CALL TO ORDER: 3 p.m.
ROLL CALL: Lafferty, Luna, Kamenjarin, Meenes, Merz, Sabellico and Stine
APPROVAL OF MINUTES:
Motion by Commissioner Lafferty, seconded by Commissioner Luna, to continue the Jan. 6, 2021 and the
Jan. 13, 2021 minutes. Motion passed 5/0/2 (Commissioners Kamenjarin and Sabellico abstained).
PUBLIC COMMENTS ON ITEMS NOT LISTED ON THE AGENDA:
None
PLANNING COMMISSION PUBLIC HEARING:
Chair Meenes directed everyone's attention to the slide on the screen to review the procedures the
Commission would be following for that evening's public hearing.
Chair Meenes opened the public hearing for Item 1.
1. CDP 2017-0025 (DEV05075) -HIGHLAND JAMES 5 LOT 1 -Request for approval of a Coastal
Development Permit to allow for the construction of a 3,691 square foot single-family residence
within the Mello II Segment of the city's Local Coastal Program located at 3970 Highland Drive within
Local Facilities Management Zone 1. The project site is not within the appealable area of the
California Coastal Commission. The City Planner has determined that the project belongs to a class
of projects that the State Secretary for Resources has found do not have a significant impact on the
environment, and it is therefore categorically exempt from the requirement for the preparation of
environmental documents pursuant to Section 15303(a) construction of a single family residence of
the state CEQA Guidelines.
City Planner Neu introduced Agenda Item 1 and stated Associate Planner Dan would make the staff
presentation (on file in the Planning Division).
DISCLOSURES:
Commissioners Lafferty, Merz, and Sabellico disclosed they visited the site.
Chair Meenes disclosed driving to the site and looking over the fence.
Commissioner Stine drove by the site and looked at an aerial view on Google Maps.
COMMISSION DISCUSSION:
Commissioner Meenes notes the staff report states there are proposed frontage improvements including
a curb, gutter, parkway and sidewalk. He asks if the rest of the street will also be improved.

Engineering Manager Geldert stated that the street has been identified as an alternative design street.
Commissioner Lafferty asked if an ADU was proposed and asked if dwelling units are being lost.
Associate Planner Dan stated if the property owner wanted to build an ADU the city would need to process
that under a different CDP. However, staff would need to review that with development standards in
place .
In response to a question from Commissioner Lafferty City Planner Neu discussed recent legislation
prohibits dwelling unit limitations in the city's growth management ordinance and the city's policies in
the matter will be reviewed · with the upcoming draft Housing Element. Additionally, he stated the
property owner cannot be required to build an ADU .
In response to Commissioner Meenes' question about proposed improvements, Deputy City Attorney
Kemp advised that proposed improvements on the alternative design street can be deferred to future
street improvements.
Commissioner Lafferty requested a condition for staff to correct the west elevation balcony to ensure the
elevation and 2nd floor plan are consistent.
City Planner Neu added that standard condition 3 authorizes staff to require the developer to correct and
modify the documents to make them internally consistent and conform with the final action.
City Planner Neu stated that staff can add the condition to ensure the sheets and plan set elevations are
consistent.
ACTION:
Motion by Commission Lafferty, seconded by Commissioner Kamenjarin, to adopt Resolution No. 7406 as
amended. Motion carried, 7 /0.

COMMISSION DISCUSSION:
Commissioner Lafferty asked if any site sections were provided for either property.
Associate Planner Dan responded that site sections were not proposed. He added that a geotechnical
report shows the pad and proposed rear property line slope.
Commissioner Merz noted the plan sheet that shows the topography for the rear of the lot, slope benching
per the geotechnical report and the finished grades.
Commissioner Lafferty asked about the roof equipment.
Ms. Temple, the applicant, responded that the solar panels will be on the roof.
ACTION:
Motion by Commissioner Stine, seconded by Commissioner Luna, to adopt Resolution No. 7407. Motion
carried, 7 /0.
PLANNING COMMISSION REPORTS/COMMENTS:
Commissioner Lafferty shared that the historic preservation commission is trying to organize a special
meeting to review whether the Capp House will be considered a historic property.
CITY PLANNER REPORTS:
City Planner Neu advised the Housing Element Update will be considered at the next meeting on March
3, 2021. He also added that the City Council voted to change the Village and Barrio Master Plan to require
council approval in the Barrio area.
CITY ATTORNEY REPORTS:
None.
