The Planning Division has completed a review of your application for the extension of Minor Conditional
Use Permit MCUP 16-02-B Project, an existing one-on-one athletic/physical training and rehabilitation
center located at 2075 Corte Del Nogal, Suite N. The application was submitted on March 8, 2021, prior
to the expiration date. The Minor Conditional Use Permit was originally approved on August 26, 2016.
MCUP 16-02 was set to expire on August 26, 2021.
After careful consideration of the circumstances surrounding this request, it has been determined that (1)
the project is still in compliance with the Conditional Use Permit regulations in Carlsbad Municipal Code
(CMC) Chapter 21.42, and (2) the findings required for granting a Minor Conditional Use Permit extension
can be made; therefore, pursuant to Carlsbad Municipal Code Section 21.42.ll0(D), the City Planner
APPROVES the extension of Minor Conditional Use Permit MCUP 16-02 in perpetuity, based on the
following findings and conditions.
Findings:
1. The permit or approval remains consistent with the general plan, all titles of the code and growth
management program policies and standards in place are the time the extension was considered,
and the findings contained in the City Planner approval letter dated August 26, 2016 for MCUP
16-02 -B PROJECT apply to this extension and are incorporated herein by reference and remain
in effect.
2. That the extension of Minor Conditional Use Permit MCUP 16-02 remains consistent with the
General Plan, all titles of the Carlsbad Municipal Code and growth management program policies
and standards in place at this time.
3. Circumstances have not substantially changed since the approval was originally granted as the
one-on-one athletic/physical training and rehabilitation center is existing and no substantial
changes have been proposed.
4. The City Planner has determined that the project belongs to a class of projects that the State
Secretary for Resources has found do not have a significant impact on the environment, and it is
therefore categorically exempt from the requirement for the preparation of environmental
documents pursuant to Section 15301-Existing Facilities of the state CEQA Guidelines. In making
this determination, the City Planner has found that the exceptions listed in Section 15300.2 of the
state CEQA Guidelines do not apply to this project.

Conditions:
1. This Minor Conditional Use Permit extension is granted in perpetuity pursuant to Carlsbad
Municipal Code Section 21.42.ll0(D).
2. The conditions contained in the City Planner's approval letter dated August 26, 2016, for MCUP
16-02 apply to this extension and are incorporated herein by reference and remain in effect
except for Planning Condition No. 8, which is superseded by Condition No. 1 of this approval
letter.
