was
refusing to approve the occupancy on one of your production houses because of the
recreational vehicle parking situation.
On December 22, 1978, I directed a letter to the City concerning this matter,
copy attached.
In response to my letter, Mr. David Abrams of the City Planning Department called
me today. He reminded me that in a letter to you, dated December 4, 1978, copy
attached, that the City had informed your company that occupancy would be with-
held on one house in your present development phase pending completion of some
improvements to the open space lots. Apparently your company either has not
completed the improvements or has failed to inform the City.
I would think that it would be best if you were to talk directly to Mr. Abrams if
there are further problems.

Dear Art:
Per our discussion several weeks ago, I would like to submit to you
for your review, a preliminary plan for landscaping and RV parking
lot in Lot 472 of La Costa Vale Unit No.3. This 100 foot wide lot
that lies between Cadencia Street and Venado Street is an S.D.G.&E.
Co. easement for overhead structures.
With the development of the Canyon Park project westerly of Cadencia
Street there was a requirement for 8400 square feet of recreational
vehicle parking. La Costa Land Company would like to develope the
westerly portion of Lot 472 into the RV parking area to satisfy the
requirement of the Canyon Park Subdivision. As I understand the pro-
cedure, we cannot develope this facility within your easement without
your permission, or without you granting a license to the entity that
would be responsible for the ownership and maintenance.
We request that you review this preliminary plan, and submit your
comments back to us in writing as to you minimum requirements for
you to be able to grant the license for this proposed project.
I have reviewed this plan with Mr. Bud Plender, the Assistant Planning
Director at the City of Carlsbad. His preliminary review was positive.
The next step, I feel, is to receive your input, then prepare a final
development plan detailing the landscaping which would include a plant
list, providing plans for re-routing the drainage ditch in the central
portion of the lot, and securing the necessary City development permits.
Before we prepare these final plans, we of course, would like your com-
ments .
One method that we had suggested to La Costa to satisfy the requirement
of. the Canyon Park Subdivision, would be to convey the fee title of
Lot 472 to the Homeowners Association of Canyon Park. In turn

then we would request that the S.D.G.&E. Co. issue their license
to the Homeowners Association, for the development of the RV parking
lot. The final determination as to the ownership of the lot and who

In compliance with our compromise agreement, La Costa Land Company
has submitted initial plans for a relocated recreational vehicle
parking facility to service the residents of the Canon Park planned
unit development. The plans need to be refined and expanded to
include a full landscape and irrigation plan, but after an early
review, the proposed site appears acceptable.
The next question to be addressed, is the proper procedure for
incorporating the proposed site into the City Council approved PUD.
The PUD chapter of the Zone Code identifies a procedure for accom-
modating amendments to a planned unit development (Sec. 21.45.160,
attached). Basically, if the amendment is "minor" in nature as
determined by the Planning Commission, the change can be approved
by that body as a resolution and made a part of the original City
Council approval. If the Planning Commission finds the amendment
not minor, it shall set the matter for public hearing.
The proposed location change for the RV storage facility is certain
to be determined a minor amendment if it were presented to the
Planning Commission. In fact, the alteration seems so minor that
it perhaps would not constitute an amendment at all. The proposed
location of the RV parking lot would substantially conform with the
approv ed site, since it is on the same side of Cadencia Street and
only one block north.
The proposed site is within an S.D.G. and E. easement, so approval
for this use is still subject to their approval. Assuming that
approval is obtained, an administrative review and approval of the
proposed RV parking facility by City departments would be more
desirable than presentation at a Planning Commission meeting.

Staff has determined, with the Planning Director's concurrance,
that a proposed change of location for the required RV storage
lot accompanying this PUD, be accommodated administratively
without additional Planning Commission or City Council approval.
The original location was identified off-site, on the east side
of Cadencia Street. The proposed location is at a similar
location off-site, only a block to the north. The storage lot
will be just as easily accessible to the residents of Canon Park
as the original site, and will have at least the minimum required
storage area. In summary, staff considers the proposed RV lot
in substantial conformance with the original approval, and there-
fore the change can be accommodated by a determination of the
Planning Director.
The developer of the project, The Woodward Companies, is aware
that a detailed landscape, irrigation and development plan for
the proposed lot must be submitted and approved by the Planning
Department. Furthermore, since the lot is to be located in an
S.D.G. & E. eastment, evidence of a long-term commitment by the
utility company for the lease or use of the property will be
required.

I have received your request to transfer the R-V storage area
as approved in PUD-7 to a new site within La Costa. 1 have
found that the existing designated R-V sits is part of the
conditions of approval.. Also the PUD regulations require that
off-site R-V areas must be approved by City Council, therefore
an amendment to the PUD-7 is required.
You may request that if the Planning Commission finds '••f-this
amendment is minor in nature, and not requiring full hearings.
I am sending you exerts of this provision. As yo.u will note in
this provision, if the Planning Commission does not find the
change minor, a full public hearing will be required. If you
wish to pursue this method please indicate by letter to the
Planning Commission how the development will guarantee to the
residences of PUD-7 that the required area for R-V storage will
be set aside for the use of the residences of PUD-7.
The location of the site and the design as proposed appears satis-
factory to the planning staff. However, if you make a request,
staff will do a thorough review to insure that the proposed site
will not be detrimental to the area, or if any conditions should

indicated that SDG&E will approve a license agreement for this project. We
are submitting to SDG&E appropriate executed documents. When we receive
a copy of the executed license agreement, we will send you a copy.
Our land company project coordinator, Les Vaughn, will take the necessary
steps toward obtaining a building permit.
La Costa Land Company will actually construct the project, but title to the

In order to ensure the maintenance of a recreational vehicle
storage yard for the residents of the Corona La Costa
Subdivision (PUD-7/CT 76-17), the undersigned hereby agrees
that in the event that the San Diego Gas and Electric Company
terminates the License Agreement (No. 1979-3-1) between the

LICENSE AGREEMENT
THIS AGREEMENT, made this day of
19 , by and between SAN DIEGO GAS & ELECTRIC COMPANY (Licensor),
and (Licensee).
A. Licensee is the owner of the real property
described on Exhibit "A" attached hereto and by reference
made a part hereof.
B. Licensor is the owner of an easement
(Licensor's Easement) as described in Exhibit "B" attached
hereto and by reference made a part hereof.
C. Licensee desires to obtain permission-to
develop
(Licensee's Improvements) upon Licensor's Easement as shown
on Exhibit "B" attached hereto and by reference made a part
hereof.
NOW THEREFORE, the parties agree as follows:
1. Licensor grants to Licensee a revocable
license to develop Licensee's Improvements upon Licensor's
Easement in accordance with Exhibit "B."
2. This License may be terminated in whole or in
part; or altered by Licensor:
A. When required to enable Licensor to enjoy
full use of- Licensor's Easement, including but not limited
to Licensor's right to commence, resume, or increase its use of
the easement for any purpose, pursuant to General Order 69B of
the Public Utilities Commission of the state of California.
B. Should Licensee fail or refuse to comply
with the terms herein, this License shall, at the option of
Licensor, be terminated.
C. Licensor shall give written notice to Licensee
of any termination or alteration, and Licensee shall have thirty
(30) days after receipt of such notice to remove or alter Licensee's
Improvements from Licensor's Easement as directed by Licensor,
to restore the ground and area to as near its original condition
and appearance as possible to Licensor's satisfaction, and to
cease use of Licensee's Improvements. Such removal, restoration
or alteration shall be at the sole cost and expense of Licensee.
If Licensee fails to remove, restore or alter within a reasonable
period of time after notice, Licensor shall have the right to
remove, restore or alter Licensee's Improvements at the sole
expense and risk of Licensee, which expense Licensee agrees to
pay to Licensor upon demand.
D. No termination or cancellation of this License
shall release Licensee from any liability or obligation arising
hereunder.
3. This License is personal to Licensee and shall
terminate upon sale or conveyance of the property by Licensee.
Any assignment or transfer without prior written consent of
Licensor shall terminate this License.
4. This License is subject to all conditions, restrictions,

reservations, exceptions, encumbrances, rights and easements
affecting the above described property, whether or not. of record,
including but not limited to, Licensor's right to construct,
maintain, operate, repair, replace and/or inspect lines of power
poles, underground pipelines, underground conduits, fences and
roads, along with appurtenant structures, in, on, over, under and
accross Licensee's Improvements. Licensor, in exercising its
rights herein, shall not be required to pay Licensee for destruction
or damage to Licensee's Improvements.
5. Licensee agrees to pay all costs for construction,
maintenance, or repair of its improvements under this License.
Licensor shall not be responsible for any repairs or maintenance
on Licensee's Improvements.
6. Licensee agrees to comply promptly with all requests
of Licensor for the reasonable protection of improvements of
Licensor located on Licensor's Easement. In addition, Licensee
shall regulate and control the entry and activities of its invitees
in and upon Licensor's Easement.
7. Licensor and Licensee shall comply with all laws
and/or regulations of local, state, and federal governments and
their agencies which exercise jurisdiction over Licensor's Easement.
8. Licensee acknowledges that there are or may be
high voltage lines, towers, poles, underground electric conduits
or gas pipelines on or near Licensor's Easement, and in part
consideration for Licensor granting this License, assumes all
risks, including risks of an extra hazardous nature, of loss,
damage, or- injury to persons or property in any manner arising

out of or incident to the performance of this License, including
without limitation all consequential damages, whether or not
resulting from the negligence of Licensor, its agents or employees,
and does hereby waive and release Licensor from any and all
liability of whatever nature to any person or property arising
out of or incident to the performance of this License. Licensee
agrees to indemnify, hold harmless, and defend Licensor from all
liability from loss, damage, or injury to persons or property in
/
any manner arising out of or incident to the performance of this
License, including without limitation all consequential damages,
whether or not resulting from the negligence of Licensor, its
agents or employees.
9. Licensee shall obtain and maintain during the life
of this License, comprehensive bodily injury and property damage
liability insurance, including contractual liability, with limits
of not less than $250,000 for bodily injury or death sustained by
any one person; $500,000 for bodily injury or death sustained by
two or more persons; and $250,000 for property damage arising out
of any one or more occurrences. Such insurance shall be with
companies and in a form satisfactory to Licensor, with Licensor .
named as an additional insured, and shall provide that Licensor
be given thirty (30) days prior written notice of any change in
or cancellation of policy. A certificate of insurance shall be
filed with Licensor prior to installation and use of Licensee's
Improvements.
10. Licensee covenants not to commit or permit any
waste, nuisance or damage on Licensor's Easement; to keep Licensee's

Improvements free from weeds, bru-n, and any accumulation of
flammable material and growth; not to construct or allow to be
constructed any sign, signboards, or any outdoor advertising on
Licensor's Easement; and not to reside or allow any residence,
temporary or otherwise, on Licensor's Easement.
11. Licensee acknowledges Licensor's Easement rights
and agrees never to contest Licensor's interest therein by reason
of its use as provided in this License.
12. In the event'that either party commences legal
action against the other by reason of an alleged breach of this
agreement, the prevailing party shall be entitled to recover
court costs and attorney fees as set by the court including those
of appeal. "Prevailing Party" means the party in whose favor
final judgment is rendered.
13. All notices required in this.agreement shall be
deemed given when made in writing and deposited in the United
States mail, certified and postage pre-paid, addressed as follows:

I) BACKGROUND
Location and Description of Property
The subject property consists of an approximately 15,000
ft. parcel, located within a San Diego Gas & Electric
easement on the east side of Cadencia Street, north of La
Costa Boulevard. The site has not been graded and is covered
with low-lying native vegetation. The major portion of the
site is relatively level, while the easternmost portion
rises steeply. Approximately 600 cubic yards of balanced
cut and fill grading is proposed.

General Plan Information
A) Land Use
The City's current land use plan designates the subject
property for low-medium density residential development.
Since the parcel is within a transmission easement, it is
not developable as a residential project. Since the proposed
recreational vehicle storage area is required by the PUD
regulations, which is considered an accessory residential
use, the project is consistent with this land use designation
B) Public Facilities
Due to the nature of the project, there would be a negligible
affect on most public facilities. However, any on-site or
adjacent public facilities could be required as per the
City's Public Improvement Ordinance or as conditions of
approval .
C) Other Elements of the General Plan
The project is consistent with all other elements of the
City's General Plan.
E n v i r o n mental Impact Information
An Environmental Impact Assessment (No. 556) has been processed
and a negative declaration issued for the project based on
the justification that:
1) The subject property is devoid of any significant flora
or fauna, or any unique environmental or historical
resources.
2) The City's grading controls will adequately provide
measures to mitigate potential adverse grading impacts
to the contiguous area.
3) Landscaping will be installed around the site and on
the slopes in order to lessen the project's visual
impact and reduce erosion potential.
History and Related Cases
SP-38/CT 72-20: (Resolution No. 3128 and 3129, June 5,
1973)
The City Council approved a specific plan and tentative map
for 269 residential lots located on the north side of La
Costa Avenue, west of Rancho Santa Fe Road. This included
the subject property, which was designated as a San Diego
Gas & Electric easement. The current proposal (SP-38(B) is
necessary in order to develop this portion of the easement
into an R-V storage area.
PUD-7/CT 76-177SP-38-A: (Resolution No. 4081, 2/1/77; No.
4080, 2/1/77; No. 5000, 3/1/77).
The City Council approved a specific plan amendment (SP-
38(A) which removed approximately 48 acres (209 lots) on the
north side of La Costa Avenue and east of Cadencia Street
from SP-38. This area was developed as a planned unit development
under PUD-7/CT 76-17. A condition of approval of PUD-7/CT
76-17 was that an RV storage yard be provided solely for the
use of the residents in the subject development. Although
the plans for PUD-7 designate an off-site storage area, it
is located south of the current proposal. Thus, application
must also supply for an amendment to PUD-7.

11. Major Planning Considerations
1) Does the proposed RV storage area meet the requirements
of the City's PUD Ordinance?
2) Has the storage area been adequately designed to meet
parking and circulation concerns?
3) Does the project interfere with any existing or proposed
pedestrian or equestrian trails?
4) Does the fact that the storage area is proposed within
a transmission easement reduce its potential utility?
5) Should any conditions be imposed on the project to
enhance its viability and reduce its visual impact?
DISCUSSION
In order to meet the requirement of the PUD ordinance, the
applicant must provide 40 square feet of recreational vehicle
storage per dwelling unit. In addition, Condition No. 18 of
PUD-7 (Corona La Costa) requires that RV storage be provided
for the residents of this PUD, and that it be maintained by
the La Costa Land Company.
In order to comply with these conditions, the applicant has
proposed an 8400 square foot RV storage area. The storage
area is to be located off-site of PUD-7, on the east side of
Cadencia Street. A total of three 15'x35' spaces, and nine
Il'x25' spaces would be provided. Based on the PUD require-
ments, the proposed storage area would adequately serve the
209 dwelling units of the Corona La Costa subdivision.
The originally approved plans for PUD-7 show a similar
storage area located further to the south, but also off-site
and on the east side of Cadencia Street. Although the
proposed location change is relatively minor as far as
distance is concerned, the fact that the new location would
be within a transmission easement raises a major concern.
Specifically, in order to proceed with the project, the
Corona La Costa Homeowners Association has entered into a
revocable lease agreement with SDG&E. This agreement stipulates
that the lease may be cancelled at any time and the Homeowners
Association shall have 30 days within which to clear and/or
modify the site and improvements. Although there is no
assurance that the applicant will be able to maintain this
site as a storage facility in perpetuity, staff is reasonably
assured that the lease will not be cancelled since this is
the standard lease granted by SDG&E, and it has been used
for other developments within transmission easements.

However, in order to ensure that RV storage area will be
available to serve the subdivision in the event that the
lease is cancelled, staff has included Condition No. 7.
This condition stipulates that the applicant shall enter
into a secured agreement with the City which guarantees
that in the event that the lease is terminated, an alternative
storage area will be provided.
Since the original design of this storage area, the City
Council approved a zone code amendment which allows RV
storage yards by CUP, subject to a number of requirements.
These requirements include, among other things, special
fencing and landscaping requirements. Although the subject
storage yard does not require a CUP, staff feels that it is
desirable to apply some of these requirements.
Therefore, in order to reduce the overall visual impact of
the project on adjacent residential development (the lots
bordering the site to the north and south will be developed
with single family dwellings), staff has included special
screening conditions. First, the applicant is required to
increase the height of the fence along the perimeter of the
site to 8 feet. Also, staff has required that the applicant
provide a two foot landscape strip along the southern property
line. This can be accomplished by reducing the width of the
interior driveway from 40 feet to 38 feet. This additional
landscape strip will serve to further reduce the visual
impact of the project.
There is an existing improved pedestrian/equestrian trial
within the SDS&E easement directly across from the site, on
the west side of Cadencia Street. Due to the relatively
steep topograhpy of the site, it is doubtful that the trail
will be extended through the subject property. However,
there is an undeveloped area between the northern edge of
the proposed storage area and the northern property line,
which would permit the extension of this trail system if it
is determined to be desirable.
Staff believes that the proposed storage area is adequately
designed, and that its off-site location will not hinder its
u t i1i ty.
RECOMMENDATION
Staff recommends that the Planning Commission APPROVE
SP-38(B)/ PUD-7(A) based on the following findings and
subject to the following conditions:
Findings
1) The proposed amendments do not substantially alter the
originally approved PUD and Specific Plan since the RV
storage area was originally approved in the same general
location and adequate storage area will be provided.

2) The San Diego Gas & Electric Company has found the
proposed storage area to be an acceptable use within
their transmission easement and has granted a lease for
the use of the property as proposed.
3) The overall design and location of the storage area
provides for adequate circulation and sufficiently
meets the storage requirements of Section 21.45.120(6),
for planned unit developments.
4) Conditions have been included which serve to reduce the
overall visual impact of the proposed development.
5) An Environmental Impact Assessment (No. 556) has been
processed and a negative declaration issued for the
project based on the justification that:
a) The subject property is devoid of any significant
flora or fauna, or any unique environmental or
historical resources.
b) The City's grading controls will adequately provide
measures to mitigate potential adverse grading
impacts to the contiguous area.
c) Landscaping will be installed around the site and
on the slopes in order to lessen the project's
visual impact and reduce erosion potential.
Conditions
T]Development shall occur substantially as indicated on
Exhibits A and B dated 9/5/79, on file in the Planning
Department, except for modifications required herein.
2) The applicant shall agree to modify the proposed
landscape plans as follows: 15 Acacia Longifolia
planted on 8 ft. centers shall be substituted for the
Acacia Pycantha; one gal Trachelospermum Jasminoides
planted on 18 in. centers shall be substituted for
Grendelia Stricta.
3) The applicant shall agree to provide a two foot landscape
strip along the southern edge of the property, between
the property line and the proposed fence. Said landscape
strip shall be planted with the Acacia Longifolia as
previously specified in Condition No. 2. Revised plans
showing the proposed change shall be subject to the
approval of the Planning Director prior to construction.
4) The applicant shall agree to install an eight foot high
wall or fence around the entire perimeter of the storage
area. Said fence shall be constructed so as to totally
screen views of the storage area.
5) The RV storage area shall be limited solely for the use
and convenience of the residents of Corona La Costa
(PUD-7).

6) The maintenance, restoration and/or repair of any
recreational vehicle shall not be permitted within the
storage area.
7) The applicant shall enter into a secured agreement with
the City of Carlsbad which guarantees that in the event
that the lease for the RV storage area is terminated,
an alternative location equivalent in size and acceptable
to the City shall be provided. This agreement must be
secured prior to the finalizing and subject to the
approval of the Planning Director. In addition, a
proposed alternative site must receive the approval of
the Planning Commission.
