SUBJECT: CD 2021-0010 (DEV2016-0015) -VIASAT CAMPUS FENCING EAST CAMPUS PHASE 5 AND 6
The City Planner has completed a review of your application for a Consistency Determination, CD 2021-
0010 (APN 213-260-12-00), which is a modification to Major Site Development Plan SDP 16-17 (related
permits include MP 178K, PUD 16-05, SUP 16-01, and MS 16-04) approved pursuant to Planning
Commission Resolution No. 7197. and Minor Site Development Plan SDP 2018-0008 approved
administratively per the approval letter dated December 26, 2018.
After careful consideration of the request, the City Planner has determined that the request meets all of
the findings below and APPROVES this request. The proposed modifications include:
• A six-foot chain link fence with dark brown slats to surround and screen the undeveloped
portion of the project site.
In order for a Discretionary Permit Consistency Determination to be approved, all of the following findings
must be made:
1) No project condition, feature, facility or amenity is changed or deleted that had been considered
essential to the project's design, quality, safety or function in that the fence is proposed for
aesthetic purposes to screen the undeveloped portion of the site. No project condition, feature,
facility or amenity is proposed to be changed or deleted as part of this proposal.
2} The request represents an upgrade in overall design features and or materials and improves upan
the project's compatibility with the surrounding neighborhood in that the fence will screen the
vacant lot so that the community does not see a vacant lot as viewed from the street.
3} The proposed revision does not change the density or boundary of the subject property.
4) The proposed revision does not involve the addition of a new land use not shown on the original
permit.
5) The proposed revision does not rearrange the major land uses within the development in that the
site changes do not impact the layout of the buildings.

6} The proposed revision does not create changes of greater thon ten percent provided that
compliance will be maintained with the applicable development standards of the Carlsbad
Murii<;ipal Code in that the fence is temporary, does not create any changes to the site or
approved structures that would result in changes of greater than ten percent, and is to remain
on the site until the site is developed.
7) The proposed change will not result in any significant environmental impact, and/or require
additional mitigation.
8} The proposed change would not result in any health, safety or welfare impacts.
9) There were not ony major issues or controversies associated with the original project which would
be exacerbated with the proposed change.
10) The proposed change would not be readily discernable to the decision makers as being
substantially different /ram the project as originally approved in that the fence is temporary, is
provided for aesthetic purposes, and does not create any changes to the ,site ar approved
structures.
Therefore, the City Planner has determined that the application qualifies for a consistency determination
with the approved permits and approves the changes to the project based on Planning Division
Administrative Policy No. 35.
