Tom Wellman spoke regarding Council Member Schumacher's responses in the media and social media outlets regarding small businesses. Theresa Carpenter spoke regarding Council Member Schumacher's responses in the media and social media outlets. Katie Bringuier spoke regarding Council Member Schumacher's recent behavior and information displayed in media and social media. PUBLIC HEARINGS: 4.CONSIDER ADOPTION OF VEHICULAR LEVEL OF SERVICE EXEMPTIONS UNDER THE GENERAI PLAN MOBILITY ELEMENT POLICY 3-P.9 FOR STREET FACILITIES DECLARED DEFICIENT UNDER THE CITYWIDE FACILITIES AND IMPROVEMENTS PLAN CIRCULATION PERFORMANCE STANDARD 1)Review and consider the Traffic and Mobility Commission's recommendations from Dec. 7, 2020 to exempt the five roadway facilities; and 2)Adoption of Resolution No. 2021-003 exempting street facilities from the Growth Management Plan vehicular Level of Service standard, pursuant to Mobility Element Policy 3- P.9, thereby refocusing planning efforts at these street facilities to transportation demand management strategies to reduce overall trip generation and adoption of CEQA findings. Transportation Director Tom Frank and Traffic & Mobility Commission Chair Mona Gocan presented the report and reviewed a PowerPoint presentation (on file in the Office of the City Clerk). Mayor Hall opened the duly noticed Public Hearing at 3:33 p.m. Hearing no one wishing to speak, Mayor Hall closed the duly noticed Public Hearing at 3:33 p.m. Motion by Mayor Pro Tern Blackburn, seconded by Council Member Bhat-Patel, to approve Resolution No. 2021-003 and Resolution No. 2021-004. Motion carried unanimously, 5/0. DEPARTMENTAL AND CITY MANAGER REPORTS: 5. COVID-19 ACTIONS AND EXPENDITURES REPORT — Receive a report on recent actions and expenditures related to the city's response to the COVID-19 pandemic and provide direction as appropriate. (Staff contact: Geoff Patnoe, City Manager Department) City Manager's Recommendation: Receive the report and provide direction as appropriate. City Manager Scott Chadwick introduced the item. Assistant Director of Emergency Services David Harrison, Deputy City Manager of Community Services Gary Barberio, Police Chief Neil Gallucci, Senior Program Manager Holly Nelson, Fire Chief Michael Calderwood, Chief Innovation Officer David Graham, Community Development Director Jeff Murphy, and Deputy City Manager of Administrative Services Laura Rocha presented the report and reviewed a PowerPoint presentation (on file in the Office of the City Clerk). In response to an inquiry from Council Member Schumacher, Assistant Director of Emergency Services Harrison provided the approximate number of COVID-19 related fatalities in the city. In response to an inquiry from Council Member Schumacher, Chief Gallucci explained that the CDC and the State of California requested that homeless encampment cleanups not occur during the pandemic in an effort to prevent the spread of the virus. In response to an inquiry from Council Member Acosta, Chief Innovation Officer Graham described the collaboration efforts between the Carlsbad Chamber of Commerce, the Village Association, Visit Carlsbad and the City of Carlsbad. Jan. 12, 2021 Carlsbad City Council Regular Meeting Page 4 In response to an inquiry from Council Member Acosta, Deputy City Manager Rocha explained the Coronavirus Aid, Relief, and Economic Security (CARES) Act funding received by the city and that no new additional funds were anticipated to be received by the city at this time. Council received the report. Mayor Hall declared a recess at 4:52 p.m. Mayor Hall reconvened the meeting at 4:59 p.m. 6.REGIONAL COVID-19 VACCINATION COORDINATION — 1) Receive a presentation; and 2) Adoption of Resolution No. 2021-005 empowering the Director of Emergency Services to authorize emergency use of the Biotech and Beyond building as a regional point of distribution for COVID-19 vaccination and testing programs coordinated by emergency services agencies. (Staff contact: Michael Calderwood, Fire and Geoff Patnoe, City Manager Department) City Manager's Recommendation: Receive the presentation and adopt the resolution. Fire Chief Michael Calderwood and Fire Battalion Chief Nathan Pearson presented the report and reviewed a PowerPoint presentation (on file in the Office of the City Clerk). In response to an inquiry from Mayor Hall, Fire Chief Calderwood explained that between 80 to 100 individuals per day are being vaccinated. He also provided information about the super vaccination site at Petco Park in San Diego and added that Carlsbad could be a potential site for a North County effort. In response to an inquiry from Mayor Hall, City Manager Chadwick explained the necessary steps and collaboration efforts needed to establish a Carlsbad vaccination site. Motion by Mayor Pro Tern Blackburn, seconded by Council Member Bhat-Patel, to approve Resolution No. 2021-005. Motion carried unanimously, 5/0. Motion carried unanimously, 5/0. 7.CLEAN ENERGY ALLIANCE POWER SUPPLY PRODUCT OFFERINGS AND INPUT TO THE CITY'S BOARD REPRESENTATIVE — Provide input to the city's Clean Energy Alliance board representative regarding the alliance's power supply product offering. (Staff contact: Jason Haber, City Manager Department) City Manager's Recommendation: Provide staff with input. Intergovernmental Affairs Director Jason Haber and Clean Energy Alliance (CEA) Interim Chief Executive Officer Barbara Boswell presented the report and reviewed a PowerPoint Jan. 12, 2021 Carlsbad City Council Regular Meeting Page 5 presentation (on file in the Office of the City Clerk). The following individual called into the City Council Meeting and voiced their comment for the record: CEA Community Advisory Committee Member Paige DeCino spoke regarding offering carbon- free energy rates for low-income families. In response to an inquiry from Council Member Bhat-Patel, CEA Interim Chief Executive Officer Boswell explained that currently there is not any state funding for waivers or grant programs to assist low-income families. Council Member Bhat-Patel recommended the Green Impact and Clean Impact options in an effort to reach the city's sustainability goals. Mayor Hall expressed his thoughts on the Local Impact option regarding affordability and the importance of reaching out to businesses. In response to an inquiry from Council Member Acosta, CEA Interim Chief Executive Officer Boswell explained that customers who decide to opt out of the Clean Energy Alliance would stay with or go back to San Diego Gas & Electric (SDGE). She also explained that while approximately 10% of customers of Solana Energy Alliance have opted out, 5-7% is typically the average. In response to an inquiry from Mayor Hall, CEA Interim Chief Executive Officer Boswell explained she did not have information on the percentage of business customers that clean energy alliances serve. In response to an inquiry from Mayor Pro Tem Blackburn, CEA Interim Chief Executive Officer Boswell explained if a community selects a higher percentage renewable power supply, individual customers can opt for a lower tier option. Officer Boswell also clarified that the City Council was being asked what they recommend the CEA offer in addition to the 50% renewable energy. She explained that the decision is time sensitive if the CEA board wants to include this at the launch in March 2021 in order to give customers timely notice and that they can offer additional options at a later date. In response to an inquiry from Mayor Hall, CEA Interim Chief Executive Officer Boswell explained that the CEA board can determine what renewable energy power supply mix they deem appropriate so long as it meets the state's minimum requirement. In response to an inquiry from Council Member Acosta, CEA Interim Chief Executive Officer Boswell clarified about the power supply product offering choices. Council Member Acosta provided her thoughts about excluding the Local Impact option as customers can opt-out to SDGE. In response to an inquiry from Mayor Hall, CEA Interim Chief Executive Officer Boswell explained that when the CEA board selects its product offerings, any new CEA member cities Jan. 12, 2021 Carlsbad City Council Regular Meeting Page 6 would be offered these in addition to the 50% minimum renewal requirement set by the CEA Joint Power Agreement. Council Member Schumacher expressed her thoughts on a time certain deadline to have a recovery impact for businesses as well as assisting lower-income residents. In response to an inquiry from Mayor Pro Tern Blackburn, Mayor Hall explained a conversation needs to occur with CEA JPA members and with the Chamber of Commerce. In response to an inquiry from Mayor Pro Tern Blackburn, CEA Interim Chief Executive Officer Boswell explained the 50% renewable option is CEA's default while the Local Impact option is a program that individual customers could participate in based on the criteria the program was developed under and that the CEA board can create additional programs after the launch. In response to an inquiry from Council Member Schumacher, CEA Interim Chief Executive Officer Boswell explained the CEA Board has not taken a position for or against nuclear or non-nuclear energy. Minute Motion by Council Member Acosta, seconded by Mayor Pro Tern Blackburn, recommending the Clean Impact, Solana Energy Alliance product match, Green Impact, and no Local Impact with the ability for customers to opt-out and go back to SDGE if they choose — 3/2 (Hall, Schumacher— No). 8. ADOPTION OF THE CARLSBAD SUSTAINABLE MOBILITY PLAN — Adoption of Resolution No. 2021-006 adopting the Carlsbad Sustainable Mobility Plan. (Staff contact: Nathan Schmidt, Public Works) City Manager's Recommendation: Adopt the resolution. Transportation Planning & Mobility Manager Nathan Schmidt and Traffic & Mobility Commission Chair Mona Gocan presented the report and reviewed a PowerPoint presentation (on file in the Office of the City Clerk). In response to an inquiry to Council Member Bhat-Patel, Transportation Planning & Mobility Manager Schmidt explained that plan updates and opportunities will occur annually for the Traffic & Mobility Commission. He also explained that the high priority projects were ranked through a process with guidance from the stakeholder working group and the Traffic & Mobility Commission. He added that feasibility studies would return to the Traffic & Mobility Commission and the City Council. In response to an inquiry to Council Member Bhat-Patel, City Manager Chadwick explained that safer routes to the school's section of the item text, could be presented to the City Schools Committee. Motion by Mayor Pro Tern Blackburn, seconded by Council Member Bhat-Patel, to approve Resolution No. 2021-006. Motion carried unanimously, 5/0. REORGANIZATION OF THE CITY COUNCIL, ELECTION OF MAYOR PRO TEMPORE, REGIONAL COMMITTEE ASSIGNMENTS AND SUBCOMMITTEE ASSIGNM ENTS — 1) Adoption of Resolution No. 2021-007 appointing one member of the City Council to serve as Mayor Pro Tem pore for a term ending in December 2021, or until a replacement is appointed; and 2)Adoption of Resolution No. 2021-008 appointing members of the City Council to the San Diego Association of Governments Board of Directors; and 3)Adoption of Resolution No. 2021-009 appointing members of the City Council to the San Diego Association of Governments Shoreline Preservation Working Group; and 4)Adoption of Resolution No. 2021-010 appointing members of the City Council to the North County Transit District Board of Directors; and 5)Adoption of Resolution No. 2021-011 confirming the mayoral appointment of a member of the City Council to the San Diego County Water Authority Board of Directors; and 6)Adoption of Resolution No. 2021-012 appointing members of the City Council to the Clean Energy Alliance Joint Powers Authority Board of Directors; and 7)Adoption of Resolution No. 2021-013 confirming the mayoral appointments of members of the City Council to the various regional committee assignments; and 8)Adoption of Resolution No. 2021-014 confirming the mayoral appointments of members of the City Council to the various subcommittee assignments. Motion by Mayor Hall, seconded by Mayor Pro Tern Blackburn, to adopt Resolution No. 2021- 008 appointing Mayor Hall as the Primary Member, Council Member Bhat-Patel as the First Alternate Member and Mayor Pro Tern Blackburn as the Second Alternate Member to the SANDAG Board of Directors. Motion carried unanimously, 5/0. Council Member Acosta expressed her disinterest in serving on the SANDAG Shoreline Preservation Working Group. Motion carried unanimously, 5/0. Council Member Acosta expressed her interest in serving on the SDCWA Board of Directors. In response to an inquiry from Council Member Bhat-Patel, Mayor Hall explained that Keith Lewinger is the SDCWA Board of Directors alternate. Council Member Acosta expressed her interest in serving on the CEA JPA. Mayor Hall expressed his interest in continuing to serve on the CEA JPA. Council Member Schumacher expressed her interest in continuing to serve on the CEA JPA. In response to an inquiry from Council Member Acosta, City Attorney Brewer explained the procedures to bring back an item to expand district appointments. Motion by Council Member Acosta, seconded by Mayor Hall, adopting Resolution No. 2021- 017 appointing Michael Sebahar to the Parks & Recreation Commission. Motion carried unanimously, 5/0. Jan. 12, 2021 Carlsbad City Council Regular Meeting Page 11 In response to an inquiry from Mayor Hall, City Attorney Brewer explained that the transition to district appointments is complete. She added that further action from the City Council would be needed to transition other boards and commissions to have district appointments. In response to an inquiry from Mayor Pro Tern Blackburn, City Manager Chadwick explained that it would take approximately two months to get this through the Municipal Code Subcommittee before returning to City Council. Minute Motion by Council Member Acosta, seconded by Council Member Bhat-Patel, directing staff to return with information as to how the transition of district appointments can be continued for all boards and commissions. APPOINT ONE MEMBER TO THE CARLSBAD GOLF LODGING BUSINESS IMPROVEMENT DISTRICT ADVISORY BOARD — Adoption of Resolution No. 2021-018 appointing one member to the Carlsbad Golf Lodging Business Improvement District Advisory Board. (Staff contact: Tammy McMinn, City Clerk Department) City Manager's Recommendation: Adopt the resolution. Motion by Mayor Hall, seconded by Mayor Pro Tern Blackburn, adopting Resolution No. 2021- 018 reappointing Geoff Gray to the Carlsbad Golf Lodging Business Improvement District Advisory Board. Motion carried unanimously, 5/0. COUNCIL REPORTS AND COMMENTS: City Council Members Bhat-Patel, Acosta, and Schumacher expressed their concern with the domestic terror attack at the U.S. Capitol that took place on Jan. 6, 2021. CITY MANAGER COMMENTS: City Manager Scott Chadwick thanked the City Council, constituents, and city staff for their kind words and support during his COVID-19 recovery. CITY ATTORNEY COMMENTS: City Attorney Celia Brewer congratulated Deputy City Attorney Marissa Kawecki on the birth of her daughter. CITY CLERK COMMENTS: None. ANNOUNCEMENTS: None.
