A. In meeting with Mr. Bussey as well as the others named,
the following was discussed:
1. The portion of the land the Broadway is on is not
part of the Precise Plan approved for the property
which is actually to the west. It is zoned C2 and
technically requires no precise plan modification.
2. A portion of the Broadway is however, located on
City of Carlsbad property (parking authority) and
requires approval by the City.
3. The City does not wish to accept any application
for plan check until such time as the above and
other details are ironed out between the City and
the May Stores Shopping Centers, Inc. Mr. Bussey

will contact Mr. Goetz and Mr. Lipp to see if this
can be accomplished. Specifically the City will
need a letter from Mr. Goetz.
4. The writer emphasized the urgency of the Broadway
schedule and the desire of the Broadway to be
underway with foundations no later than the end of
February.
5. Mr. Agatep expressed the desire of the Planning
Department that the Broadway be part of the Precise
Plan modification even though it is not technically
required. This involves the full cycle of reviews,
hearings, approvals, etc.
B. In meeting with Mr. Osburn and/or Mr. Green the following
was determined:
1. Carlsbad Zoning Ordinance limits height to 35'
(from ground level). This could be approved by a
Precise Plan modification or could be processed as
a variance.
2. Broadway must be considered a separate building from
the mall building. This will require a Type I
classification since we cannot get enough area for
a Type II without area increases for side yards.
3. We can exit through the Mall building.
4. Lower level is considered a basement.
5. No change in occupancy required for the restaurant as
long as it is less than 10% of area of that story.
6. We can rate shafts, structure, and so forth at 100
sq. ft. per occupant and should indicate our computa-
tions on the drawings.
7. Once Mr. Bussey is satisfied on the items mentioned
in A. 2. and A.3. and gives approval to accept
application for plan check, Mr. Osburn will accept a
"Foundations Only" application. When we file the
entire project, plan check can be expedited by submitting
four sets - Building Department, Fire Department,
Planning & City Engineer.

8. The City Engineer will be interested in relocation
of existing utilities and this should be cleared
by Site Engineer so as to prevent holdup of our
plan check.

SUBJECT: REQUEST FOR RECLASSIFICATION IN ZONE FROM R-A-10,000
TO C-2 AND ADOPTION OF A SPECIFIC PLAN ON PROPERTY
LOCATED ON THE EAST SIDE OF JEFFERSON STREET, NORTH
OF THE PROPOSED MARRON ROAD

Report submitted by: City Manager, Fire, Engineering, Building,
Parks & Recreation and Planning Departments
General Discussion:
The application represents a request for rezoning from R-A-10,000
to C-2 and Adoption of a Specific Plan on 42.15+ acres located
on the east side of Jefferson Street, north of the proposed
Marron Road.
The proposed 42.15± acres General Commercial zone is scheduled
to be used for the final portion of the Plaza Camino Real Shopping
Center expansion. The proposed expansion is bounded on the
west by the Buena Vista Lagoon, on the east by the existing Plaza
Camino Real, north of the "Hosp Grove" development and south of
the zoning in the area is R-A-10,000 to the west (Buena Vista
Lagoon) and Planned Community (P-C) to the south. Major access
to the subject parcel will be provided by Marron Road from the
east and from the Jefferson Street overpass at Hwy. 78.
A Specific Plan for grading was approved by City Council Ord. 9292
on February 15, 1972. At that time, requirements were established
to provide landscaping programs for all cut and fill slopes,
along Marron Road and along the slopes of the flood control channel
Additional Specific Plans of development were required to be
submitted to the City of Carlsbad as each phase of development
occurs. It is intended that a Specific Plan will also be included
with this application. The Specific Plan will require landscaping
programs, criteria for signing, limitations on access to Marron
Road and Jefferson Street, and the spatial relationships of
proposed structures to those now in existence.
It is recommended that an Environmental Impact Statement be re-
quired as a portion of this Specific Plan approval and that the
guidelines established by the City of Carlsbad be utilized in
preparing the environmental report.

Additionally, a request for General Plan Amendment shall be
submitted to the City of Carlsbad as a condition of approval.
Recommendation:
The staff recommends approval of the subject application for
the following reasons and subject to the following conditions.
Reasons of Approval;
1. The subject proposal is in the best interest of the City
of the City of Carlsbad.
2. The subject reelassification and specific plan will not be
detrimental to surrounding properties.
Conditions of Approval:

SECTION I; RECOMMNDATION
Staff recommends that SP-41(A) be Approved based on the following
findings:
1) The proposed Specific Plan Amendment deleting a portion of the
affected property is consistent with all applicable City Policies
and Ordinances because:
a) The development of the area to be deleted has been superceded
by the approval of a Precise Plan (PP-24) as required by an
agreement between the applicant and the City.
SECTION II: BACKGROUND
The subject property is generally located north of Marron Road and
west of El Camino Real. State Highway No. 78 lies approximately 440'
to the north. The City of Oceanside has jurisdiction over the strip
of land between the northern boundary of the subject property and State
Highway No. 78. Buena Vista Lagoon lies approximately 1000' to the
west of the property. The entire area to be deleted consists of approx-
imately 45 acres.
The site has been rough graded and is relatively flat. A flood control
channel for Buena Vista Creek lies along the northernly boundary of the
site.

SP-41 was approved by the City Council (Ordinance No. 9334) on Nov-
ember 8, 1972 in conjunction with ZC-111(Ordinance No. 9335). The
subject area included land west of the existing Plaza Camino Real,
between Marron Road and the City limits, to Jefferson Street and
Buena Vista Lagoon. The Specific Plan Ordinance requires the sub-
mi ttal of a development plan prior to building and grading. On June
29, 1977, the Planning Commission considered a Precise Plan (PP-24)
covering a portion of the Specific Plan area and recommended approval
to the City Council. If the City Council approves the Precise Plan,
it will effectively supercede the requirements of the Specific Plan
and the applicable area under the Precise Plan should be deleted from
the Specific Plan.
Construction of the existing portion of Plaza Camino Real began in
1968-1969. A Specific Plan (SP-21) was approved in 1972 for grading
and fill between the existing center and Buena Vista Lagoon (Ordinance
#9292) .
A "Public Parking Lot Operating Agreement," approved in 1969 still
exists between the City, the Parking Authority, and the Plaza Camino
Real (Resolution 1667) for the existing parking lot and will not be
affected by this action. The City is currently negotiating with May
Stores for an agreement on the proposed expansion.
Environmental Impact Information
An Environmental Impact Report (EIR-295 and 389) has been certified
for a Precise Plan and tentative map for the same area that is proposed
for deletion. Therefore, no further environment review is required by
reason of prior compliance.
General Plan Information
The Land Use Element designates the site for Intensive Regional Retail
(RRI) which is consistent with the proposed uses.
Public Facilities
Sewer capacity has been reserved for the proposed Plaza expansion.
Other necessary improvements are required as conditions-of-approval
of the Precise Plan and Tentative Map.

SECTION III; DISCUSSION
An existing agreement between the applicant and the City requires
approval of a Precise Plan of Development prior to any construction.
The requirements of the Precise Plan cover everything that was included
in the Specific Plan plus much more. The proposed deletion will have no
effect on the City's ability to adequately review and approve any develop-
ment on the subject property. ,
