Executive Summary Local fire departments are required to perform annual inspections of all public and private schools, hotels, motels, lodging houses and apartment and/or condominium buildings under California Health and Safety Code Sections 13146.2 and 13146.3. In addition, a compliance report for inspections must be provided to its administrating authority each year in accordance with Section 13146.4. This report confirms that all initial annual fire inspections for fiscal year 2020-21 are complete. Discussion Annual fire inspections help mitigate known hazards, reduce community risk and ensure reasonable compliance with the California Fire Code. Inspections review and confirm proper maintenance of fire protection systems, effective egress systems, damage to fire protective construction and sufficient site access to Fire Department personnel. The California Health and Safety Code Section 13146.2 mandates that all hotels, motels and lodging houses are inspected annually by the local fire department. The Carlsbad Fire Department inspected 43 hotels and/or motels totaling 163 buildings within these facilities. The California Health and Safety Code Section 13146.2 mandates that all apartment buildings are inspected annually by the local fire department. An apartment building consists of three or more attached units and excludes all duplex-style buildings. The California Building Code also specifies that condominiums should be considered apartments. The Carlsbad Fire Department inspected 2,396 apartment buildings with three units or greater. June 8, 2021 Item #15 Page 1 of 5 The California Health and Safety Code Section 13146.3 mandates that all public and private schools are inspected annually by the local fire department. The Carlsbad Fire Department inspected 36 school facilities totaling 250 buildings within these facilities. In total, the Fire Department conducted 2,809 mandated inspections during fiscal year 2020-21 and completed initial inspections of all known buildings and structures within the California Health and Safety Code mandate. The acceptance of this compliance report and resolution fulfill the statutory requirements contained in California Health and Safety Code Sections 13146.2, 13146.3 and 13146.4. Options Staff provide the following options for the City Council’s consideration: 1. Do not adopt a resolution accepting a compliance report on the status of all state- mandated annual fire inspections for FY 2020-21 Pro • None identified Con • Noncompliant with California Senate Bill 1205 and California Health and Safety Code 13146.4 Staff recommend Option 1 for the City Council’s approval – adopt a resolution accepting a compliance report on the status of all state-mandated annual fire inspections under California SB 1205 and California Health and Safety Code Section 13146.4. Fiscal Analysis There is no fiscal impact with filing and accepting this report. Next Steps None. Environmental Evaluation (CEQA) This action does not constitute a “project” within the meaning of the California Environmental Quality Act under Public Resources Code section 21065 in that it has no potential to cause either a direct physical change in the environment or a reasonably foreseeable indirect physical change in the environment and therefore does not require environmental review. City Council resolution June 8, 2021 Item #15 Page 2 of 5 RESOLUTION NO. 2021-141 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CARLSBAD, CALIFORNIA, ACCEPTING A REPORT ON THE STATUS OF ALL STATE- MANDATED ANNUAL FIRE INSPECTIONS IN THE CITY OF CARLSBAD IN CONJUNCTION WITH THE CALIFORNIA SENATE BILL 1205 AND THE CALIFORNIA HEALTH AND SAFETY CODE SECTION 13146.4 WHEREAS, California Health & Safety Code Section 13146.4 was added in 2018, and became effective on September 27, 2018; and WHEREAS, California Health & Safety Code Sections 13146.2 and 13146.3 requires all fire departments, including the Carlsbad Fire Department, that provide fire protection services to perform annual inspections in every building used as a public or private school, hotel, motel, lodging house, apartment house, and certain residential care facilities for compliance with building standards, as provided; and WHEREAS, California Health & Safety Code Section 13146.4 requires all fire departments, including the Carlsbad Fire Department, that provide fire protection services to report annually to its administering authority on compliance with Sections 13146.2 and 13146.3; and WHEREAS, the City Council of the City of Carlsbad intends this Resolution to fulfill the requirements of the California Health & Safety Code regarding acknowledgment of the Carlsbad Fire Department's compliance with California Health and Sections 13146.2 and 13146.3. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Carlsbad, California, that said City Council expressly acknowledges the measure of compliance of the Carlsbad Fire Department with California Health and Safety Code Sections 13146.2 and 13146.3 in the area encompassed by the City of Carlsbad, as follows: A. EDUCATIONAL GROUP E OCCUPANCIES: Educational Group E occupancies are generally those public and private schools, used by more than six persons at any one time for educational purposes through the 12th grade. Within the City of Carlsbad, there lie 36 Group E occupancy campuses. June 8, 2021 Item #15 Page 3 of 5 During fiscal year 2020-21, the Carlsbad Fire Department completed the annual inspection of 36 Group E occupancies, with a total building count of 250 structures and/or facilities. This is a compliance rate of 100 percent for this reporting period. B. RESIDENTIAL GROUP R OCCUPANCIES: Residential Group R occupancies, for the purposes of this resolution, are generally those occupancies containing sleeping units, and include hotels, motels, apartments (three units or more), etc. as well as other residential occupancies. Within the City of Carlsbad, there lie 2,559 Group R (and their associated sub-categories) occupancies of this nature. During fiscal year 2020-21, the Carlsbad Fire Department completed the annual inspection of 2,559 Group R occupancies, buildings, structures and/or facilities. This is a compliance rate of 100 percent for this reporting period. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Carlsbad, California, as follows: 1.That the above recitations are true and correct. 2.That this Resolution, and all action taken subsequent hereto in connection herewith, is taken pursuant to the provisions of California Health and Safety Code sections 13146, et seq. (Article 2, State Board of Fire Services). 3.Words used in this Resolution and its subsequent action in connection herewith shall be defined as outlined in said code sections. 4.That the City Council of the City of Carlsbad hereby declares that the City of Carlsbad is compliant with the state-mandated fire inspection requirements contained within California Health and Safety Code Sections 13146.2 and 13146.3. 5.That the City Council of the City of Carlsbad hereby declares that the Fire Department has met its mandatory reporting requirements to the administering agency, as required in California Health and Safety Code section 13146.4.
