PUBLIC REPORT OF ACTION TAKEN IN CLOSED SESSION: City Attorney Celia Brewer announced
no reportable action from closed session.
PUBLIC COMMENT:
The following individuals called into the City Council Meeting and voiced their comments for the
record:
Anthony Bona congratulated City Clerk Barbara Engleson for her recognition in Women's History
Month.
Larry Posner congratulated city and fire staff for their response during the COV1D-19 pandemic
and the vaccine distribution process. He also advocated for a more unified City Council.
Noel Breen advocated for more unity amongst the City Council.
Tim Stipe addressed misconceptions about a police oversight committee.
Tracy Carmichael requested a review be conducted into Council Member Schumacher and for her
resignation from the City Council.
Tiffani Czapinski requested Council Member Schumacher's resignation from the City Council.
Aly Vredenburg spoke in support of a potential police oversight committee.
Melanie Burkholder requested Council Member Schumacher's resignation from the City Council.

1.REPORT ON CITY INVESTMENTS AS OF JAN. 31, 2021 — Accept and file Report on City

2.DECLARATION OF RESTRICTIVE COVENANTS FOR THE ROMERIA DRAINAGE IMPROVEMENT
PROJECT HABITAT MITIGATION AREAS, CIP NO. 6604 — Adoption of Resolution 2021-051
authorizing execution of a declaration of restrictive covenants for the Romeria Drainage
Improvement Project Habitat Mitigation Areas, CIP Project No. 6604. (Staff contact: Daniel

PUBLIC HEARINGS:
3.LA COSTA TOWN SQUARE PARCEL 3 RESIDENTIAL — 1) Introduction of Ordinance CS-393
approving an amendment to the La Costa Master Plan (MP-149R) for property generally
located southeast of the intersection of La Costa Avenue and Rancho Santa Fe Road, and
located within the southeast quadrant of the city within Local Facilities Management Zone 11
(Case Name: La Costa Town Square Parcel 3 Residential; Case No.: AMEND 2017-0012); and
2) Adoption of Resolution No. 2021-052 approving a Tentative Tract Map, Planned
Development Permit and Site Development Plan to subdivide a 7.2 acre parcel into two lots,
one with 76 town homes and one with 19 affordable condominiums, including development
standards modifications, on property generally located north of the intersection of Calle
Timiteo and La Costa Avenue, within the La Costa Master Plan, Neighborhood SE-13B, in the
southeast quadrant of the city and Local Facilities Management Zone 11 (Case Name: La Costa
Townsquare Parcel 3 Residential; Case No. CT 2017-0003/PUD 2017-0004/SDP 2018-0018

City Manager's Recommendation: Take public input, close the public hearing, introduce an
ordinance and adopt a resolution.

Senior Planner Jason Goff presented the report and reviewed a PowerPoint presentation (on
file in the Office of the City Clerk).
Mayor Hall opened the duly noticed Public Hearing at 3:50 p.m.
City Attorney Celia Brewer explained that the applicant has 10 minutes to review their
presentation.
TRC Senior Vice President of Development Carlos Palafox and Consultant Byron de Arakal
presented the report and reviewed a PowerPoint presentation (on file in the Office of the City
Clerk).
Council Member Acosta discussed her ex parte disclosures. She explained she attended a
meeting and walked the project site with TRC Senior Vice President of Development Carlos
Palafox and Consultant Byron de Arakal. She also received additional information regarding
the project from Traffic Commissioner Steve Linke.
Hearing no one else wishing to speak, Mayor Hall closed the duly noticed Public Hearing at
4:03 p.m.
City Attorney Celia Brewer titled the ordinance.
Motion by Mayor Pro Tern Blackburn, seconded by Council Member Bhat-Patel, to introduce
Ordinance No. CS-393 and adopt Resolution No. 2021-052. Motion carried unanimously, 5/0.
DEPARTMENTAL AND CITY MANAGER REPORTS:
4. COVID-19 ACTIONS AND EXPENDITURES REPORT — Receive a report on recent actions and
expenditures related to the city's response to the COVID-19 pandemic and provide direction
as appropriate. (Staff contact: Geoff Patnoe, City Manager Department)
City Manager's Recommendation: Receive the report and provide direction as appropriate.

Jeff Murphy, Police Chief Neil Gallucci, Senior Program Manager Holly Nelson, Fire

5.CITY COUNCIL REDISTRICTING DISCUSSION — Engage in a discussion regarding the regulations
and options surrounding redistricting of City Council boundaries and provide direction to
staff. (Staff contact: Cindie McMahon, City Attorney Department, Sheila Cobian, City
Manager Department and Faviola Medina, City Clerk Department)
City Manager's Recommendation: Engage in discussion and provide direction to staff.
Assistant to the City Manager Sheila Cobian, City Clerk Services Manager Faviola Medina,
Assistant City Attorney Cindie McMahon, Communication and Engagement Director Kristina
Ray, and National Demographics Corporation Consultants Douglas Johnson and Shannon
Kelly presented the report and reviewed a PowerPoint presentation (on file in the Office of
the City Clerk).
In response to an inquiry from Council Member Bhat-Patel, Assistant City Attorney Cindie
McMahon explained that appointments to an Independent Redistricting Commission cannot
be made by the legislative body.
In response to an inquiry from Mayor Pro Tern Blackburn, Assistant City Attorney Cindie
McMahon explained that the legislative body can determine the selection method for making
appointments to the Independent Redistricting Commission but cannot actually make the
appointments themselves.
Motion by Council Member Schumacher, seconded by Council Member Bhat-Patel, directing
staff to return with information about an independent redistricting commission at a future
date uncertain. Motion carried, 3/2 (Hall, Blackburn — No).
Motion by Council Member Acosta, seconded by Council Member Bhat-Patel, directing staff
to hold a virtual meeting in each district, two in-person mapping sessions, and include a
multicultural outreach component. Motion carried unanimously, 5/0.
6.CLEAN ENERGY ALLIANCE DEFAULT ENERGY PRODUCT SELECTION AND RATES DISCUSSION —
Adoption of Resolution No. 2020-053 establishing the Clean Energy Alliance's default power
supply product for all customer accounts (municipal, commercidl, industrial and residential)
within the City of Carlsbad. (Staff contact: Jason Haber, City Manager Department)
City Manager's Recommendation: Adopt the resolution.
Director of Intergovernmental Affairs Jason Haber and Clean Energy Alliance (CEA) Chief
Executive Officer Barbara Boswell presented the report and reviewed a PowerPoint
presentation (on file in the Office of the City Clerk).
In response to an inquiry from Council Member Acosta, CEA Chief Executive Officer Boswell
explained that agencies at any time can change their default energy product.

In response to an inquiry from Council Member Acosta, CEA Chief Executive Officer Boswell
explained that exit rates are subject to volatility in the future for the next 8 to 10 years unless
there is a legislative action.
In response to an inquiry from Council Member Schumacher, CEA Chief Executive Officer
Boswell explained that if the Clean Energy Alliance has reserved funds that exceed the
established goals, the Clean Energy Alliance Board can then set customers' rates at a reduced
cost.
In response to an inquiry from Council Member Schumacher, Director of Intergovernmental
Affairs Haber explained that Clean Impact 75 in comparison to SDG&E has a 0.6% savings.
In response to an inquiry from Mayor Hall, CEA Chief Executive Officer Boswell explained that
the Clean Energy Alliance purchases energy in advanced at a fixed rate in an amount that they
anticipate their customers needing. She further explained that the Clean Energy Alliance does
this to protect themselves from the volatility in prices when demand increases.
Motion by Council Member Bhat-Patel, seconded by Council Schumacher, to adopt
Resolution 2020-053 selecting Option 2 — Clean Impact 75. Motion carried, 4/1 (Hall — No).
7. CONSIDER ADOPTION OF A RESOLUTION DECLARING A CLIMATE EMERGENCY — Consider a
request from City Council Member Schumacher to adopt a resolution declaring a climate
emergency. (Staff contact: Sheila Cobian, City Manager Department)
City Manager's Recommendation: Consider adoption of the resolution.
Council Member Schumacher introduced the item.
The following individuals called into the City Council Meeting and voiced their comments for
the record:
Karl Aldinger, Conservation Organizer for the Sierra Club of San Diego, advocated for the
seriousness of a climate crisis.
Paige DeCino expressed support for the resolution and advocated for local action towards
fighting the global climate crisis.
Michael McMahon advocated for local action towards fighting the global climate crisis.
Stephen Gunther, on behalf of the Center of Sustainable Energy, expressed support for the
resolution and praised the City of Carlsbad for its work towards resolving the climate crisis.

Motion by Council Member Schumacher, seconded by Council Member Bhat-Patel, directing
staff to review recommended resolution and bring back at a future date. Motion carried
unanimously, 5/0.

activities and meetings of some committees and subcommittees of which they are members.
