Recommended Action
That the Community Development Commission hold a public hearing to consider and accept
public comment and adopt a resolution approving the City of Carlsbad’s Fiscal Year 2021 Annual
Public Housing Agency Plan for submission to the U.S. Department of Housing and Urban
Development.
Executive Summary
The Housing Services Division of the Community Development Department administers the
federally funded Section 8 Rental Assistance Program on behalf of the City of Carlsbad Public
Housing Agency. Under federal law, the Carlsbad Public Housing Agency is required to file a five-
year Public Housing Agency Plan with HUD. Additionally, the housing agency is also required to
prepare, adopt and submit to HUD an Annual Public Housing Agency Plan consistent with the goals
and objectives of the five-year plan.
These plans provide a basic guide to the housing agency’s policies, and the rules and
requirements concerning the agency’s operations, programs and services. In addition, the plans
advise HUD and members of the public about the mission and strategies for serving the needs
of low-income and very low-income families within the housing agency’s jurisdiction for each of
the next five years.
Under federal law, the plans must be adopted by the local Public Housing Agency’s Board of
Commissioners, which for Carlsbad is the City Council, serving as the Community Development
Commission. The commission approved the five-year plan on April 7, 2020. The Fiscal Year 2021
Annual Plan (attached to Exhibit 1) is the first annual update of the five-year plan.
Discussion
Plan goals and objectives
The 5-Year Public Housing Agency Plan identifies quantifiable goals and objectives that will
enable the agency to serve the needs of low-income families, those with under 80% of the area
median income; very low-income families, with under 50% of the area median income; and
extremely low-income families, with under 30% of the area median income.

The adopted 5-Year Public Housing Agency Plan has the following goals and objectives:
1. Expand the supply of assisted housing
• Apply for additional Housing Choice Voucher funding, when funds are made
available and the PHA is eligible to apply for such funds1
2. Improve the quality of assisted housing
• Improve voucher management by continuing to be recognized as a “high-
performing housing agency” in accordance with HUD’s Section Eight
Management Assistance Program performance evaluation
• Improve management functions by streamlining functions and technical
initiatives
• Fully utilize and maintain housing assistance payment costs within HUD-funded
allocations
3. Increase assisted housing choices
• Maintain voucher payment standards to expand assisted housing choices
4. Promote self-sufficiency and asset development of families and individuals
• Continue to voluntarily administer the Family Self-Sufficiency Program for
participants that are transferring into the jurisdiction who are currently on such
a program
5. Ensure equal opportunity and affirmatively further fair housing
• Undertake affirmative measures to ensure access to assisted housing regardless
of race, color, religion, national origin, sex, sexual orientation, familial status and
disability
o Will provide educational information about equal opportunity and fair
housing at all Section 8 Program briefings and move briefings
o Will provide reasonable accommodations for people with disabilities and
for frail elderly
o Will contract with the Legal Aid Society of San Diego, a non-profit agency
that provides advocacy on fair housing and tenant-landlord mediation
issues
Plan changes from last year
Each year, the Public Housing Agency is required to identify any plan elements that have been
revised since the last annual plan submission. For this reporting period there was one area that
has been revised and is addressed in the Fiscal Year 2021 Annual Public Housing Agency Plan
elements segment:

Financial resources - The amount of funding received for housing assistance payments
and program administration in calendar year 2020 increased significantly since the last
reporting period:

In November 2020 the housing agency received an additional disbursement of
$975,370. These additional funds were in response to the increase in monthly rental
assistance payments as a result of the COVID-19 pandemic. The housing agency also
received $251,319 for administrative costs also due to the pandemic.
Plan progress report
The Public Housing Agency also needs to indicate its progress in meeting the goals and
objectives identified in its last approved and adopted 5-Year Public Housing Agency Plan. The
agency’s goals and their status are described below:
1. Goal – Expand the supply of assisted housing
• Received an allocation of nine special purpose vouchers specifically for non-
elderly persons with disabilities.
2. Goal – Improve voucher management
• In response to COVID 19 and the office closure, developed protocols for
interacting with participants and stakeholders via phone, email and online
meetings.
3. Goal – Increase assisted housing choices
• Maintained payment standards between 100% and 110% of the HUD-published
“fair market rents” to ensure voucher holders are able to fully use their
assistance and find adequate housing in Carlsbad.
• The city’s housing navigator position assists rental assistance participants and
community members in locating housing. Last year, the housing navigator
assisted about 600 individuals.
4. Goal – Promote self-sufficiency and asset development of families and individuals
• Voluntarily administers the Family Self-Sufficiency Program for participants who
have moved into the agency’s jurisdiction. In 2020, there were three families
participating in the program, one successfully completed the program during the
year.
5. Goal – Ensure equal opportunity and affirmatively further fair housing
• The agency has a contract with the Legal Aid Society of San Diego to provide Fair
Housing counseling, educational Fair Housing seminars for staff, tenants and
landlords. Among the services it provided in 2020, the Legal Aid Society
conducted a fair housing law and eviction moratorium training before the
Housing Commission in December. Members of the public and the real estate
and property management industries were invited to attend the virtual
workshop.

• In collaboration with other North County cities, the 2020-2025 San Diego
Regional Analysis of Impediments to Fair Housing was finalized in May 2020.2
The Analysis of Impediments, which was approved by the City Council on July 14,
2020, provides guidance to the cities and the region to advance the goals of fair
housing.
• Fair housing educational materials are available on the city’s website and
included in briefing packets and available in English and Spanish in the Housing
Services lobby.
On January 14, 2021, the Housing Commission passed a resolution (Exhibit 3) recommending
approval of the annual plan for FY 2021.
Options
Federal regulations require public housing agencies to prepare, adopt and submit to HUD an
Annual Public Housing Agency Plan as a condition of receiving Section 8 program funding. If the
Carlsbad Community Development Commission does not adopt and submit the Fiscal Year 2021
Annual Public Housing Agency Plan to HUD, then the city’s Section 8 rental assistance program
would not receive funding.
Fiscal Analysis
The Public Housing Agency Plan governs the federal funds allocated for administration of the
Section 8 Rental Assistance Program. For calendar year 2020, the City of Carlsbad’s funding
allocation was $8,420,505 for rental assistance payments and $788,739 for program operating
expenses.
The funding level for calendar year 2021 is unknown at this time because it is not expected that
HUD will publish and release the funding allocations until April. However, assuming next year’s
funding will be similar to the current year allocation, staff estimates the housing agency will be
able to continue providing rental subsidies for approximately 550 families.
Next Steps
With the Community Development Commission’s approval of the Public Housing Agency Plan,
staff will work with the mayor to execute and submit all required documents to the Department
of Housing and Urban Development, which includes all certifications relating to civil rights.
Environmental Evaluation (CEQA)
This action does not constitute a “project” within the meaning of the California Environmental
Quality Act under Public Resources Code section 21065 in that it has no potential to cause
either a direct physical change in the environment, or a reasonably foreseeable indirect physical
change in the environment, and therefore does not require environmental review.
Public Notification and Outreach
The draft FY 2021 Public Housing Agency Annual Plan was available for public review and
comment for 45 days prior to adoption by the Community Development Commission. The
public review period will end on March 23, 2021 with a public hearing before the Community

Development Commission. Public comments from the public review period and the public
hearing will be included in the final Public Housing Agency Plan submission to HUD.
Public notice of this item was posted in keeping with the state's Ralph M. Brown Act and it was
available for public viewing and review at least 72 hours before the scheduled meeting date.
Information regarding public notifications of this item such as mailings, public hearing notices
posted in a newspaper of general circulation and on the city’s website are available in the Office

A RESOLUTION OF THE COMMUNITY DEVELOPMENT COMMISSION OF THE
CITY OF CARLSBAD, CALIFORNIA, APPROVING THE ANNUAL PUBLIC
HOUSING AGENCY PLAN FOR FISCAL YEAR 2021 FOR SUBMISSION TO THE
U.S. DEPARTMENT OF HOUSING AND URBAN DEVELOPMENT (HUD)
WHEREAS, Housing Services staff, on behalf of the Carlsbad Housing Agency, administers the
Section 8 Rental Assistance Program for the City of Carlsbad; and
WHEREAS, the U.S. Department of Housing and Urban Development (HUD) has issued regulations
requiring Public Housing Agencies (PHA) to submit a 5-year and Annual Plan consistent with the City of
Carlsbad's Consolidated Plan and local objectives; and
WHEREAS, the Department of Housing and Urban Development (HUD) requires that the
Community Development Commission hold a public hearing to consider and accept public comment and
approve the Annual PHA Plan for Fiscal Year 2021 and authorize execution of the PHA Certifications of
Compliance with the PHA Plans and Related Regulations: Board Resolution to accompany the Annual PHA
Plan for Fiscal Year 2021 and submit all documents with the Plan to the U.S. Department of Housing and
Urban Development.
NOW, THEREFORE, BE IT RESOLVED by the Community Development Commission of the City of
Carlsbad, California, as follows that:

A) is hereby approved by the Community Development Commission.

Purpose. The 5-Year and Annual PHA Plans provide a ready source for interested parties to locate basic PHA policies, rules, and requirements concerning the PHA’s operations, programs, and services, and informs HUD, families served by the PHA, and members of the public of the PHA’s mission, goals and objectives for serving the needs of low- income, very low- income, and extremely low- income families Applicability. Form HUD-50075-HCV is to be completed annually by HCV-Only PHAs. PHAs that meet the definition of a Standard PHA, Troubled PHA, High Performer PHA, Small PHA, or Qualified PHA do not need to submit this form. Where applicable, separate Annual PHA Plan forms are available for each of these types of PHAs. Definitions. (1) High-Performer PHA – A PHA that owns or manages more than 550 combined public housing units and housing choice vouchers, and was designated as a high performer on both of the most recent Public Housing Assessment System (PHAS) and Section Eight Management Assessment Program (SEMAP) assessments if administering both programs, or PHAS if only administering public housing. (2) Small PHA - A PHA that is not designated as PHAS or SEMAP troubled, or at risk of being designated as troubled, that owns or manages less than 250 public housing units and any number of vouchers where the total combined units exceeds 550. (3) Housing Choice Voucher (HCV) Only PHA - A PHA that administers more than 550 HCVs, was not designated as troubled in its most recent SEMAP assessment, and does not own or manage public housing. (4) Standard PHA - A PHA that owns or manages 250 or more public housing units and any number of vouchers where the total combined units exceeds 550, and that was designated as a standard performer in the most recent PHAS and SEMAP assessments. (5) Troubled PHA - A PHA that achieves an overall PHAS or SEMAP score of less than 60 percent. (6) Qualified PHA - A PHA with 550 or fewer public housing dwelling units and/or housing choice vouchers combined, and is not PHAS or SEMAP troubled.

PHA Certifications of Compliance with the PHA Plan and Related Regulations including
Required Civil Rights Certifications
Acting on behalf of the Board of Commissioners of the Public Housing Agency (PHA) listed below, as its Chairman or other
authorized PHA official if there is no Board of Commissioners, I approve the submission qf the 5-Year and/or XX Annual PIIA Plan
for the PHA fiscal year beginning July, 2021, hereinafter referred to as" the Plan", ofwhich this document is apart and make the
following certifications and agreements with the Department of Housing and Urban Development (HUD) in connection with the
submission of the Plan and implementation thereof
The Plan is consistent with the applicable comprehensive housing affordability strategy (or any plan incorporating such
strategy) for the jurisdiction in which the PHA is located.
2.The Plan contains a certification by the appropriate State or local officials that the Plan is consistent with the applicable
Consolidated Plan, which includes a certification that requires the preparation of an Analysis of Impediments to Fair Housing
Choice, for the PHA's jurisdiction and a description of the manner in which the PHA Plan is consistent with the applicable
Consolidated Plan.
3.The PHA has established a Resident Advisory Board or Boards, the membership of which represents the residents assisted by
the PHA, consulted with this Resident Advisory Board or Boards in developing the Plan, including any changes or revisions
to the policies and programs identified in the Plan before they were implemented, and considered the recommendations of the
RAB (24 CFR 903.13). The PHA has included in the Plan submission a copy of the recommendations made by the Resident
Advisory Board or Boards and a description of the manner in which the Plan addresses these recommendations.
4.The PHA made the proposed Plan and all information relevant to the public hearing available for public inspection at least 45
days before the hearing, published a notice that a hearing would be held and conducted a hearing to discuss the Plan and
invited public comment.
5.The PHA certifies that it will carry out the Plan in conformity with Title VI of the Civil Rights Act of 1964, the Fair Housing
Act, section 504 of the Rehabilitation Act of 1973, and title II of the Americans with Disabilities Act of 1990.
6.The PHA will affirmatively further fair housing by examining their programs or proposed programs, identifying any
impediments to fair housing choice within those programs, addressing those impediments in a reasonable fashion in view of
the resources available and work with local jurisdictions to implement any of the jurisdiction's initiatives to affirmatively
further fair housing that require the P1-IA's involvement and by maintaining records reflecting these analyses and actions.
7.For PHA Plans that includes a policy for site based waiting lists:
•The PHA regularly submits required data to HUD's 50058 PIC/IMS Module in an accurate, complete and timely manner
(as specified in P1H Notice 2010-25);
•The system of site-based waiting lists provides for full disclosure to each applicant in the selection of the development in
which to reside, including basic information about available sites; and an estimate of the period of time the applicant
would likely have to wait to be admitted to units of different sizes and types at each site;
•Adoption of a site-based waiting list would not violate any court order or settlement agreement or be inconsistent with a
pending complaint brought by HUD;
•The PHA shall take reasonable measures to assure that such a waiting list is consistent with affirmatively furthering fair
housing;
•The PHA provides for review of its site-based waiting list policy to detennine if it is consistent with civil rights laws and
certifications, as specified in 24 CFR part 903.7(c)(1).
8.The PHA will comply with the prohibitions against discrimination on the basis of age pursuant to the Age Discrimination Act
of 1975.
9.The PHA will comply with the Architectural Barriers Act of 1968 and 24 CFR Part 41, Policies and Procedures for the
Enforcement of Standards and Requirements for Accessibility by the Physically Handicapped.
10.The PHA will comply with the requirements of section 3 of the Housing and Urban Development Act of 1968, Employment
Opportunities for Low-or Very-Low Income Persons, and with its implementing regulation at 24 CFR Part 135.
11.The PHA will comply with acquisition and relocation requirements of the Uniform Relocation Assistance and Real Property
Acquisition Policies Act of 1970 and implementing regulations at 49 CFR Part 24 as applicable.

12. The PHA will take appropriate affirmative action to award contracts to minority and women's business enterprises under 24 CFR 5.105(a). 13. The PHA will provide the responsible entity or HUD any documentation that the responsible entity or HUD needs to carry out its review under the National Environmental Policy Act and other related authorities in accordance with 24 CFR Part 58 or Part 50, respectively. 14. With respect to public housing the PHA will comply with Davis-Bacon or HUD determined wage rate requirements under
Section 12 of the United States Housing Act of 1937 and the Contract Work Hours and Safety Standards Act. 15. The PHA will keep records in accordance with 24 CFR 85.20 and facilitate an effective audit to determine compliance with program requirements. 16. The PHA will comply with the Lead-Based Paint Poisoning Prevention Act, the Residential Lead-Based Paint Hazard Reduction Act of 1992, and 24 CFR Part 35. 17. Chairperson Nguyen-Cleary said he had a meeting with Jeff Murphy, Community Development Director, regarding the Housing Element and it being a non-exclusive guiding document for the city. The city is obligated to follow-up on all items in the
Housing Element, but that doesn’t preclude the Housing Commission or city from raising

Ms. Bobbi Nunn, Housing Program Manager, gave a presentation to the Housing
Commission on the 2021 Annual PHA Plan. Ms. Nunn answered Commission questions regarding aspects of the Section 8 rental assistance program, such as rules about participants moving to Carlsbad (porting
in), status of the waiting list, Family Self-Sufficiency (FSS), and participant
demographics.
Staff Recommendation: Approve.

Resolution No. 2021-001, recommending that the Community

2. HOMELESS RESPONSE ACTIVITIES AND UPDATES - Receive an informational report on the City of Carlsbad’s recent activities to address homelessness. No action is requested.
Ms. Holly Nelson, Senior Homeless Program Manager, gave a presentation on the city’s homelessness response activities and answered questions concerning:
• 2020 Point-in-Time data and homeless demographics from the City of Carlsbad
Police Department and regional resources in North County
• Status update on the Homeless Response Plan and how the city is responding to COVID19 concerns with the homeless community
• Efforts of the North County Ad Hoc Committee and coordinating with neighboring
jurisdictions on the issue of homelessness Program.
Staff Recommendation: Receive report.
3. 2020 HOUSING COMMISSION WORK PLAN ANNUAL REPORT AND 2021
HOUSING COMMISSION WORK PLAN – Carlsbad Municipal Code (CMC) Section 2.15.020 (C) requires that each board or commission provide to the City Council for its approval an annual work plan of activities to be undertaken and to provide a subsequent report of its accomplishments.
Mr. David de Cordova, Housing Services Manager, gave a report on the 2020 Annual Work Plan of the Housing Commission. He also presented the Resolution 2021-002 for the 2021 Housing Commission Work Plan.
An email was read into the record from Carlsbad resident Diane Rivera regarding
accessibility of affordable housing information. Chairperson Ngyuen-Cleary noted that the draft 2021-2029 Housing Element includes a program to improve access to housing information, and that it overlaps with Goal 4 of the Housing Commission work plan. Commissioner Evans volunteered to meet with Ms. Rivera to discuss her concerns and
ideas, and Housing Services Manager de Cordova stated that staff would also reach out
to Ms. Rivera regarding points she raised.
ACTION: On a motion by Commissioner Cortes-Torres and seconded by Commissioner Cole, the Housing Commission adopted Resolution
No. 2021-002, recommending approval as presented.

• The Housing Element Update has been submitted to the state for their review. They have 60 days to review the document. Staff posted a strike out version of the latest draft Housing Element on the city’s website, which compares the draft
document to the currently-adopted Housing Element.
• There will be a special Housing Commission on March 4th for the Housing Element Update.

Annual Plan for Fiscal Year 2021 for submission to the U.S. Department of Housing and Urban
Development.
Executive Summary
The Housing Services Division administers the federally funded Section 8 Rental Assistance
Program for the Carlsbad Public Housing Agency. Under federal law, a Public Housing Agency
(PHA) is required to submit a 5-Year and Annual Plan. These plans provide a basic guide to PHA
policies, rules, and requirements concerning the PHA’s operations, programs, and services. In
addition, the plans advise HUD and members of the public the PHA’s mission and strategies for
serving the needs of low-income and very low-income families for the next five years. The 5-Year
Plan was approved and adopted by the Community Development Commission on April 7, 2020.
Each year, the Carlsbad Public Housing Agency is required to prepare, adopt and submit to HUD an
Annual Plan consistent with the goals and objectives of the 5-Year Plan. The Fiscal Year 2021
Annual Plan (Attachment 2) is the first annual update of the 5-Year Plan.
Analysis
The purpose of the 5-Year PHA Plan is to identify goals and objectives to serve the needs of low-
income (under 80% of the area median income - AMI), very low-income (under 50% of the AMI),
and extremely low-income (under 30% of the AMI) families for the next five years.

The 5-Year PHA Plan goals are:
1. Expand the supply of assisted housing
2. Improve the quality of assisted housing
3. Increase assisted housing choices
4. Promote self-sufficiency and asset development of families and individuals
5. Ensure equal opportunity and affirmatively further fair housing
On an annual basis, the PHA needs to indicate the progress in meeting the goals and objectives
identified in the 5-Year PHA Plan which was adopted on April 7, 2020.
Further, the PHA is required to identify any PHA Plan elements that have been revised since the
last Annual Plan submission. The following area is addressed in the PHA Plan Update segment:

Next Steps
The Fiscal Year 2021 Annual Plan is required to be available for public review and comment prior
to a Public Hearing and adoption by the City Council who acts as the Community Development
Commission for this process. The public review period is 45 days and the Annual Plan is due to the
Housing and Urban Development Department (HUD) prior to April 17, 2021. A Public Hearing will
be scheduled when the Community Development Commission hears this item. All public
comments received on the Annual Plan will be addressed and included in the final documents that
will be submitted to HUD.
Environmental Review
Pursuant to Public Resources Code section 21065, this action does not constitute a “project”
within the meaning of CEQA in that it has no potential to cause either a direct physical change
in the environment, or a reasonably foreseeable indirect physical change in the environment,
and therefore does not require environmental review.
