APPROVAL OF MINUTES:
Minutes of the Regular Meeting held Nov. 17, 2020
Motion by Mayor Pro-Tern Blackburn, seconded by Council Member Bhat-Patel, to approve the
minutes as presented. Motion carried, 4/0/1 (Acosta — Abstain).
PRESENTATIONS: None.
PUBLIC COMMENT:
Motion by Mayor Hall, seconded by Council Member Acosta, to limit public comments on all
agenda items to two minutes and fifteen seconds. Motion carried unanimously, 5/0.

Jane!! Cannon spoke to highlight some of Council Member Schumacher's achievements and voiced
support for her political work.
Greg Dowell requested to expedite the permit review process and lift the stop work orders issued
to the Carlsbad Unified School District.
Erin McPherson Nielsen expressed the need for positive leadership and voiced her support for
Council Member Schumacher.
Nancy Hacker spoke to highlight some of Council Member Schumacher's achievements and voiced
support for her political work.

John Wellman spoke on the arbitrary responses that cities, counties, states and countries have
had to the COVID-19 pandemic and the need to follow in the footsteps of New York City and
Chicago's COVID-19 response.

Barbara Campbell expressed the need for positive leadership and voiced her support for Council

2.ADDITIONAL SETTLEMENT OF WORKER'S COMPENSATION CLAIM OF DEREK HARVEY —
Adoption of Resolution No. 2021-019 authorizing additional settlement of the worker's
compensation claim of Derek Harvey. (Staff contact: Sarah Reiswig and Judy von Kalinowski,

ORDINANCE FOR ADOPTION:
3.ORDINANCE NO. CS-389 — CITY ENGINEER ROLES AND RESPONSIBILITIES — Adoption of
Ordinance No. CS-389 amending sections 2.08.035, 2.24.020, 3.40.030, 8.48.020, 10.33.020,
11.16.020, 11.16.030 and 20.04.020 and adding sections 2.08.036, 2.08.037 and 13.16.020 of
the Carlsbad Municipal Code. (Staff contact: Faviola Medina, City Clerk Department)
City Attorney Celia Brewer titled the ordinance.
Motion by Mayor Pro Tern Blackburn, seconded by Council Member Bhat-Patel, to adopt
Ordinance No. CS-389. Motion carried unanimously, 5/0.
PUBLIC HEARINGS:
4.AMENDMENT TO THE 2020-21 ANNUAL ACTION PLAN — Adoption of Resolution No. 2021-
020 approving the fiscal year 2020-21 amended Annual Action Plan and inclusion of the
CARES Act supplemental funding, approving the CDBG Advisory Committee Funding
recommendations and authorizing the submittal of the consolidated plan to the U.S.
Department of Housing and Urban Development. (Staff contact: Nancy Me!ander,
Community Development)
City Manager's Recommendation: Take public input, close the public hearing and adopt the
resolution.
Program Manager Nancy Melander presented the report and reviewed a PowerPoint
presentation (on file in the Office of the City Clerk).
Mayor Hall opened the duly noticed Public Hearing at 3:57 p.m.
The following individuals called into the City Council Meeting and voiced their comments for

Rebecca Palmer expressed her support of the rental assistance programs and the allocating
of the CDBG funds.
Kathleen Diehlmann, President of the Board of Directors for the Brother Beno's Foundation,
expressed her support for the rental assistance programs and the collaboration with the
Brother Beno's organization. She also advocated the need for these types of programs for the
Tracy Carmichael expressed her support of the CDBG funding. She also advocated for more
services for the senior population and the emergency needs of the public.
Hearing no one else wishing to speak, Mayor Hall closed the duly noticed Public Hearing at
4:02 p.m.
Motion by Mayor Pro Tern Blackburn, seconded by Council Member Bhat-Patel, to adopt
Resolution No. 2021-020. Motion carried unanimously, 5/0.
DEPARTMENTAL AND CITY MANAGER REPORTS:
5. COVID-19: MINUTE ORDER ON A COMPREHENSIVE APPROACH TO ADDRESS PUBLIC HEALTH
ORDER COMPLIANCE — 1) Receive an informational report on the city's efforts to address the
COVID-19 public health orders and additional ideas for council's discussion; and
2)Adoption of Resolution No. 2021-021 approving modifications to the COVID-19 Small
Business Loan Program; and
3)Discuss and provide direction to staff on any additional actions to be vetted, receive legal
review, or pursued as appropriate to address compliance with the public health orders and
collaboration with other cities in the region and the county. (Staff contact: David Graham,
Community Development)
City Manager's Recommendation: Receive the report, adopt the resolution and provide
direction as appropriate.
Mayor Hall recused himself for the Carlsbad Village discussion of the item due to a potential
conflict of interest and added that he would return for the city-wide discussion of the item.
Mayor Hall left the dais at 4:04 p.m.

Motion by Mayor Pro Tern Blackburn, seconded by Council Member Bhat-Patel, directing staff
to:
•Use the city's intergovernmental affairs team to engage the governor, legislature,
legislative representatives, county representatives, or local agencies to support
city council priorities in addressing the pandemic.
•Engage with local, state and national organizations of which the city is a member
to support city council priorities in addressing a comprehensive approach to
addressing compliance with the public health order. Motion carried, 4/0/1 (Hall —
Absent).
Motion by Council Member Acosta, seconded by Council Member Bhat-Patel, directing staff
to:

•Continue and enhance existing COVID-19 response activities related to:
o Evaluating ways that other jurisdictions are comprehensively
addressing compliance and considering adoption of one or more
approaches if they are applicable, relevant, and effective
o Collaborating with the business community to better understand
barriers and solicit ways to assist
o Collaborating with volunteer groups to assist in compliance efforts. Motion
carried, 4/0/1 (Hall — Absent).
Compliance Ideas:
Motion by Mayor Pro Tern Blackburn, seconded by Council Member Bhat-Patel, directing staff
to provide additional communication to retail and big box stores to ensure compliance.

Motion by Council Member Bhat-Patel, seconded by Council Member Acosta, directing staff
to:
•Elevate administrative enforcement for businesses using temporary activation
permits.
•Coordinate efforts for outreach with landlords of persistent violators to bring
them into compliance. Motion carried, 3/1/1 (Blackburn — No; Hall — Absent).

Economic Relief and Incentive Ideas:
Motion by Council Member Schumacher, seconded by Council Member Bhat-Patel, directing
staff to:
•Leverage #STAYSAFESTAYOPEN program using a web portal to
recognize businesses complying with the health order, including:
o Digital marketing
o Ramped-up education campaign helping residents know how they
can support local businesses
o Fair promotion of businesses
•Collaborate with Carlsbad Village Association, Carlsbad Chamber of Commerce,
and Visit Carlsbad to create a recognition program.
•Use the $25,000 in business outreach funding authorized by the city council for
business community outreach.

•Engage with business organizations direct aid programs and return to city council
with options for their considerations, including:
o Microgrants
o Rental assistance programs. Motion carried unanimously, 5/0.
Motion by Mayor Pro Tern Blackburn, seconded by Council Member Bhat-Patel, to adopt
Resolution No. 2021-021. Motion carried unanimously, 5/0.
6.OBJECTIVE DESIGN STANDARDS AND STREAMLINED PERMITTING PROCESS FOR
MULTIFAMILY HOUSING PROJECTS — 1) Adoption of Resolution No. 2021-022 authorizing the
city to apply for $500,000 in Local Early Action Planning Grant Program Funds from the State
of California, to accept any award of funds, and authorizing the city manager to appropriate
any funds received; and
2) Adoption of Resolution No. 2021-023 approving an agreement for professional consulting
services with RRM Design Group to assist in the preparation of objective design standards
and procedures to streamline the permitting process for multifamily housing and mixed-use
development projects and directing staff to submit to the California Housing and Community
Development Department a request to revise the Senate Bill 2 scope of work and project
schedule (Case Name: Objective Design Standards and Streamlined Permitting Process for
Multifamily Housing; Case No.: ZCA 2020-0003/LCPA 2020-0007/AMEND 2020-0003 (PUB
2020-0004)) (Staff contact: Shelley Glennon, Community Development)
City Manager's Recommendation: Adopt the resolutions.
Mayor Hall announced he would step down from the dais due to a potential conflict of
interest.

City Planner Don Neu presented the report and reviewed a PowerPoint presentation (on file

Motion by Council Member Schumacher, seconded by Council Member Bhat-Patel, to adopt
Resolution No. 2021-022 and Resolution No. 2021-023. Motion carried, 4/0/1 (Hall —Absent).
Mayor Hall returned to the dais at 7:59 p.m.
7.SEMIANNUAL TRANSPORTATION REPORT — Receive a semiannual transportation report.

City Manager's Recommendation: Receive the report.
Transportation Director Tom Frank and Traffic and Mobility Commission Chair Mona Gocan
presented the report and reviewed a PowerPoint presentation (on file in the Office of the City
Clerk).

In response to an inquiry from Mayor Hall, City Manager Scott Chadwick explained that the
Semiannual Transportation Report could be highlighted in another way beside posting it on
the city's website. He added that the Communications team could figure out a way to
highlight the report.
Minute Motion by Mayor Hall, seconded by Council Member Schumacher, to highlight the
Semiannual Transportation Report. Motion carried unanimously, 5/0.
Council received the report.
8. WORK PLANS FOR THE PARKS & RECREATION DEPARTMENT'S THREE COMMISSIONS — 1)
Adoption Resolution No. 2021-024 approving the Parks & Recreation Commission Work Plan
for FY 2020-21; and
2)Adoption of Resolution No. 2021-025 approving the Senior Commission Work Plan for FY
2020-21; and
3)Adoption of Resolution No. 2021-026 approving the Beach Preservation Commission Work
Plan for FY 2020-21. (Staff contact: Kyle Lancaster, Parks & Recreation)
City Manager's Recommendation: Adopt the resolutions.
Parks & Recreation Director Kyle Lancaster presented the report and reviewed a PowerPoint

Motion by Mayor Pro Tern Blackburn, seconded by Council Member Bhat-Patel, to adopt
Resolution No. 2021-024, Resolution No. 2021-025 and Resolution No. 2021-026. Motion
carried unanimously, 5/0.
9. APPOINTMENT OF TWO MEMBERS TO THE CARLSBAD GOLF LODGING BUSINESS
IMPROVEMENT DISTRICT ADVISORY BOARD AND THREE MEMBERS TO THE CARLSBAD
TOURISM BUSINESS IMPROVEMENT DISTRICT ADVISORY BOARD — 1) Adoption of Resolution
No. 2021-027 appointing two members to the Carlsbad Golf Lodging Business Improvement
District Advisory Board; and
2)Adoption of Resolution No. 2021-028 appointing two members to the Carlsbad Tourism
Business Improvement District Advisory Board; and
3)Adoption of Resolution No. 2021-029 appointing one member to the Carlsbad Tourism
Business Improvement District Advisory Board. (Staff contact: Tammy McMinn, City Clerk
Department)
City Manager's Recommendation: Adopt the resolutions.

027 reappointing Robert Rauch and Tate Stull to serve as members on the Carlsbad Golf
Lodging Business Improvement District Advisory Board. Motion carried unanimously, 5/0.

028 reappointing Robert Rauch and Randall Chapin to serve as members on the Carlsbad
Tourism Business Improvement District Advisory Board. Motion carried unanimously, 5/0.
Motion by Mayor Hall, seconded by Mayor Pro Tern Blackburn, to adopt Resolution No. 2021-
029 appointing Hector Becerra to serve as a member on the Carlsbad Tourism Business
Improvement District Advisory Board. Motion carried unanimously, 5/0.
10. MAYORAL APPOINTMENT OF ONE MEMBER TO THE TRAFFIC & MOBILITY COMMISSION —
Adoption of Resolution No. 2021-030 appointing one member to the Traffic & Mobility
Commission. (Staff contact: Tammy McMinn, City Clerk Department)
City Manager's Recommendation: Adopt the resolution.
Motion by Mayor Hall, seconded by Mayor Pro Tern Blackburn, to adopt Resolution No. 2021-
030 reappointing Peter Penseyres to serve as a member on the Traffic & Mobility
Commission. Motion carried unanimously, 5/0.
COUNCIL REPORTS AND COMMENTS: Mayor Hall and the City Council Members reported on
activities and meetings of some committees and subcommittees of which they are members.
Minute Motion by Council Member Schumacher, seconded by Council Member Acosta, to discuss
a reconsideration of the reorganization of the City Council at the January 26th, 2021 City Council
meeting. Motion failed, 2/3 (Hall, Blackburn, Bhat-Patel — No).
Council Member Schumacher mentioned the passing of Carlsbad resident Jodi Good and the
impact she had on the community.
