PLEDGE OF ALLEGIANCE: Mayor Pro Tem Blackburn led the Pledge of Allegiance. ANNOUNCEMENT OF CONCURRENT MEETINGS: Mayor Hall announced the City Council is serving as the Carlsbad Municipal Water District on Consent Item No. 4. INVOCATION: None. PUBLIC REPORT OF ACTION TAKEN IN CLOSED SESSION: City Attorney Celia Brewer announced there was no reportable action. APPROVAL OF MINUTES: None. PRESENTATIONS: Proclamation in Recognition of Arbor Week Congressional Update from U.S. Congressman Mike Levin Congressional Update from U.S. Congressman Mike Levin U.S. Congressman Levin spoke regarding the American Rescue Plan and American Jobs Act. Proclamation in Recognition of Arbor Week Council Member Schumacher read the proclamation. Parks Services Manager Tim Selke said a few words. ANNOUNCEMENTS: Mayor Hall announced City Council Members will be participating in a Special City Council meeting on Tuesday, April 27 at 10:00 a.m. and it will be held virtually. PUBLIC COMMENT: The following individuals called into the City Council Meeting and voiced their comment for the record: Holly Hamel spoke regarding her concerns with homelessness and public safety in the city. Mary Lucid spoke regarding the Senior Commission and Senior Center. Kirsten Ludwig spoke regarding her concerns with homelessness and public safety in the city, particularly at Pine Park. Charles Lehr, representing Protect Aviara, expressed his opposition to rezoning Zone 13. Paul Marsteller spoke regarding his concerns with homelessness and public safety in the city. Mayor Pro Tem Blackburn requested City Manager Chadwick to have the Homelessness Outreach Team contact those speakers who spoke regarding homelessness. CONSENT CALENDAR: Motion by Mayor Pro Tem Blackburn, seconded by Council Member Bhat-Patel, to approve Consent Calendar Item Nos. 1 through 4. Motion carried unanimously, 5/0. 1. ADVERTISE FOR BIDS FOR THE FISCAL YEAR 2020-21 CONCRETE REPAIR PROJECT, CIP NO. 6013-21 – Adoption of Resolution No. 2021-085 approving the plans and specifications and authorizing the city clerk to advertise for bids for the Fiscal Year 2020-21 Concrete Repair Project, CIP No. 6013-21. (Staff contact: Scott Lyle, Public Works) 2. AGREEMENT FOR JANITORIAL SERVICES FOR CITYWIDE FACILITY CUSTODIAL SERVICES AND AGREEMENT FOR PARKS RESTROOM CUSTODIAL SERVICES – 1) Adoption of Resolution No. 2021-086 authorizing execution of an agreement for citywide facility custodial services to Universal Building Maintenance, LLC, D.B.A. “Allied Universal Janitorial Services” in an amount not to exceed $1,222,228 over a two-year term; and 2) Adoption of Resolution No. 2021-087 authorizing execution of an agreement for parks restroom custodial services to MEK Enterprises, Inc., in an amount not to exceed $1,315,844 over a two-year term. (Staff contact: Brian Bacardi, Public Works) 3. AWARD OF CONTRACT TO BLUE PACIFIC ENGINEERING CONSTRUCTION, INC. FOR CONSTRUCTION OF THE TAMARACK AVENUE AND VALLEY STREET PEDESTRIAN IMPROVEMENTS PROJECT, CIP NO. 6335 – Adoption of Resolution No. 2021-088 accepting bids and awarding a contract to Blue Pacific Engineering Construction, Inc. for construction of the Tamarack Avenue and Valley Street Pedestrian Improvements, CIP No. 6335, in an amount not to exceed $358,391, and authorizing additional appropriation in an amount not to exceed $62,109 for the project. (Staff contact: John Kim, Public Works) 4. AWARD OF MASTER PURCHASE AGREEMENT TO ZENNER USA, INC. FOR PURCHASE OF WATER METERS – Adoption of Carlsbad Municipal Water District Resolution No. 1651 accepting bids and awarding a master purchase agreement to Zenner USA, Inc. for purchase of domestic service cold-water meters in an amount not to exceed $250,000. April 20, 2021 Carlsbad City Council Regular Meeting Page 3 PUBLIC HEARINGS: 5. 2021 HAZARD REDUCTION PROGRAM – ABATEMENT – Adoption of Resolution No. 2021-089 authorizing abatement of weeds and rubbish upon private property in the City of Carlsbad under the terms of the City of Carlsbad’s Hazard Reduction Program and scheduling a public hearing on July 27, 2021 to consider the final hazard reduction cost report. (Staff contact: Randy Metz, Fire) City Manager’s Recommendation: Take public input, close the public hearing and adopt the resolution. Fire Marshal Randy Metz presented the report and reviewed a PowerPoint presentation (on file in the Office of the City Clerk). Mayor Hall opened the duly noticed Public Hearing at 3:31 p.m. City Clerk Barbara Engleson reported there were no speakers but that the City Clerk’s Office did receive one written protest. Hearing no one wishing to speak, Mayor Hall closed the duly noticed Public Hearing at 3:31 p.m. Motion by Mayor Pro Tem Blackburn, seconded by Council Member Bhat-Patel, to approve Resolution No. 2021-089. Motion carried unanimously, 5/0. DEPARTMENTAL AND CITY MANAGER REPORTS: 6. NEGOTIATIONS TO RELOCATE SDG&E’S NORTH COAST SERVICE CENTER TO THE SHOPPES AT CARLSBAD CITY-OWNED PARKING LOT PROPERTIES – Adoption of Resolution No. 2021-090 authorizing staff to work with Brookfield Properties, NRG Energy, and San Diego Gas & Electric to relocate the SDG&E North Coast Service Center from its current location near the northeast corner of Carlsbad Boulevard and Cannon Road, to a portion of the city-owned parking lot properties at The Shoppes at Carlsbad, and appropriate funds in an amount not to exceed $100,000 to retain the professional services of Kosmont Companies. (Staff contact: Gary Barberio, Community Services and Celia Brewer, City Attorney Department) City Manager’s Recommendation: Adopt the resolution. Senior Vice President of Asset Management Judith Lagano spoke in support of staff’s recommendation. NRG Energy Inc. Senior Director of Real Estate Development Mark Rohrlick spoke in support of staff’s recommendation. San Diego Gas & Electric (SDG&E) Public Affairs Manager Joe Gabaldon spoke in support of staff’s recommendation. Motion by Council Member Schumacher, seconded by Mayor Pro Tem Blackburn, to approve Resolution No. 2021-090. Motion carried unanimously, 5/0. 7. MAYORAL APPOINTMENT OF THREE MEMBERS TO THE HISTORIC PRESERVATION COMMISSION – 1) Adoption of Resolution No. 2021-091 appointing one member to the Historic Preservation Commission; 2) Adoption of Resolution No. 2021-092 appointing one member to the Historic Preservation Commission; and 3) Adoption of Resolution No. 2021-093 appointing one member to the Historic Preservation Commission. (Staff contact: Tammy McMinn, City Clerk Department) City Manager’s Recommendation: Adopt the resolutions. The following individuals called into the City Council Meeting and voiced their comment for the record regarding their interest and qualifications to serve on the Historic Preservation Commission: John May; Raúl Díaz; Don Lowe; Patty Schreibman. Motion by Mayor Hall to approve Resolution No. 2021-091 appointing Raúl Díaz. Motion carried unanimously, 5/0. Motion by Mayor Hall to approve Resolution No. 2021-092 appointing Patty Schreibman. Motion carried unanimously, 5/0. Motion by Mayor Hall to approve Resolution No. 2021-093 reappointing Robert Prosser. Motion carried unanimously, 5/0. PUBLIC COMMENT: The following individuals called into the City Council Meeting and voiced their comment for the record: Clean Energy Alliance (CEA) Interim CEO Barbara Boswell spoke regarding CEA’s enrollment program plan options. Ellie Arkans requested for City Council to agendize and vote on restarting in-person meetings at City Hall. April 20, 2021 Carlsbad City Council Regular Meeting Page 5 Kelly Stern requested a municipal code change for parking permits to non-residents. She also expressed her concerns with increased crimes committed by homeless hotel voucher recipients and city resources used against these crimes. Michaelene Heitchew spoke regarding her concern with safety due to an explosion and other legal issues at the property at 3985 Highland Drive. Scott Sterner, representing Republic Services, thanked the city for selecting Republic Services and their excitement to begin servicing the city. COUNCIL REPORTS AND COMMENTS: Mayor Hall and the City Council Members reported on activities and meetings of some committees and subcommittees of which they are members.
