Mayor Hall announced this item was continued to a date uncertain.
Proclamation for Black History Month
Council Member Schumacher read the proclamation.
Sage Creek High School Black Student Union President Christian Dorsey-McQueen and Carlsbad
High School Black Student Union President Lena McEachern said a few words.

The following individuals called into the City Council Meeting and voiced their comment for the

Mary Lucid spoke regarding the Senior Center.
Robert Klotz spoke regarding reopening the pickle ball courts.
Katie Taylor spoke regarding her opposition to a civilian police oversight committee.
Ellie Arkans requested the City Council delay their decision on implementing a civilian police
oversight committee.

Motion by Mayor Pro Tern Blackburn, seconded by Council Member Bhat-Patel, to approve

1.ANNUAL REPORT ON CITY INVESTMENTS — Accept and file Annual Report of Investments for

2.REVISIONS TO COUNCIL POLICY 1 — ADOPTION OF CITY COUNCIL POLICY STATEMENTS
Adoption of Resolution No. 2021-042 adopting revised City Council Policy No. 1, Adoption of

3.PROFESSIONAL SERVICES AGREEMENT WITH INFRASTRUCTURE MANAGEMENT SERVICES,
LLC FOR CITYWIDE PAVEMENT CONDITION DATA COLLECTION — Adoption of Resolution No.
2021-043 authorizing execution of a professional services agreement with Infrastructure
Management Services, LLC for citywide pavement condition data collection and analysis as
part of the Pavement Management Program, CIP Project No. 6001 in an amount not to exceed
$165,700. (Staff contact: Jonathan Schauble, Public Works)
ORDINANCES FOR INTRODUCTION:
4.CARLSBAD MUNICIPAL CODE CHAPTER 2.04 AMENDMENT — ELECTED OFFICIALS —
Introduction of Ordinance No. CS-391 amending Chapter 2.04 and repealing Chapter 2.06 and
Sections 2.080.010, 2.080.020, 2.08.022, 2.08.030 and 2.08.032 of the Carlsbad Municipal
Code. (Staff contact: Cindie McMahon, City Attorney Department and Sheila Cobian, City
Manager Department)
City Manager's Recommendation: Introduce the ordinance.
Assistant City Attorney Cindie McMahon and Assistant to the City Manager Sheila Cobian
presented the report and reviewed a PowerPoint presentation (on file in the Office of the City
Clerk).
City Attorney Celia Brewer introduced and titled the ordinance.
Motion by Mayor Pro Tern Blackburn, seconded by Council Member Bhat-Patel, to introduce
Ordinance No. CS-391. Motion carried unanimously, 5/0.
ORDINANCE FOR ADOPTION: None.
PUBLIC HEARINGS:
5.VILLAGE AND BARRIO MASTER PLAN AMENDMENT AND LOCAL COASTAL PROGRAM
AMENDMENT CHANGING PERMIT APPROVAL AUTHORITY — 1) Introduction of Ordinance CS-
392 amending the Village and Barrio Master Plan to change the approval authority from the
Planning Commission to the City Council for site development plans, conditional use permits,
coastal development permits and variances processed within the Barrio Perimeter, Barrio
Center and Village-Barrio other districts (Case Name: Village and Barrio Master Plan
Amendment; Case No.: AMEND2020- 0001/AMEND2020-0002 (DEV08014); or
2) Introduction of an ordinance amending the Village and Barrio Master Plan to change the
approval authority from the City Council to the Planning Commission for site development

plans, conditional use permits, coastal development permits and variances processed within
the Village Center, Village General, Hospitality, Freeway Commercial and Pine-Tyler mixed-
use districts (Case Name: Village and Barrio Master Plan Amendment; Case No.: AMEND2020-
0001/AM END2020- 0002 (DEV08014). (Staff contact: Jeff Murphy, Community Development)
City Manager's Recommendation: Take public input, close the public hearing and adopt an
ordinance.
Mayor Hall announced he would recuse himself from this item due to a potential conflict of
interest. He left the meeting at 3:28 p.m.
Community Development Director Jeff Murphy presented the report and reviewed a
PowerPoint presentation (on file in the Office of the City Clerk).
Mayor Pro Tern Blackburn opened the duly noticed Public Hearing at 3:32 p.m.
Hearing no one wishing to speak, Mayor Pro Tern Blackburn closed the duly noticed Public
Hearing at 3:33 p.m.
In response to an inquiry from Council Member Schumacher, City Planner Don Neu explained
the approximate Planning Commission appeal costs, that no applications have been received
for California State Senate Bill 35 projects, and that a maximum of five hearings are allowed
under California State Senate Bill 330.
In response to an inquiry from Council Member Schumacher, Community Development
Director Murphy confirmed District 1 has the highest level of poverty in the city.
In response to an inquiry from Council Member Acosta, Community Development Director
Murphy explained the history of the Planning Commission's decision-making authority.
In response to an inquiry from Mayor Pro Tern Blackburn, City Planner Don Neu confirmed
that if the appellant were successful in the appeal, they would receive their monies back.
In response to an inquiry from Mayor Pro Tern Blackburn, Community Development Director
Murphy explained that the City Council still has the ultimate authority to reverse the Planning
Commission's decision through an appeal.
In response to an inquiry from Mayor Pro Tern Blackburn, City Attorney Celia Brewer
explained two possible approaches to appeals including modifying the hardship provision and
discouraging frivolous appeals.
In response to an inquiry from Council Member Schumacher, Community Development
Director Murphy explained the state's intent to reduce impediments, uncertainties and risks
associated with the public hearing process.

In response to an inquiry from Council Member Acosta, City Planner Don Neu explained the
appeals process provisions. Community Development Director Murphy added that there is a
one-page application.
City Attorney Celia Brewer introduced and titled the ordinance.
Motion by Council Member Schumacher, seconded by Council Member Acosta, to introduce
Ordinance No. CS-392 (Option 1). Motion carried, 3/1/1 (Blackburn — No; Hall —Absent).
Mayor Hall returned to the meeting at 3:58 p.m.
DEPARTMENTAL AND CITY MANAGER REPORTS:
6. AWARD OF CONTRACT TO HAZARD CONSTRUCTION FOR EL CAMINO REAL BRIDGE
IMPROVEMENTS—Adoption of Resolution No. 2021-044 accepting bids, awarding a contract
to Hazard Construction Company and authorizing additional appropriation in an amount not
to exceed $512,000 for construction of the El Camino Real Bridge Improvements at Cannon
Road Phase I, CIP Project Nos. 6042 and 6056, in an amount not to exceed $1,819,988. (Staff
contact: Brandon Miles, Public Works)
City Manager's Recommendation: Adopt the resolution.
Engineering Manager Hossein Ajideh and Associate Engineer Brandon Miles presented the
report and reviewed a PowerPoint presentation (on file in the Office of the City Clerk).
In response to an inquiry from Mayor Pro Tern Blackburn, Engineering Manager Ajideh
clarified that the completion of three northbound lanes will be part of phase two of the
project.
Motion by Mayor Pro Tern Blackburn, seconded by Council Member Bhat-Patel, to approve
Resolution No. 2021-044. Motion carried unanimously, 5/0.
COUNCIL REPORTS AND COMMENTS:
Mayor Hall and the City Council Members reported on activities and meetings of some
committees and subcommittees of which they are members. They also congratulated Council
Member Bhat-Patel on the birth of her child.
Mayor Hall announced the City Council Goal workshop has been continued to March 11, 2021
at 9:00 a.m.

City Manager Chadwick congratulated Council Member Bhat-Patel on the birth of her child.
