Recommended Action
Hold a public hearing and adopt a resolution approving an amendment to the Carlsbad
TransNet Local Street Improvement Program of Projects for fiscal years 2020-21 through 2024-
25, as programmed in the 2021 San Diego Association of Governments Regional Transportation
Improvement Program.
Executive Summary
The city receives funding for certain transportation projects from a regional fund collected
under TransNet, the half-cent-on-the-dollar sales tax for local transportation projects that was
first approved by San Diego County voters in 1988 and extended in 2004 for 40 years.
On June 2, 2020, the City Council held a public hearing and adopted Resolution No. 2020-096
approving the Carlsbad TransNet Local Street Improvement Program of Projects for fiscal years
2020-21 through 2024-25 for inclusion in the 2020 update to the San Diego Association of
Governments TransNet Program of Projects, a step that entitles these projects for funding from
this regional program.
On Sept. 25, 2020, the association’s board of directors, acting as the San Diego County Regional
Transportation Commission, adopted the 2020 update to the TransNet Program of Projects as
Amendment No. 14 to the 2018 Regional Transportation Improvement Program. Amendment
No. 14 is a formal amendment to the 2018 program, which contains the updated 2020 TransNet
Program of Projects prepared by the local agencies in the region. On Feb. 26, 2021, the
association’s board adopted the 2021 program.
To obtain TransNet funding for Carlsbad projects, the City Council is required to hold a public
hearing to consider and approve the amendment to the Carlsbad Program of Projects. A signed
resolution approving the amendment is due to the San Diego Association of Governments by
June 4, 2021. The city’s amended program will then be incorporated into the association’s 2021
program amendment. On July 23, 2021, the association’s board is expected to approve the
amendment to the 2021 program.

Staff recommend approval of the amendment to the Carlsbad TransNet Local Street
Improvement Program of Projects for fiscal years 2020-21 through 2024-25.
Discussion
The San Diego Association of Governments Board of Directors, sitting as the San Diego County
Regional Transportation Commission, are required by state and federal laws to develop and
adopt an updated regional traffic improvement program every two years. This is a multiyear list
of projects submitted by cities and other jurisdictions in the county identifying transportation
projects that are eligible to use the sales tax funds generated through TransNet.
In addition to the federal and state requirements, the San Diego Transportation Improvement
Program Ordinance and Expenditure Plan requires that the association prepare a five-year
TransNet Program of Projects every two years.
Each association member agency that spends TransNet or certain federal or state funds must
first approve its own program of projects every two years. In addition to the projects using
those funding sources, the program must include projects that will increase transportation
capacity, regardless of their funding sources. The federal Metropolitan Planning and Air Quality
Conformity Regulations also require inclusion of all capacity-increasing road projects for air
quality emissions modeling and analysis.
On June 2, 2020, the City Council approved the 2020 TransNet Local Street Improvement
Program of Projects (Resolution No. 2020-096). The 2020 update to the program of projects
covered fiscal years 2020-21 through 2024-25. The San Diego Association of Governments
Board of Directors approves the TransNet Program of Projects as an element of the Regional
Transportation Improvement Program.
As part of the FY 2021-22 Capital Improvement Program development process, staff has
identified several transportation projects which need either additional TransNet funding or a
change of schedule of TransNet funding allocations. Staff has also identified two transportation
projects that need to be added to the Carlsbad TransNet Local Street Improvement Program of
Projects. These changes require holding a public hearing and a resolution of the City Council
before they can be submitted to the San Diego Association of Governments for inclusion in the
next 2021 Regional Transportation Improvement Program amendment.
TransNet Local Funds are programmed for a variety of projects, including Americans with
Disabilities Act improvements, various roadway improvements, pavement management
program, traffic signal improvements and roadway lighting projects.
The city program of projects also includes various capacity-increasing roadway projects along
regionally significant arterial roadways, regardless of the funding source. Some of these
projects are funded by city funds, such as traffic impact fees or funding from adjacent private
development. As part of the amendment to the 2020 Program of Projects, staff propose adding
the following new projects to the city’s 2020 program:
•Barrio lighting
•Valley Street and Magnolia Avenue complete streets
As noted in the TransNet Extension Ordinance, no more than 30% of cumulative TransNet
revenues shall be spent on local street and road maintenance projects.

The proposed amendment to the Carlsbad Program of Projects for fiscal years 2020-21 through
2024-25 is provided as Exhibit 1, Attachment A.

Staff provide the following options for the City Council’s consideration:
1. Adopt a resolution approving an amendment to the Carlsbad TransNet Local Street
Improvement Program of Projects for fiscal years 2020-21 through 2024-25

Staff recommends option 1 for the City Council’s approval, adopting a resolution approving an
amendment to the Carlsbad TransNet Local Street Improvement Program of Projects for fiscal
years 2020-21 through 2024-25.
Fiscal Analysis
Approval of the amendment to the Regional Transportation Improvement Program ensures
eligibility for funding and programs the funding for future obligations.
Inclusion in the program, however, is not a guarantee that projects will receive the stated
funding. The amounts shown in Attachment A to the resolution (Exhibit 1) are the best available
estimates of project costs and anticipated funding. The city is not obligated to proceed with a
project included in the program if funding falls short or is not available.
Sufficient TransNet funds are available to the city for the funding allocations. No changes to the
2020 TransNet Program are proposed in FY 2020-21.
Next Steps
Upon approval by the City Council, staff will submit the city’s amended program of projects and
signed resolution to the San Diego Association of Governments for inclusion in the 2021
Regional Transportation Improvement Program amendment by the due date of June 4, 2021.
This formal amendment is expected to be approved by the association’s board of directors on
July 23, 2021.

Environmental Evaluation (CEQA)
The project is exempt from the California Environmental Quality Act under Guidelines Section
15276(a) which states that the act does not apply to the development or adoption of a regional
transportation improvement program. However, individual projects developed in accordance
with such programs shall remain subject to the act.
Public Notification
Public notification for this item was published in accordance with the Ralph M. Brown Act and,
because this item is a public hearing, notice was posted 10 days before the scheduled meeting
date.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CARLSBAD,
CALIFORNIA, APPROVING AN AMENDMENT TO THE CARLSBAD TRANSNET
LOCAL STREET IMPROVEMENT PROGRAM OF PROJECTS FOR FISCAL YEARS
2020-21 THROUGH 2024-25, AS PROGRAMMED IN THE 2021 SAN DIEGO
ASSOCIATION OF GOVERNMENTS (SANDAG) REGIONAL TRANSPORTATION
IMPROVEMENT PROGRAM (RTIP)
WHEREAS, on Nov. 4, 2004, the voters of San Diego County approved the San Diego
Transportation Improvement Program Ordinance and Expenditure Plan (TransNet Extension
Ordinance); and
WHEREAS, the TransNet Extension Ordinance provides that the SANDAG Board of Directors,
sitting as the San Diego County Regional Transportation Commission, shall approve on a biennial basis
a multi-year program of projects submitted by local jurisdictions identifying those transportation
projects eligible to use transportation sales tax (TransNet) funds; and
WHEREAS, the City of Carlsbad was provided with an estimate of annual TransNet local street
improvement revenues for fiscal years 2020-21 through 2024-25; and
WHEREAS, on June 2, 2020, the City Council approved its 2020 TransNet Local Street
Improvement Program of Projects (Resolution No. 2020-096); and
WHEREAS, the City Council desires to revise the city's Program of Projects; and
WHEREAS, the City Council held a noticed public hearing with an agenda item that clearly
identified the proposed amendments prior to approval of the projects identified in Attachment A, in
accordance with Section 5(A) of the TransNet Extension Ordinance and Rule 7 of SANDAG Board Policy
No. 31; and
WHEREAS, the city planner has determined that the project is exempt from the California
Environmental Quality Act (CEQA) per State CEQA Guidelines Section 15276(a) — Transportation
Improvement and Congestion Management Programs; and that no exception to the exemption as set
forth in CEQA Guidelines section 15300.2 applies.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Carlsbad, California, as
follows:
1. That the above recitations are true and correct.

2.That the City of Carlsbad requests that SANDAG make the changes shown in Attachment
A to its 2020 Program of Projects (the "Amendment") as programmed in the 2021 RTIP.
3.That pursuant to Section 2(C)(1) of the TransNet Extension Ordinance, the City Council
certifies that no more than 30% of its annual revenues shall be spent on local street and
road maintenance-related projects as a result of the Amendment.
4.That pursuant to Section 4(E)(3) of the TransNet Extension Ordinance, the City Council
certifies that all new or changed projects, or major reconstruction projects included in
the Amendment and funded by TransNet revenues shall accommodate travel by
pedestrians and bicyclists, and that any exception to this requirement permitted under
the Ordinance and proposed was clearly noticed as part of the City Council's public
hearing process for the Amendment.
5.That the City Council does hereby certify that all applicable provisions of the TransNet
Extension Ordinance and SANDAG Board Policy No. 31 have been met.
6.That the City Council continues to agree to indemnify, hold harmless, and defend
SANDAG, the San Diego County Regional Transportation Commission, and all officers
and employees thereof against all causes of action or claims related to the City of
Carlsbad's TransNet funded projects.
PASSED, APPROVED AND ADOPTED at a Regular Meeting of the City Council of the City of
Carlsbad on the 11th day of May, 2021, by the following vote, to wit:

NOTICE IS HEREBY GIVEN that the City Council of the City of Carlsbad will hold a public hearing at the
Council Chamber, 1200 Carlsbad Village Drive, Carlsbad, California, at 3:00 p.m. on Tues., May 11, 2021, to
consider approving an amendment to the Carlsbad Transnet Local Street Improvement Program of Projects
for fiscal years 2021/22 through 2024/25 for inclusion in SANDAG's Regional Transportation Improvement
Program (RTIP). The amendment to the Carlsbad Program of Projects consists of the following changes:
Two new transportation projects are proposed to be added to the Carlsbad Transnet Local Street
Improvement Program of Projects in order to utilize TransNet Local funds:
•Barrio Lighting — install additional streetlights and pedestrian lighting in the Barrio neighborhood.
•Valley Street and Magnolia Avenue Complete Streets — construct sidewalks, bike paths, green street
features, and underground overhead utilities in the project area.
Ten projects which are already included in the Carlsbad Transnet Local Street Improvement Program of
Projects have funding changes proposed as part of this amendment. These projects are listed below.
The details of the funding changes are included in Attachment A to the resolution for this agenda item. No
changes to 2020 TransNet Program of Projects are proposed for the current fiscal year (FY21). The staff
