Rojas Room Addition
Mike -On February 17, 1998, the City Council adopted Resolution No. 294, granting the appeal for a
variance to waive the parking requirement for additions to an existing building on the Rojas property
located at 2650 Roosevelt Street. The property owner's representative will be submitting revised plans.

1. Please make all corrections on the original tracings, as requested in the correction list.
Submit three sets of plans for commercial/industrial projects (two sets of plans for residential
projects). For expeditious processing, corrected sets can be submitted in one of two ways:
1. Deliver all corrected sets of plans and calculations/reports directly to the City of
Carlsbad Building Department, 2075 Las Palmas Drive, Carlsbad, CA 92009, (619) 438-
1161. The City will route the plans to EsGil Corporation and the Carlsbad Planning,
Engineering and Fire Departments.
2. Bring one corrected set of plans and calculations/reports to EsGil Corporation, 9320
Chesapeake Drive, Suite 208, San Diego, CA 92123, (619) 560-1468. Deliver all remaining
sets of plans and calculations/reports directly to the City of Carlsbad Building Department for
routing to their Planning, Engineering and Fire Departments.
NOTE: Plans that are submitted directly to EsGil Corporation only will not be reviewed
by the City Planning, Engineering and Fire Departments until review by EsGil Corporation is
complete.
2. Window area for the expanded room must be 1 /1 O of the floor area. The new 5°4° window will
not comply.
3. Specify on the plans the thickness and type of plywood shear panel you intend to use.

I have reviewed the above plan check and have the following comments:
"1· All additions to existing buildings within the Village Redevelopment Area are
required to provide parking per the standards contained within the Village Master
Plan and Design Manual. The Master Plan requires a two car garage for single
family dwellings. Therefore, prior to the issuance of a building permit, the plans
must be revised to include the construction of a two car garage.

Jroof cross-section. The cross section appears to be located in the vicinity of the
building addition. The plans will need to be revised to remove the cross-section and

Sewer lateral across assessor property numbers 203-102-25 and 26.

Per our discussion with Mr. Rojas last week, it is my understanding that Mr. Rojas is trying to
satisfy his City building inspector for sign-off of a room addition he is currently building. The
inspector wants Mr. Rojas to bring a sewer lateral into conformance with City standards. The
inspector claims that the sewer lateral which services Mr. Rojas' house on APN 203-102-25
crosses the adjacent vacant parcel to the north (APN 203-102-25) before connecting with the
main line in the street. Mr. Rojas does not dispute this claim but did state that the line has been
there since the 1950's. A sewer line may not cross another lot unless accompanied by easement.
Since Mr. Rojas owns both properties, several options are available to resolve this issue.
Resolution can be accomplishing by any one of the following options.
• Consolidate both properties into one legal lot by processing an application for an
adjustment plat through the City Engineering Department. A "Combination
Request" through the County Assessors Office to combine the "parcels" does not
create one lot. This process will only combine two assessor parcels into one parcel
number for tax purposes. Two separate lots would still underlay the single parcel.
• Process a covenant of easement over the adjacent lot. Like the adjustment plat, a
covenant of easement is processed through the City Engineering Department. A
covenant of easement would need to be processed rather than a regular easement
dedication since the owner of the property which holds the lateral is the same owner
of the property benefiting from the sewer easement. In the event that the adjacent
vacant property is sold, the recordation of a covenant of easement will ensure that an
easement is established on the vacant lot and adequately disclosed to the buyer.
• Relocate the sewer line on to the property for which it serves.
• Adjust the lot line between the two properties to position the sewer line on to the
property for which the sewer line serves. This alternative may also violate zoning
ordinance, however. Consult with Planning Department.
