Attached for City Council consideration is a report of the 2020 Housing Commission Work Plan accomplishments and the proposed 2021 Housing Commission Work Plan. Also attached for City Council consideration is a report of the Fiscal Year 2019-20 Planning Commission Work Plan accomplishments and the proposed fiscal year 2020-21 and 2021-22 Planning Commission work plans. Discussion In 2018, the City Council revised the municipal code to create uniform policies and procedures related to boards and commissions, including a requirement for annual work plans. The purpose of the work plan is to encourage increased dialogue between the city’s boards and May 11, 2021 Item #11 Page 1 of 32 commissions and the City Council. It is also intended to ensure that the boards and commissions are working in line with the City Council’s priorities. Housing Commission On Jan. 28, 2020, the City Council approved the Housing Commission work plan for calendar year 2020, as well as an amendment to Carlsbad Municipal Code Chapter 2.40 that clarified that homelessness issues are part of the Housing Commission's functions. Following that City Council approval, the Housing Commission carried out its duties under the municipal code and consistent with the work plan. On Jan. 14, 2021, after public comment and commissioner discussion, the Housing Commission unanimously recommended that the City Council approve both the 2020 Annual Report and the proposed 2021 Work Plan as reflected in their resolution (Exhibit 3). The 2020 Work Plan Annual Report and 2021 Work Plan are reflected in Exhibit 1 as Attachments A and B, respectively. As the attached report details, despite the COVID-19 pandemic, the Housing Commission accomplished several tasks in the 2020 Work Plan. However, since a number of the tasks in the 2020 Work Plan are still in process, are recurring or ongoing in nature, the Housing Commission recommends that these tasks be carried forward to the 2021 Housing Commission Work Plan. Of particular note, the Housing Commission recommends the addition of one new task: (to review the pending inclusionary housing in-lieu fee study1 and make a recommendation to the City Council. (Task 1c, highlighted in bold type). Planning Commission On Dec. 10, 2019, the City Council approved the Planning Commission work plan for fiscal year 2019-20, as well as an amendment to the Carlsbad Municipal Code Chapter 2.24, to update procedural rules and eliminate redundant and inconsistent sections. The responsibilities and corresponding work of the Planning Commission is well defined in state law and Titles 19 (Environment), 20 (Subdivisions), and 21 (Zoning) of the Carlsbad Municipal Code. Because of this, many of the projects on the work plan are projects undertaken to comply with state laws or City Council direction, or those submitted by private applicants or city departments. The Planning Commission’s members met on March 17, 2021 to consider the commission’s work plan for fiscal years 2020-21 and 2021-22. The work plans are based on a fiscal year calendar and there is a short period of time until the start of the new fiscal year, so staff propose a work plan for both the current and future fiscal years. After a presentation by staff and a discussion of the work plans, the Planning Commission added a workshop to its fiscal year 2021-22 work plan. The Planning Commission unanimously recommended that the City Council approve the plans as reflected in its resolution (Exhibit 4. The 2020 Work Plan Annual Report, Fiscal Year 2020-21 Work Plan, and Fiscal Year 2021-22 Work Plan are included in Exhibit 3 as Attachments A, B and C.) As shown in the annual report, the Planning Commission met 15 times last year. (Typically, the Planning Commission typically meets about 20 times per year, but the impacts of COVID resulted in a few meeting cancellations in 2020.) May 11, 2021 Item #11 Page 2 of 32 matters and private development projects, including the comprehensive update to the city’s Local Coastal Program, Housing Element Update, density bonus ordinance2 and the Marja Acres, Aviara Apartment, and BMW Carlsbad Auto Dealership projects. Fiscal Analysis There is no direct fiscal impact associated with accepting the 2020 Housing Commission Work Plan Annual Report, the Planning Commission Fiscal Year 2019-20 Annual Report and approving the 2021 Housing Commission Work Plan and the Planning Commission fiscal year 2020-21 and 2021-22 work plans Next Steps The Housing Commission, the Planning Commission and staff will focus the commissions’ efforts on the activities listed in the approved work plans. Environmental Evaluation (CEQA) In keeping with California Public Resources Code Section 21065, this action does not constitute a “project” within the meaning of the California Environmental Quality Act ) in that it has no potential to cause either a direct physical change in the environment or a reasonably foreseeable indirect physical change in the environment and therefore does not require environmental review. Public Notification and Outreach Public notification for this item was published in accordance with the Ralph M. The Housing Commission held a public hearing on Feb. 13, 2020 to consider the 5-year and annual PHA plans, and recommended approval to the City Council. In 2021, the Housing Commission will hold a public hearing to consider and recommend on the Fiscal Year 2021 Streamlined Annual PHA Plan. c, Review and recommend for approval to City Council an affordable housing resale program. The Housing Commission reviewed proposed affordable housing resale guidelines on Aug. 13, 2020, and changes to related City Council Policy 73. The Housing Commission recommended approval of the resale guidelines as amended and changes to Council Policy 73 as proposed. The task is complete. The City Council adopted the affordable housing program guidelines and Council Policy 73 changes at their Dec. 8, 2020 meeting. d. Examine housing policy questions as may be referred by the City Council. The Housing Commission reviewed a proposed new City Council policy concerning the use of the Housing Trust Fund on Aug. 13, 2020, and recommended approval with amendments. The City Council adopted the Housing Trust Fund Policy at their Dec. 8, 2020 meeting. Recommend this as an on-going task for 2021 Goal 2: Support and advise the City Council regarding efforts to address homelessness. a. A status update of the North County regional effort was originally scheduled to be presented as part of the Task 2a report above. The report will be presented to the Housing Commission in early 2021. Goal 3: Monitor and participate in the 2021-2029 Housing Element Update. a.Receive regular updates from the Housing Commission representative to the Housing Element Advisory Committee (HEAC). The Housing Commission received status updates regarding the 2021-2029 Housing Element program at their February and October meetings. This task is complete. In a joint meeting with the City Council, Planning Commission, Traffic and Mobility Commission, and the Housing Element Advisory Committee on Jan. 21, 2020, the Housing Commission received a presentation regarding SB330: Housing Crisis Act of 2019 and New Regulations on Accessory Dwelling Units. The Housing Commission hosted a Basics of Fair Housing Law and Eviction Moratorium training workshop at their Dec. 10, 2020 meeting. This task is complete for 2020. Recommend this as a recurring task in 2021. b. Receive a status report of current Housing Element programs. The Housing Commission was provided a weblink to the 2019 Annual Housing Element Progress Report on Oct. 8, 2020. This task is complete for 2020. For some actions, the Planning Commission acts in an advisory role and provides a recommendation to the City Council. In many cases the City Council has delegated to the Planning Commission the authority to take a final action on the item subject to appeal to the City Council. Prior to an item being considered by the Planning Commission the Planning Division staff complete its review of a proposed project for compliance with all applicable plans, policies, and laws and provides a written recommendation. Planning Commissioners also serve on special committees or task forces as requested by the City Council. II.Composition The Planning Commission consists of seven members appointed by the City Council to a four-year term. There are also three ex officio members who shall be the City Planner, Assistant City Attorney, and City Engineer. III.Fiscal Year 2019-21 Goals & Tasks The City of Carlsbad Planning Commission has selected to focus on the following goals and tasks: GOAL/TASK STATUS COMMENTS/RECOMMENDATION Long Range Planning Projects Local Coastal Program — Comprehensive Complete The Planning Commission received an Update of the Local Coastal Program overview of the Local Coastal Program Land Use Plan Update on November 20, 2019. On Dec. 2, 2020, Jan. 6, 2021 and Jan. 13, 2021 the Planning Commission held a public hearing to consider the draft plan. On Jan. 13, 2021 the Planning Commission voted unanimously to recommend approval of the draft plan with revisions. May 11, 2021 Item #11 Page 17 of 32 GOAL/TASK STATUS • COMMENTS/RECOMMENDATION Zoning Code Update Inactive Project was put on hold so staff could focus on other priority projects. An administrative draft of the updated Zoning Code has been prepared. Housing Element Update 2021-2029 Completed On Oct. 7, 2020 the Planning Commission received an informational presentation on the update to the General Plan Housing Element. On March 3, 2021 the Planning Commission recommended approval of an Addendum to EIR 13-02 and an amendment to the General Plan ' Housing Element. Growth Management Program Update Inactive No work was initiated on the project pending direction from the City Council. Level of involvement from the Planning Commission has not been determined. Density Bonus Ordinance Update Complete On Oct. 2, 2019 the Planning Commission recommended approval of a General Plan Amendment, Zone Code Amendment and Local Coastal Program Amendment to update the city's inclusionary housing and density bonus zoning ordinance to conform to changes in state law. May 11, 2021 Item #11 Page 18 of 32 Guidelines for Multi-Family Residential Structures (Subject to City Council approval to submit an application for an SB 2 Grant and award of state funding) Pending. Waiting for approval from the California Housing and Community Development Department to start work. On Jan. 26, 2021 the City Council approved an agreement for professional consulting services with RRM Design Group to assist in preparation of objective design standards for multi-family housing and mixed-use development projects outside of the Village and Barrio Master Plan area. The City Council also directed staff to submit to the California Housing and Community Development Department a request to update the SB 2 scope of work and project schedule. Private Development Projects Marja Acres- 248 townhomes, 46 affordable senior apartments, and 10,000 square feet of commercial space. Completed On Sept. 16, 2020 the Planning Commission recommended approval of certification of an Environmental Impact Report and Mitigation Monitoring and Reporting Program; and approval of development permits on 20.65 acres located at 4901 El Camino Real. May 11, 2021 Item #11 Page 22 of 32 City of Carlsbad Planning Commission Work Plan Fiscal Year 2020-2021 I.Mission Statement The Planning Commission holds regularly scheduled public hearings to consider land use matters, such as the general plan, local coastal program, growth management program, specific plans, master plans, amendments to the zoning ordinance, zone changes, special studies, and discretionary development permits for public and private projects. For some actions, the Planning Commission acts in an advisory role and provides a recommendation to the City Council. In many cases the City Council has delegated to the Planning Commission the authority to take a final action on the item subject to appeal to the City Council. Prior to an item being considered by the Planning Commission the Planning Division staff complete its review of a proposed project for compliance with all applicable plans, policies, and laws and provides a written recommendation. Planning Commissioners also serve on special committees or task forces as requested by the City Council. II.Composition The Planning Commission consists of seven members appointed by the City Council to a four - year term. There are also three ex officio members who shall be the City Planner, Assistant City Attorney, and City Engineer. Ill.
