PLEDGE OF ALLEGIANCE: Mayor Pro Tern Blackburn led the Pledge of Allegiance. ANNOUNCEMENT OF CONCURRENT MEETINGS: None. INVOCATION: None. APPROVAL OF MINUTES: Minutes of the Regular Meeting held Jan. 12, 2021 Minutes of the Regular Meeting held Jan. 19, 2021 Minutes of the Special Meeting held Feb. 4, 2021 Motion by Mayor Pro-Tern Blackburn, seconded by Council Member Bhat-Patel, to approve the minutes as presented. Motion carried unanimously, 5/0. PRESENTATIONS: Proclamation for National Engineers Week Council Member Acosta read the proclamation. Transportation Director Tom Frank thanked the City Council and said a few words. Proclamation in Recognition of Kallie Humphries Council Member Schumacher read the proclamation. Kallie Humphries thanked the City Council and said a few words. PUBLIC COMMENT: The following individuals called into the City Council Meeting and voiced their comment for the record: Mary Lucid requested that the Parks & Recreation Department set goals to expand and grow the Senior Center. Julia Hayashi requested more park space in the Ponto area. Melanie Burkholder spoke regarding e-bike public safety. Todd Ruddle spoke regarding the placement of a paid public oversight committee, as well as the closure of the pickleball courts at Poinsettia Park Feb. 23, 2021 Carlsbad City Council Regular Meeting Page 2 Teamster Representative Salvador Abrica spoke regarding the current request for proposals for recycling organics, solid waste collections and organic materials processing services. Pierre Cochet-Weindandt advocated for safety compliance to stop the spread of the COVID-19 virus. Colin Scharff spoke regarding housing unaffordability in Carlsbad and San Diego County. Colleen Walseth spoke regarding the opening of the Alga Norte Aquatics Center and allowing parent participation. CONSENT CALENDAR: Motion by Mayor Pro Tern Blackburn, seconded by Council Member Bhat-Patel, to approve Consent Calendar Item Nos. 1 through 4. Motion carried unanimously, 5/0. 1.AGREEMENT WITH NISSHO OF CALIFORNIA, INC. FOR PARKS MAINTENANCE SERVICES — Adoption of Resolution No. 2021-045 awarding an agreement for parks services, Work Category C — Community Parks and Schools Athletic Fields, to Nissho of California, Inc. in an amount not to exceed $1,676,540 per year, during the initial two-year term of the agreement, and appropriating an ongoing additional $308,540 from the General Fund to the Parks Maintenance Operating Budget. (Staff contact: Tim Selke, Parks & Recreation) 2.CONSTRUCTION CONTRACT WITH ACE ELECTRIC FOR CITY FACILITY SAFETY AND PARKING LOT LIGHTING PROJECT, CIP 6074 — Adoption of Resolution No. 2021-046 awarding a construction contract to Ace Electric, Inc. for the City Facility Safety and Parking Lot Lighting Project CIP No. 6074 at Calavera Hills, Poinsettia and Stagecoach Community Parks. (Staff contact: Tim Selke, Parks & Recreation) 3.ACQUISITION OF AFFORDABLE HOUSING UNIT AT 2687 LEIGHTON CIRCLE — Adoption of Resolution No. 2021-047 authorizing the deputy city manager, administrative services, to appropriate $150,000 from the Community Development Block Grant Special Revenue Fund and $105,000 from the Housing Trust Fund and authorizing the City Manager to execute all required documents to complete the purchase of an affordable housing unit at 2687 Leighton Circle. (Staff contact: David de Cordova, Community Development) 4.AMENDMENTS TO MASTER SERVICE AGREEMENT WITH RICOH USA, INC. FOR MANAGED PRINT SERVICES — Adoption of Resolution No. 2021-048 authorizing the city manager to execute amendments to the Master Service Agreement with Ricoh-USA, Inc. for managed print services, in an amount not to exceed $333,820 for a two-year term ending February 28, 2023, with an optimal one-year extension ending February 29, 2024 in an amount not to exceed $166,910. CS-391 — CARLSBAD MUNICIPAL CODE CHAPTER 2.04 AMENDMENT — ELECTED OFFICIALS — Adoption of Ordinance No. CS-391 amending Chapter 2.04 and repealing Chapter 2.06 and Sections 2.08.010, 2.08.020, 2.08.022, 2.08.030 and 2.08.032 of the Carlsbad Municipal Code. (Staff contact: Faviola Medina, City Clerk Department) City Manager's Recommendation: Adopt Ordinance No. CS-391. This item was heard after Item #8 6.ORDINANCE NO. CS-392 — VILLAGE AND BARRIO MASTER PLAN AMENDMENT AND LOCAL COASTAL PROGRAM AMENDMENT CHANGING PERMIT APPROVAL AUTHORITY — Adoption of Ordinance No. CS-392 amending the Village and Barrio Master Plan to change the approval authority from the Planning Commission to the City Council for site development plans, conditional use permits, coastal development permits and variances processed within the Barrio Perimeter, Barrio Center and Village-Barrio other districts (Case Name: Village and Barrio Master Plan Amendment; Case No.: AMEND2020-0001/AMEND2020-0002 (DEV08014). (Staff contact: Faviola Medina, City Clerk Department) City Manager's Recommendation: Adopt Ordinance No. CS-392. PUBLIC HEARING: The Mayor requested this item be heard before Item #5. 7.FISCAL YEAR 2021-22 FUNDING PLAN AND NOTICE OF FUNDING AVAILABILITY FOR THE COMMUNITY DEVELOPMENT BLOCK GRANT PROGRAM —Adoption of Resolution No. 2021- 049 approving the Fiscal Year 2021-22 funding plan and authorizing the distribution of the Fiscal Year 2021-22 Notice of Funding Availability for the Community Development Block Grant Program. (Staff contact: Nancy Melander, Community Development) City Manager's Recommendation: Take public input, close the public hearing and adopt a resolution. Program Manager Nancy Melander presented the report and reviewed a PowerPoint presentation (on file in the Office of the City Clerk). Mayor Hall opened the duly noticed public hearing at 3:44 p.m. Hearing no one wishing to speak, Mayor Hall closed the duly noticed public hearing at 3:44 p.m. Motion by Mayor Pro Tern Blackburn, seconded by Council Member Bhat-Patel, adopting Resolution No. 2021-049. COVID-19 ACTIONS AND EXPENDITURES REPORT — Receive a report on recent actions and expenditures related to the city's response to the COVID-19 pandemic and provide direction as appropriate. (Staff contact: Geoff Patnoe, City Manager Department) City Manager's Recommendation: Receive the report and provide direction as appropriate. City Manager Scott Chadwick introduced the item. Assistant Director of Emergency Services David Harrison, Deputy City Manager of Community Services Gary Barberio, Parks & Recreation Director Kyle Lancaster, Community & Economic Development Director Jeff Murphy, Police Chief Neil Gallucci, Senior Program Manager Holly Nelson, Fire Chief Michael Calderwood, Chief Innovation Officer David Graham, and Deputy City Manager of Administrative Services Laura Rocha presented the report and reviewed a PowerPoint presentation (on file in the Office of the City Clerk). Council received the report. City Manager Scott Chadwick explained why the pickleball courts were closed due to lack of compliance, and that singles play will be reopened as of Fri., Feb. 26, 2021. In response to Council Member Acosta's inquiry, Parks & Recreation Director Kyle Lancaster explained that swimmers were limited to one lane while swimming in order to remain in compliance with social distancing protocols. In response to Mayor Pro Tern Blackburn's inquiry, Sgt. Gary Marshall explained that the Police Department is working with North County Transit District (NCTD) and the San Diego Sherriffs Department Rail Team regarding the homeless encampments on NCTD property. Sgt. Marshall further explained that two encampments were given a 72-hour notice to leave the premises and offered resources and assistance. Police Chief Gallucci clarified that not moving encampments is a CDC guideline, not a law, in order to negate the spread of the COVID-19 virus. In response to Council Member Schumacher's inquiry, Sgt. Marshall explained that the issue of homeless persons using the patio at the McGee Park House has been actively addressed since Jan. 1, 2021, to include increasing patrols and contacting the individuals at the park occupying the patio. Sgt. Marshall added that ten citations were issued as well as one arrest for possession of narcotics. Sgt. Marshall added that the goal of the Homeless Outreach Team was to provide outreach to individuals experiencing homeless and to assist them with resources that are available. In response to Council Member Schumacher's inquiry, Parks & Recreation Director Lancaster explained that a contracted company unlocks the bathrooms at the McGee House between 7 and 8 a.m. each morning. Council Member Schumacher voiced her concern for the female janitors who clean the McGee House and have to navigate around homeless individuals using the patio in order to access the house and not feeling safe doing so. Chief Gallucci explained that officers in the field can add the McGee House to their patrol between 7 and 8 a.m. each Feb. 23, 2021 Carlsbad City Council Regular Meeting Page 5 morning, and that anyone can call the Police Department at any time to report homeless individuals who are using the historic home's patio illegally. In response to Council Member Schumacher's inquiry, City Attorney Celia Brewer stated that not clearing encampments is a guidance by the CDC, not a law, and that they are suggesting encampments not be cleared in order to negate the spread of the COVID-19 virus. Minute Motion by Council Member Schumacher, seconded by Mayor Pro Tem Blackburn, directing staff to bring back an item regarding the enforcement of encampment clearings. Motion carried unanimously, 5/0. For the record, Council Member Schumacher stated that Ms. Nelson and Sgt. Marshall have been doing an exceptional job, and added that if she mentions wanting more to be done it is not because they are not doing enough, but it is because the issue feels intractable to all. Council Member Schumacher thanked Ms. Nelson and Sgt. Marshall for everything they do. ORDINANCES FOR ADOPTION: This item was heard after Item #8 5.ORDINANCE NO. Mayor Hall announced he would recuse himself from the following Item #6 due to a potential conflict of interest. He left the meeting at 4:41 p.m. Mayor Pro Tern Blackburn declared a recess at 4:41 p.m. Mayor Pro Tern Blackburn reconvened the meeting at 4:47 p.m. This item was heard after Item #8 6.ORDINANCE NO. Mayor Pro Tern Blackburn explained that although he originally voted no on this item, that he would be voting yes to show support for the direction the rest of the City Council decided to support. Motion by Mayor Pro Tern Blackburn, seconded by Council Member Bhat-Patel, to adopt Ordinance No. CS-392. Motion carried, 4/0/1 (Hall — Absent). Mayor Hall rejoined the meeting at 4:50 p.m. 9. VETERANS MEMORIAL PARK MASTER PLAN REPORT — Adoption of Resolution No. 2021-050 approving the recommended Veterans Memorial Park Master Plan Report in concept and directing staff to proceed with the necessary environmental permitting and entitlements. (Staff contact: Kasia Trojanowska, Parks & Recreation) City Manager's Recommendation: Adopt the resolution. Parks & Recreation Director Kyle Lancaster, Park Planning Manager Kasia Trojanowska, and Parks Services Manager Tim Selke presented the report and reviewed a PowerPoint presentation (on file in the Office of the City Clerk). In response to Council Member Acosta's inquiry regarding the militaristic theme for the park, Park Planning Manager Trojanowski explained that a more rustic and simple approach will be used by featuring boulders and wood and ways to honor the Veterans. In response to Mayor Hall's inquiry, Parks & Recreation Director Lancaster explained that legal advice has been obtained and will be incorporated in the final design aspects to avoid creating any intentional hazards. The following individuals called into the City Council Meeting and voiced their comment for the record: San Diego Mountain Biking Association Executive Director Susie Murphy thanked staff involved for a beautiful project and urged the City Council to approve the item. Diane Nygaard, representing Preserve Calavera, spoke regarding the 43.5 acres of sensitive habitat and asked that the project planners be careful when it comes to that area. Mayor Hall and Council Members thanked the Parks & Recreation Department staff for their hard work in creating a beautiful, multi-use park.
