PLEDGE OF ALLEGIANCE: Mayor Pro Tern Blackburn led the Pledge of Allegiance. INVOCATION: None. APPROVAL OF MINUTES: None. PRESENTATIONS: Proclamation in Recognition of Earth Month Council Member Bhat-Patel read the proclamation. Senior Program Manager Avecita Jones thanked the City Council and said a few words. PUBLIC REPORT OF ACTION TAKEN IN CLOSED SESSION: None. PUBLIC COMMENT: The following individuals called into the City Council Meeting and voiced their comments for the record: Kelly McCormick thanked City Council for adding a smoke free housing policy to the city's Housing Element Plan. Keith McCormick thanked City Council for adding a smoke free housing policy to the city's Housing Element Plan. Bret Schanzenbach of the Carlsbad Chamber of Commerce invited the City Council to their Green Business Expo event at the Carlsbad Flower Fields on April 21, 2021. Charles Lehr expressed concern over Site 13 being included in the Housing Element Plan. Motion carried, 4/0/1 (Schumacher — Absent). 1.REJECTION OF ALL BIDS RECEIVED FOR THE POINSETTIA COMMUNITY PARK PHASE IV IMPROVEMENTS PROJECT, CIP NO. 4608 —Adoption of Resolution No. 2021-076 rejecting all bids received for the Poinsettia Community Park Phase IV Improvements Project, CIP No. 4608. (Staff contact: Tim Selke, Parks & Recreation) 2.SETTLEMENT OF THE WORKERS' COMPENSATION CLAIMS OF DUNCAN SANCHEZ FOR $60,000 —Adoption of Resolution No. 2021-077 authorizing settlement of the workers' compensation claims of Duncan Sanchez. (Staff contact: Sarah Reiswig and Judy von Kalinowski, Administrative Services) 3.APPROPRIATION OF FUNDS FOR PURCHASE. OF PORTABLE AND SOLAR-POWERED SPEED- FEEDBACK SIGNS - Adoption of Resolution No. 2021-078 authorizing the appropriation from Gas Tax Funds in the amount of $288,000 to solicit bids for purchase of eight portable speed feedback signs and purchase and installation of eight solar-powered speed feedback signs. (Staff contact: John Kim, Public Works) 4.STATE GRANT PROGRAM STANDARD ASSURANCES — Adoption of Resolution No. 2021-079 approving State Grant Program Standard Assurances_ (Staff contact: David Harrison, Fire) ORDINANCES FOR INTRODUCTION: None. ORDINANCE FOR ADOPTION: 5.ADOPTION OF ORDINANCE NOS. CS-394 — ELECTIONS, CS-395 — ELECTION CAMPAIGN DISCLOSURES, AND CS-396 — CAMPAIGN CONTRIBUTION LIMITS — 1) Adoption of Ordinance No. CS-394 amending Carlsbad Municipal Code Title 1, Chapter 1.12 — Elections; and 2)Adoption of Ordinance No. CS-395 amending Carlsbad Municipal Code Title 1, Chapter 1.13 — Election Campaign Disclosures; and 3)Adoption of Ordinance No. CS-396 adding Chapter 1.15 —Campaign Contribution Limits to Title 1 of the Carlsbad Municipal Code. DEPARTMENTAL AND CITY MANAGER REPORTS: 6. 2021 ANNUAL WORK PLANS FOR THE LIBRARY AND CULTURAL ARTS DEPARTMENT'S THREE BOARDS AND COMMISSIONS — 1) Adoption of Resolution No. 2021-080 approving the Library Board of Trustees Work Plan for Fiscal Year 2020-21; and 2)Adoption of Resolution No. 2021-081 approving the Arts Commission Work Plan for Fiscal Year 2020-21; and 3)Adoption of Resolution No. 2021-082 approving the Historic Preservation Commission Work Plan for Fiscal Year 2020-21. (Staff contact: Suzanne Smithson and Richard Schultz, Library & Cultural Arts) City Manager's Recommendation: Adopt the resolutions. Library & Cultural Arts Director Suzanne Smithson, Cultural Arts Manager Richard Schultz and Deputy City Manager Gary. Barberio presented the reports and reviewed a PowerPoint presentation (on file in the Office of the City Clerk). In response to an inquiry from Council Member Bhat-Patel, Library & Cultural Arts Director Smithson explained that the Library Board of Trustees reviews the data compiled in the California Public Library Survey before it is sent to the California State Library. Motion by Mayor Pro Tern Blackburn, seconded by Council Member Bhat-Patel, to adopt Resolution No. 2021-080, Resolution No. 2021-081 and Resolution No. 2021-082. Motion carried, 4/0/1 (Schumacher — Absent). 7. ARTS & CULTURE MASTER PLAN ANNUAL STATUS REPORT— Receive an annual status report on Arts & Culture Master Plan initiatives launched in fiscal year 2019-20 and fiscal year 2020- 21, and consider additional support of initiatives for fiscal year 2021-22. (Staff contact: Richard Schultz, Library & Cultural Arts) City Manager's Recommendation: Receive the report and provide direction as appropriate. April 13, 2021 Carlsbad City Council Regular Meeting Page 4 Library & Cultural Arts Director Suzanne Smithson, Cultural Arts Manager Richard Schultz and Deputy City Manager Gary Barberio presented the report and reviewed a PowerPoint presentation (on file in the Office of the City Clerk). In response to an inquiry from Council Member Acosta, Cultural Arts Manager Schultz explained that the mobile arts vehicle would allow the library to bring events to larger outdoor spaces. In response to an inquiry from Mayor Hall, City Manager Scott Chadwick explained that purchasing the mobile arts vehicle would be a substantial expense and would cost approximately $500,000. Council received the report. Motion by Mayor Pro Tern Blackburn, seconded by Council Member Bhat-Patel, to support Arts & Culture Master Plan Initiative Nos. 1, 2, and 3 only. Motion carried, 4/0/1 (Schumacher — Absent). 8. CLIMATE ACTION PLAN ANNUAL REPORT — Adoption of Resolution No. 2021-083 accepting the Climate Action Plan Annual Report for reporting period 4, July 2019 to December 2020. (Staff contact: Michael Grim, Public Works) City Manager's Recommendation: Adopt the resolution. Environmental Manager James Wood and Senior Program Manager Mike Grim presented the report and reviewed a PowerPoint presentation (on file in the Office of the City Clerk). The following individuals called into the City Council Meeting and voiced their comments for the record: Paige DeCino spoke in support of the Climate Action Plan. Lynda Daniels spoke in support of the Climate Action Plan and urged the City Council to adopt more electric based construction and housing development codes. In response to an inquiry from Council Member Bhat-Patel, Environmental Manager Wood explained that a Sustainable Materials Management Implementation Plan is currently being developed that includes state requirements and potential City Council desires such as bans on single use plastics. In response to an inquiry from Council Member Acosta, Environmental Manager Wood explained that the Sustainable Materials Management Implementation Plan is expected to come to the City Council at the end of Summer 2021. April 13, 2021 Carlsbad City Council Regular Meeting Page 5 In response to an inquiry from Council Member Acosta, Senior Program Manager Grim explained that while the Climate Action Plan (CAP) is not a comprehensively updated document, it is constantly updated with analysis of what other cities are doing and projections from current climate actions. In response to an inquiry from Mayor Hall, Environmental Manager Wood explained that if the city could show reduced emissions with their fleet vehicles, they could calculate the credit for on-road transportation. Motion by Mayor Pro Tern Blackburn, seconded by Council Member Bhat-Patel, to adopt Resolution No. 2021-083. Motion carried, 4/0/1 (Schumacher — Absent). 9. CLEAN ENERGY ALLIANCE PRODUCT SELECTION FOR CITY OF CARLSBAD, CARLSBAD PUBLIC FINANCING AUTHORITY, AND CARLSBAD MUNICIPAL WATER DISTRICT ELECTRIC SERVICE ACCOUNTS — 1) Adoption of City of Carlsbad Resolution No. 2021-084 selecting the Clean Energy Alliance Power Supply Product for City of Carlsbad Electric Service Accounts; and 2)Adoption of Carlsbad Public Financing Authority Resolution No. 84 selecting the Clean Energy Alliance Power Supply Product for Carlsbad Public Financing Authority Electric Service accounts; and 3)Adoption of Carlsbad Municipal Water District Resolution No. 1650 selecting the Clean Energy Alliance Power Supply Product for Carlsbad Municipal Water District Electric Service Accounts, selected from the following options: 1) Clean Impact — 50% power supply from renewable energy sources; 2) Clean Impact Plus — 50% renewable and 75% carbon-free energy sources; and 3) Green Impact —100% of power supply from renewable energy sources. (Staff contact: Jason Haber, City Manager Department) City Manager's Recommendation: Select the energy option and adopt the resolutions. Intergovernmental Affairs Director Jason Haber presented the report and reviewed a PowerPoint presentation (on file in the Office of the City Clerk). In response to an inquiry from Council Member Bhat-Patel, Intergovernmental Affairs Director Haber explained that opting out of service with the Clean Energy Alliance (CEA) back to San Diego Gas & Electric (SDGE) can occur at any time by sending a notice to the CEA. He also added that the power supply option can be changed at any time as well. Motion by Council Member Bhat-Patel, seconded by Mayor Pro Tem Blackburn, to adopt Resolution No. 2021-084, Carlsbad Public Financing Authority Resolution No. 84 and Carlsbad Municipal Water District Resolution No. 1650 selecting the Clean Impact Plus option. April 13, 2021 Carlsbad City Council Regular Meeting Page 6 PUBLIC COMMENT (CONTINUED): The following individuals called into the City Council Meeting and voiced their comments for the record: John Kuznik thanked the City Council for making Site 13 a low priority in the Housing Element Plan and suggested the North County Transit District's properties in Carlsbad Village and Poinsettia be redeveloped to include high density affordable housing. Sarah Helmy spoke against the inclusion of Site 13 in the Housing Element Plan. COUNCIL REPORTS AND COMMENTS: Mayor Hall and the City Council Members reported on activities and meetings of some committees and subcommittees of which they are members. CITY MANAGER COMMENTS: None.
