Thank you for submitting a preliminary review for the relocation of a rear fence proposed at 2882 Rancho
Cortes. The project site, an approximately 10,688-square-foot lot, currently is developed with a single-
family residence.
In response to your application, the Planning Division has prepared this comment letter. Please note that
the purpose of a preliminary review is to provide you with direction and comments on the overall concept
of your project. This preliminary review does not represent an in-depth analysis of your project. It is
intended to give you feedback on critical issues based upon the information provided in yoursubmittal.
This review is based upon the plans, policies, and standards in effect as of the date of this review. Please
be aware that at the time of a formal application submittal, new plans, policies, and standards may be
in effect and additional issues of concern may be raised through a more specific and detailed review.
Planning:
General
1. General Plan and zoning designations for the property are as follows:
a. General Plan: R-4 Residential
b. Zoning: P-C Planned Community Zone
c. Rancho Carrillo Master Plan (MP 139)
2. The project requires the following permits:
a. Minor Habitat Management Permit -Expansion of the yard to the edge of the native
vegetation would result in human activity (noise, human presence, pets, lighting, etc.) moving
right up to the habitat edge, which would affect native breeding birds and potentially impede
wildlife movement along the path that is currently behind the houses and used by the HOA to
clear vegetation for fire prevention. In addition, there is a potential that invasive plants within
the yard would have a greater chance of moving into the habitat and that pets may prey on
native birds and other species. These potential impacts would trigger a Habitat Management
Permit.
b. As a result of the environmentally sensitive location of the proposed fence, CEQA analysis may
result in the requirement of the preparation of CEQA documents, such as a Negative
Declaration, Mitigated Negative Declaration, etc.

3. A 20-foot fire suppression/maintenance area distance is required between the fence separating the
private-use back yard and the edge of the open space easement. The relocation of the fence to the
edge of the open space easement is not allowed as follows:
a. The fen~eloiation is subject to the 20-foot fire suppression distance shown on Figure 17 in Section
IV(C)(4) of MP 139 (page 69).
b. The fence location is subject to the 20-foot fire suppression distance pursuant to Section 5,
Subsection E (Condition C -General Fuel Modification) and Figure 5-C in the City of Carlsbad
Landscape Manual (linked below) for required distances between fences and habitat.

4. Pursuant to Section Vlll{C)(18){d) (p.172) of the Rancho Carrillo Master Plan (MP 139), slopes within
residential lots shall be maintained in common and free of property line fences. Please check with
your homeowner's association as they may have an additional easement or restriction on fence
locations. Additionally, the area in question is located within an HOA-maintained area and is
considered a fire suppression/fuel modification zone.
5. Pursuant to Carlsbad Municipal Code Section 21.95.140(C)(l)(b), no residential development is
allowed on slopes that exceed 40 percent. The small portions of the proposed fence that are located
on such slopes are not permitted.
