Executive Summary Commissioner Peter Penseyres was appointed to the Traffic & Mobility Commission in November 2017 to fill the unexpired term of Commissioner Poka. Commissioner Penseyres is eligible for reappointment. This term will expire in December 2022 to coincide with the term of the nominating council member, the mayor. The City Clerk’s Office received eight applications from residents wishing to serve on the Traffic & Mobility Commission. In keeping with City Council Policy No. 88, Mayor Hall has recommended the following two residents wishing to serve on the Traffic & Mobility Commission to advance in the process and interview with the full City Council: •Joe Whitaker - District 1 •Peter Penseyres - District 1 (seeking reappointment) Exhibit 2 contains applications for both residents. Discussion The Maddy Act (California Government Code Sections 54970-54974) requires that on or before December 31 of each year the legislative body shall prepare a Local Appointments List that contains the appointive terms of board and commission members which will expire in the next calendar year. The name of the incumbent appointee, the date of appointment and the term expiration date is also included on the list. Based on the prepared list, the City Clerk’s Office accepts applications for any upcoming vacancies. These applications are available on the city’s website and in the City Clerk’s Office. The Carlsbad Municipal Code states that the Traffic & Mobility Commission shall consist of seven members subject to ratification by a majority vote of the City Council. Jan. 19, 2021 Item #10 Page 1 of 7 The current members of the Traffic & Mobility Commission are: Member District Bill Fowler 2 Monica Gocan 1 Chuck Hunter 2 Steve Linke 4 Brandon Perez 2 Allan Wanamaker 1 Members of the Traffic & Mobility Commission are subject to the provisions of the California Political Reform Act, and must file a statement of economic interest. Fiscal Analysis None. Next Steps Following the appointment of one member to the Traffic & Mobility Commission, the City Clerk’s office will update the commission roster, and coordinate the oath of office and the filing of the appointee’s statement of economic interest and ethics training certificate. Environmental Evaluation (CEQA) Pursuant to California Public Resources Code Section 21065, this action does not constitute a “project” within the meaning of CEQA in that it has no potential to cause either a direct physical change in the environment, or a reasonably foreseeable indirect physical change in the environment, and therefore does not require environmental review. Public Notification Public notice of this item was posted in keeping with the Ralph M. Brown Act and it was available for public viewing and review at least 72 hours before the scheduled meeting date. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Carlsbad, California, as follows: 1.The above recitations are true and correct. 2.The following Carlsbad resident is appointed to serve on the Traffic & Mobility Commission, for a term ending in December 2022 to coincide with the term of the nominating council member, the mayor. Peter Penseyres PASSED, APPROVED AND ADOPTED at a Regular Meeting of the City Council of the City of Carlsbad on the 19th day of January, 2021, by the following vote, to wit: AYES: Hall, Blackburn, Acosta, Bhat-Patel, Schumacher.
