Subject: Ordinance No. CS-340 -Amending Carlsbad Municipal Code Chapter 2.04, Section 2.04.010 regarding City Council Compensation Recommended Action Adopt Ordinance No. CS-340 amending Carlsbad Municipal Code Chapter 2.04, Section 2.04.010 regarding City Council Compensation. Executive Summary Ordinance No. CS-340 was introduced and first read at the City Council meeting held on September 18, 2018. On a motion by Council Member Packard, seconded by Council Member C. Schumacher, the City Council voted 5/0 to introduce the Ordinance. The second reading allows the City Council to adopt the ordinance which will become effective thirty days after adoption. Fiscal Analysis There is no anticipated fiscal impact from this item. Next Steps The City Clerk will have the ordinance or a summary of the ordinance published in a newspaper of general circulation within fifteen days following adoption of the ordinance. Environmental Evaluation (CEQA) Pursuant to Public Resources Code section 21065, this action does not constitute a "project" within the meaning of CEQA in that it has no potential to cause either a direct physical change in the environment, or a reasonably foreseeable indirect physical change in the environment, and therefore does not require environmental review. Public Notification This item was noticed in accordance with the Ralph M. Brown Act and was available for public viewing and review at least 72 hours prior to the scheduled meeting date. Exhibits 1. CS-340 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF CARLSBAD, CALIFORNIA, AMENDING CARLSBAD MUNICIPAL CODE CHAPTER 2.04, SECTION 2.04.010 REGARDING CITY COUNCIL COMPENSATION WHEREAS, the voters of the City of Carlsbad at the June 3, 2008 election voted to change the powers and duties of the City of Carlsbad by adopting a City Charter; and WHEREAS, under the California Constitution, the City Council has plenary authority to legislate matters of local concern notwithstanding general laws to the contrary; and WHEREAS, the compensation of the Mayor and City Council is a matter of local concern; and WHEREAS, the City Council of the City of Carlsbad wishes to adopt a standing methodology that will govern future salary adjustments for council members; and WHEREAS, the City Council of the City of Carlsbad wishes to avoid an appearance of a conflict of interest by tying council member salary adjustments to an objective measure not controlled by the city. . NOW, THEREFORE, the City Council of the City of Carlsbad, California, ordains as follows that: 1. The above recitations are true and correct. 2. Carlsbad Municipal Code Chapter2.04, Section 2.04.010 is amended to read as follows: 2.04.10 Compensation. A The compensation of each member of the city council shall be set at $2,052.17 per month upon the effective date of this ordinance. Adjustments to city council compensation shall not exceed the amount established by the San Diego Regional Consumer Price index. Adjustments to city council compensation must be made or permanently waived by ordinance in January of each year. The city council is prohibited from enacting retroactive increases for years in which a salary increase was waived. B. The compensation established by this section is exclusive of any amounts payable to each member of the city council as reimbursement for actual and necessary expenses incurred in the performance of official duties for the city. EFFECTIVE DATE: This ordinance shall be effective thirty days after its adoption; and the City Clerk shall certify the adoption of this ordinance and cause the full text of the ordinance or a summary of the ordinance prepared by the City Attorney to be published at least once in a newspaper of general circulation in the City of Carlsbad within fifteen days after its adoption.
