CALL: Hall, Blackburn, Acosta, Bhat-Patel, Schumacher. ANNOUNCEMENT OF CONCURRENT MEETINGS: None. PLEDGE OF ALLEGIANCE: Mayor Pro Tern Blackburn led the Pledge of Allegiance. INVOCATION: None. APPROVAL OF MINUTES: None. PRESENTATIONS: Proclamation in Recognition of Public Works Week Council Member Schumacher presented the proclamation to Deputy City Manager. Paz Gomez and said a few words. Deputy City Manager Gomez also said a few words. Proclamation in Recognition of Building Safety Month Council Member Acosta presented the proclamation to Building & Code Enforcement Manager Jason Pasiut and said a few words. Building & Code Enforcement Manager Pasiut also said a few words. Acceptance of Donation from Carlsbad Library & Arts Foundation Library & Cultural Arts Director Suzanne Smithson accepted the donation from the Carlsbad Library & Arts Foundation President Gita Nassiri and said a few words. Library & Arts Foundation President Nassiri also said a few words. PUBLIC REPORT OF ACTION TAKEN IN CLOSED SESSION: None. PUBLIC COMMENT: The following individuals called into the City Council Meeting and voiced their comments for the record: Charles Lehr recommended that the City Council make a minute motion to remove Site 13 from the Housing Element Plan. Mary Lucid expressed her displeasure with the direction of the Carlsbad Senior Center. She recommended that the City of Carlsbad hire a consultant to help with redeveloping the Senior Center. She also recommended that the City of Carlsbad hire a full-time Senior Center Manager and make plans to build another Senior Center in South Carlsbad. Motion carried unanimously, 5/0. 1. ANNUAL LEVY OF ASSESSMENTS WITHIN STREET LIGHTING AND LANDSCAPING DISTRICT NO. 1 SPECIAL ASSESSMENT DISTRICT — Adoption of Resolution No. 2021-115 initiating the proceedings, approving the preliminary Engineer's Report for fiscal year 2021-22 and setting a public hearing for July 13, 2021 for the Annual Levy of Assessments within Lighting and Landscaping District No. 1, a Special Assessment District. (Staff contact: Jason Rosado, Administrative Services Department) 2. ANNUAL LEVY OF ASSESSMENTS WITHIN STREET LIGHTING AND LANDSCAPING DISTRICT NO. 2 SPECIAL ASSESSMENT DISTRICT — Adoption of Resolution No. 2021-116 initiating the proceedings, approving the preliminary Engineer's Report for fiscal year 2021-22 and setting a public hearing for July 13, 2021 for the Annual Levy of Assessments within Lighting and Landscaping District No. 2, a Special Assessment District. SETTLEMENT OF THE WORKERS' COMPENSATION CLAIMS OF ARTHUR VIERA — Adoption of Resolution No. 2021-119 authorizing settlement of the workers' compensation claims of Arthur Viera. ACCEPTANCE OF A DONATION FROM THE CARLSBAD LIBRARY & ARTS FOUNDATION — Adoption of Resolution No. 2021-120 accepting a donation of $157,620 from the Carlsbad Library & Arts Foundation to the City of Carlsbad's Library & Cultural Arts Department. APPROVE FISCAL YEAR 2021-22 ARTS & CULTURE MASTER PLAN INITIATIVES — Adoption of Resolution No. 2021-121 approving three additional Arts & Culture Master Plan initiatives in FY 2021-22. PUBLIC HEARINGS: None. DEPARTMENTAL AND CITY MANAGER REPORTS: 8. FISCAL YEAR 2021-22 PRELIMINARY BUDGET— 1) Receive a report and set a public hearing of June 8, 2021 for adoption of the Fiscal Year 2021-22 Operating Budget, Capital Improvement Program and Strategic Digital Transformation Investment Program and adoption of the Master Fee Schedule; and 2) Adoption of Resolution No. 2021-122 approving the appropriation of Genera! Fund reserves in fiscal year 2020-21 to pay down $10 million of the city's existing pension liability to the California Public Employees Retirement System (CALPERS), and the appropriation and transfer of $3.5 million from General Fund reserves to the Infrastructure Replacement Fund. (Staff contact: Laura Rocha and Ryan Green, Administrative Services) City Manager's Recommendation: Receive the report, set the public hearing and adopt the resolution. Deputy City Manager Laura Rocha, City Manager Scott Chadwick, Finance Director Ryan Green, Fire Chief Michael Calderwood, Assistant Police Chief Mickey Williams, Deputy City Manager Paz Gomez, Deputy City Manager Gary Barberio, Assistant City Manager Geoff Patnoe and IT Director Maria Callander presented the report and reviewed a PowerPoint presentation (on file in the Office of the City Clerk). Council received the report. Mayor Hall declared a recess at 5:30 p.m. Mayor Hall reconvened the meeting at 5:40 p.m. The following individual called into the City Council Meeting and voiced their comment for the record: Senior Public Policy Advisor of the Building Industry Association of San Diego Michael McSweeney requested more timely notification of changes to fees or costs related to the building industry association. In response to an inquiry from Mayor Hall, Deputy City Manager Barberio explained that the growth management standard for the Fire Department is continuing to be met but that it is different than the standard of coverage. In response to an inquiry from Mayor Hall, Finance Director Green explained that in this budget there are 24.5 new full-time employee positions approved. May 18, 2021 Carlsbad City Council Regular Meeting Page 4 In response to an inquiry from Mayor Hall, Deputy City Manager Rocha explained that in the fiscal year 2019-2020 budget there were 41 employee positions approved and that in the fiscal year 2020-2021 budget there were no new positions approved. In response to an inquiry from Mayor Hall, City Manager Chadwick explained that at the June 8, 2021 City Council meeting, staff can bring back the funding percentages that mirror the contributions that have been made to California Public Employees Retirement Systems (CalPERS) by the City of Carlsbad. Motion by Council Member Bhat-Patel, seconded by Council Member Acosta to divert $150,000 to the City Manager to meet the diversity, equity & inclusion City Council goals. In response to an inquiry from Mayor Hall, City Manager Chadwick explained that although one of the City Council's goals was to create a staff position to lead diversity, equity and inclusion in the City of Carlsbad organization, staff did not include funding for the position in this budget. In response to an inquiry from Council Member Bhat-Patel, City Manager Chadwick explained that staff can return with a memo to the City Council at the June 8, 2021 City Council meeting with an appropriate expense of creating the position. Substitute Motion by Council -Member Acosta, seconded by Council Member Bhat-Patel, directing the City Manager to return with a report at the June 8, 2021 City Council Meeting regarding options related to the diversity, equity, and inclusion City Council goal including funding requests and a status report on the Diversity, Equity, & Inclusion Committee that includes what is being done now and what is needed going forward. Motion carried unanimously, 5/0. Motion by Mayor Pro Tem Blackburn, seconded by Council Member Bhat-Patel, to receive the report and set the public hearing date to June 8, 2021. Motion carried unanimously, 5/0. Motion by Mayor Pro Tem Blackburn, seconded by Council Member Bhat-Patel, to adopt Resolution No. 2021-122. Motion carried, 4/1 (Hall — No). 9. COST OF SERVICE STUDY AND MASTER FEE SCHEDULE UPDATE — Receive a report with staff recommendations for fee updates based on the results of the Master Fee Schedule Cost of Service Study and provide guidance to staff for how to proceed. (Staff contact: Laura Rocha and Ryan Green, Administrative Services) City Manager's Recommendation: Receive the report and provide direction as appropriate. Finance Director Ryan Green and NBS Director Nicole Kissam presented the report and reviewed a PowerPoint presentation (on file in the Office of the City Clerk). In response to an inquiry by Mayor Pro Tern Blackburn, NBS Director Kissam explained that recovered police fees are mainly from processing police records. In response to an inquiry by Council Member Acosta, NBS Director Kissam explained the phased in, three year approach to the 10% fee increase is conservative and that many other organizations have been raising their rates as normal. Motion by Mayor Pro Tern Blackburn, seconded by _Council Member Bhat-Patel, to select Option No. 1 to implement updated fee structures and increase fees in line with staff recommendations. Motion carried unanimously, 5/0. In response to an inquiry from Council Member Schumacher, Finance Director Green explained that this item is a stepping stone to forming a policy to bring to the Carlsbad Municipal Code and City Council Policy Update Subcommittee for further updates to then bring back to the City Council for final approval. 10. CITY COUNCIL REGIONAL COMMITTEE ASSIGNMENT TO THE NORTH -COUNTY DISPATCH JOINT POWERS AUTHORITY — Adoption of Resolution No. 2021-123 confirming the mayoral appointment for the primary member to the North County Dispatch Joint Powers Authority. (Staff contact: Faviola Medina, City Clerk Services Department) City Manager's Recommendation: Adopt the resolution. Mayor Pro Tern Blackburn explained that he cannot continue attending the North County Dispatch Powers Authority meetings due to a scheduling conflict and is recommending that another Council Member be appointed to replace him. Motion by Mayor Hall, seconded by Mayor Pro Tern Blackburn, to adopt Resolution No. 2021- 123 appointing Council Member Acosta. Motion carried unanimously, 5/0. COUNCIL REPORTS AND COMMENTS: Mayor Hall and the City Council Members reported on activities and meetings of some committees and subcommittees of which they are members. CITY MANAGER COMMENTS: None.
