Motion carried unanimously, 5/0. This item was pulled for discussion by a member of the public. 1. ACCEPTANCE OF A DONATION FROM THE CARLSBAD FRIENDS OF THE ARTS -Adoption of a resolution accepting a donation of $35,000 from the Carlsbad Friends of the Arts to the City of Carlsbad's Library & Cultural Arts Department. (Staff contact: Richard Schultz, Library & Cultural Arts) 2. AGREEMENT WITH SIEMENS MOBILITY, INC. FOR CITYWIDE TRAFFIC SIGNAL MAINTENANCE AND OPERATIONS SERVICES -Adoption of Resolution No. 2021-153 authorizing execution of an agreement with Siemens Mobility, Inc. to perform citywide traffic signal maintenance and operations services in an amount not to exceed $1,054,786 per year during the initial two- year term of the agreement. YARROW DRIVE SINKHOLE AND WASTEWATER EMERGENCY REPAIR-Adoption of Resolution No. 2021-154 authorizing the City Manager <?r designee to approve a reimbursement payment to the City of Vista for the City of Carlsbad's portion of the costs for the Yarrow Drive sinkhole emergency repair in an amount not to exceed $295,061. AWARD OF CONTRACT TO DUDEK FOR THE EL FUERTE AND MAERKLE MOTORIZED VALVES PROJECT, CIP NOS. 5050, 5009 and 5007 -Adoption of Carlsbad Municipal Water District Board Resolution No. 1658 authorizing execution of a professional services agreement with Dudek, a California corporation for engineering design services of the El Fuerte and Maerkle Motorized Valves Project, CIP Project Nos. 5050, 5009 and 5007, in an amount not to exceed $295,505. FOR CONSTRUCTION OF THE FISCAL YEAR 2020- 21 CONCRETE REPAIR PROJECT, CIP NO. 6013-21 -Adoption of Resolution No. 2021-155 accepting bids and awarding a contract to A.B . Hashmi, Inc., for construction of the fiscal year 2020-21 Concrete Repair, CIP Project No. 6013-21, in an amount not to exceed $249,679. Council Member Acosta thanked the community for making donations to support the arts in the City of Carlsbad. Motion by Mayor Pro Tern Blackburn, seconded by Council Member Bhat-Patel, to adopt Resolution No. 2021-152. Motion carried unanimously, 5/0. ORDINANCES FOR INTRODUCTION: None. ORDINANCE FOR ADOPTION: None. PUBLIC HEARINGS: 6. LEVY OF ANNUAL ASSESSMENT FOR CARLSBAD TOURISM BUSINESS IMPROVEMENT DISTRICT FOR FISCAL YEAR 2021-22 -Adoption of Resolution No. 2021-156 confirming the advisory board's report and levying an assessment for fiscal year 2021-22 for the Carlsbad Tourism Business Improvement District. (Staff contact: Cheryl Gerhardt, Finance) City Manager's Recommendation: Take public input, close the public hearing and adopt the resolution. Finance Manager Cheryl Gerhardt presented the report and reviewed a PowerPoint presentation (on file in the Office of the City Clerk). Mayor Hall opened the duly noticed Public Hearing at 3:19 p.m. Hearing no one else wishing to speak, Mayor Hall closed the duly noticed Public Hearing at 3:19 p.m. Motion by Mayor Pro Tern Blackburn, seconded by Council Member Bhat-Patel, to adopt Resolution No. 2021-156. LEVY OF ANNUAL ASSESSMENT FOR CARLSBAD GOLF LODGING BUSINESS IMPROVEMENT DISTRICT FOR FISCAL YEAR 2021-22 -Adoption of Resolution No. 2021-157 confirming the advisory board's report and levying an assessment for fiscal year 2021-22 for the Carlsbad Golf Lodging Business Improvement District. Motion carried unanimously, 5/0. DEPARTMENTAL AND CITY MANAGER REPORTS: 8. COVID-19 ACTIONS AND EXPENDITURES REPORT AND DISCUSSION REGARDING RESUMING IN-PERSON PUBLIC MEETINGS -1) Receive a report on recent actions and expenditures related to the city's response to the COVID-19 pandemic and provide direction as appropriate; and 2) Discuss timeline and options for resuming in-person public meetings. (Staff contact: Geoff Patnoe, City Manager Department) City Manager's Recommendation: Receive the report and discuss the timeline and options for resuming in-person public meetings. Chief Innovation Officer David Graham, Police Captain Pete Pascual, Homeless Response Manager Holly Nelson, Library & Cultural Arts Director Suzanne Smithson, Parks & Recreation Director Kyle Lancaster and Community & Economic Development Director Jeff Murphy presented the report and reviewed a PowerPoint presentation (on file in the Office of the City Clerk). Council received the report. City Manager Scott Chadwick briefly reviewed staff recommendations for resuming in-person public meetings. In response to an inquiry from Mayor Hall, City Manager Chadwick explained that other than the re-noticing of the two mentioned public hearings he did not foresee any other reason to not return to in-person City Council meetings in July. Motion by Mayor Hall, seconded by Mayor Pro Tern Blackburn, to resume in-person City Council Meetings in the Council Chamber on July 13, 2021, continue with virtual meetings for City Council Workshops through Sept. 30, 2021, and reevaluate at the end of Sept. 2021 regarding any changes in legislation. Motion carried unanimously, 5/0. Motion carried unanimously, 5/0. 9. DEAD HERITAGE TREE -DISPOSITION OF TREE STUMP AND BURL ON GRAND AVENUE - Adoption of a resolution directing staff to remove the stump and burl of a dead heritage street tree from the public right of way on the south side of grand avenue immediately east of Jefferson Street. (Staff contact: Kyle Lancaster, Parks & Recreation) City Manager's Recommendation: Adopt the resolution. Parks & Recreation Director Kyle Lancaster presented the report and reviewed a PowerPoint presentation (on file in the Office of the City Clerk). In response to an inquiry from Council Member Schumacher, Parks & Recreation Director Lancaster explained that staff originally did not consider removing the stump of the tree and repurposing it to become something else such as a bench. He also added that due to the size of the tree stump it would be difficult to remove it in one piece. In response to an inquiry from Council Member Schumacher, Parks & Recreation Director Lancaster explained that staff would need additional direction from the City Council if they were to want the tree stump to become an art piece. He added that there would likely be an additional cost to the project and that staff could see if a large chunk of the tree could be removed or if pieces of the tree could be saved to repurpose it as an art piece. The following individuals called into the City Council Meeting and voiced their comments for the record: Don Christiansen spoke about the pros and cons of removing the tree stump. Mercedes Martin expressed her concern with changes occurring in the Carlsbad Village and supported the repurposing of the tree trunk into a bench or art piece. In response to an inquiry from Mayor Hall, Parks & Recreation Director Lancaster explained that the cost of repurposing the tree stump into an art piece will likely be less than $10,000. In response to an inquiry from Mayor Hall, Parks & Recreation Director Lancaster explained that the rest of the wood that was cut down with the tree was sent to two different mills and repurposed. Motion by Council Member Schumacher, seconded by Council Member Acosta, directing staff to return with a report regarding the cost of relocating the heritage tree stump as an art piece to a city park. MAYORAL APPOINTMENT OF ONE MEMBER TO THE BUENA VISTA LAGOON JOINT POWERS COMMITTEE -Adoption of Resolution No. 2021-158 appointing one member to the Buena Vista Lagoon Joint Powers Committee. {Staff contact: Tammy McMinn, City Clerk Department) City Manager's Recommendation: Adopt the resolution. The following individual called into the City Council Meeting and voiced their comment for the record: Glen Stimmel voiced his interest and qualifications to serve on the Buena Vista Lagoon Joint Powers Committee. Mayor Pro Tern Blackburn disclosed that he interviewed Glen Stimmel prior to City Council meeting. Motion by Mayor Hall, seconded by Mayor Pro Tern Blackburn, to adopt Resolution No. 2021- 158 appointing Glen Stimmel to serve as a member on the Buena Vista Lagoon Joint Powers Committee. Motion carried unanimously, 5/0. COUNCIL REPORTS AND COMMENTS: Mayor Hall and the City Council Members reported on activities and meetings of some committees and subcommittees of which they are members. Mayor Hall announced that the City Council Special Meeting on 5G Cellular Technology and Wireless Communication Facilities Workshop would be held on June 23, 2021 and the City Council Special Meeting on Developing a Values-Based Ethics Code would be held on June 29, 2021. Minute Motion by Council Member Acosta, seconded by Council Member Bhat-Patel, directing the City Manager to return to the City Council with a draft City Council Policy which outlines the process for how city resources, including staff, are able to be equitably and feasibly managed as it relates to Council Member requests for community meetings on a district and city-wide basis.
