SUBJECT: PIP 86-5
The City has completed a review of the application for a planned
industrial permit for development located at lot eight of Tract
80-33, Map No. 10061.
It is the Planning Director's determination that the project .
is consistent with the City's Planned Industrial Zone regulations
(Chapter 21.34) and with all other applicable City ordinances and
policies. The Planning Director, therefore, recommends approval
of this request based on the following:

The site indicated by the Planned Industrial Permit
is adequate in size and shape to accommodate the proposed
use, and all yards spaces, walls, fences, parking, loading,
landscaping and other features required by this chapter.
The improvements indicated on the Planned Industrial Permit
are located in such a manner to be related to existing and
proposed streets and highways.
The improvements as shown on the Planned Industrial Permit
are consistent with the intent and purpose of this zone and
all adopted development, design and performance standards as
set forth in this chapter.
The project is consistent with all City public facility
policies and ordinances since:
a) The Planning Commission has, by inclusion of an
appropriate condition to this project, ensured building
permits will not be issued for the project unless the
City Engineer determines that sewer service is
available, and building cannot occur within the project
unless sewer service remains available, and the Planning
Commission is satisfied that the requirements of the
Public Facilities Element of the General Plan have been
met insofar as they apply to sewer service for this
project.

b) school fees will be paid to ensure the availability of
school facilities in the Carlsbad School District.
c) All necessary public improvements have been provided or
will be required as conditions of approval.
d) Assurances have been given that adequate sewer for the
project will be provided by the City of Carlsbad.
5) This project will not cause any significant environmental
impacts and a Negative Declaration has been issued by the
Planning Director on January 24, 1987.
6) The applicant is by condition, required to pay any increase
in public facility fee, or new construction tax, or
development fees, and has agreed to abide by any additional
requirements established by a development management or
public facility program ultimately adopted by the City of
Carlsbad. This will ensure continued availability of public
facilities and will mitigate any cumulative impacts created
by the project.
Conditions:
Approval is granted for PIP 86-5 as shown on Exhibits
"A" - "Dm, dated February 20, 1987, on file in the Planning
Department and incorporated herein by reference.
Development shall occur substantially as shown, unless
otherwise noted in these conditions.
All uses established in this structure shall be
consistent with Section 21.34.020 (Permitted Uses).
All roof appurtenances shall be shielded from view and
architecturally integrated with the building design.
This project is approved upon the express condition that
building permits will not be issued for development of the
subject property unless the City Engineer determines that
sewer facilities are available at the time of application
for such sewer permits and will continue to be available
until time of occupancy.
This project is also approved under the express condition
that the applicant pay the public facilities fee adopted by
the City Council on April 22, 1986 and any development fees
established by the City Council pursuant to Chapter 21.90 of
the Carlsbad Municipal Code or other ordinance adopted to
implement a growth management system or facilities and
improvement plan and to fulfill the subdivider's agreement

to pay the public facilities fee dated November 12, 1986,
and the agreement to pay the Growth Management Fee dated April 24, 1986, copies of which are on file
with the City Clerk and are incorporated by this reference.
If the fees are not paid this application will not be
consistent with the General Plan and approval for this
project shall be void.
6) Approval of this request shall not excuse compliance with
all sections of the Zoning Ordinance and all other
applicable City ordinances in effect at time of building
permit issuance.
7) This approval shall become null and void if building permits
are not issued for this project within one year from the
date of project approval.
8) Water shall be provided to this project pursuant to the
Water Service agreement between the City of Carlsbad and the
Costa Real Water District, dated May 25, 1983.
9) The applicant shall prepare a 24" x 36" reproducible mylar
of the final site plan incorporating the conditions
contained herein. Said site plan shall be submitted to and
approved by the Planning Director prior to the issuance of
building permits.
10) The applicant shall prepare a detailed landscape and irriga-
tion plan which shall be submitted to and approved by the
Planning Director prior to the issuance of grading or
building permits, whichever occurs first.
11) All parking lot trees shall be a minimum of 15 gallons in
size.
12) All landscaped areas shall be maintained in a healthy and
thriving condition, free from weeds, trash, and debris.
13) Any signs proposed for this development shall be designed in
conformance with the City's Sign Ordinance and shall require
review and approval of the Planning Director prior to
installation of such signs.
14) Trash receptacle areas shall be enclosed by a six-foot high
masonry wall with gates pursuant to City standards. Loca-
tion of said receptacles shall be approved by the Planning
Director.

15) ~11 tenant improvements and uses shall be constructed as
per the parking ratios shown on Exhibit "A", dated February
20, 1987, and shall be shown on the applicant's grant deed
as a deed restriction.
Engineerinp:
16) The developer shall comply with all the rules, regulations
and design requirements of the respective sewer and water
agencies regarding services to the project.
17) This project is also approved under the express condition
that the applicant pay the additional public facilities fee
adopted by the City Council on April 22, 1986, and any
development fees established by the City Council pursuant to
Ordinance No. 9791 or subsequent ordinance adopted to
implement a growth or development management system or
public facilities phasing plan to fulfill the subdivider's
agreement to pay the public facilities fee dated November
12, 1986, a copy of which is on file with the City Clerk and
is incorporated by this reference. If the fees are not
paid, this application will not be consistent wth the
General Plan and approval for this project shall be void.
18) The Developer shall pay an interim Traffic Impact Fee to be
collected at the time of building permit issuance per City
of Carlsbad Ordinance No. 8660.
19) The existing street light located at the proposed driveway
is to be relocated at the Developer's expense prior to
occupancy.
20) The proposed driveway shall be located in such a manner so
as to not interfere with the existing storm drain inlet.
